题目军校文职人员权益保障研究-以长春地区军事院校为例姓名霍亮长春工业大学分类号:TP300单位代码:10190研究生学号:20090911密级:无硕士学位论文军校文职人员权益保障研究———以长春地区军事院校为例RightsandInterestsGuaranteeforCivilianStaffinMilitaryAcadmy–TakeMilitaryAcadmiesofChangchunasanExample研究生姓名:霍亮专业:社会保障指导教师姓名:高德春指导教师职称:教授2012年4月长春工业大学硕士学位论文I摘要文职人员是指按照规定的编制聘用到军队工作,履行现役军官(文职干部)同类岗位相应职责的非现役人员。聘用文职人员是在军校和文职人员遵循双方地位平等的原则上,以合同形式,明确规定双方的权利、义务和责任,有利于国防教育发展的一项重要制度。聘用文职人员制度是我国军队力量构成和用人制度改革的一项重大举措。军校聘用文职人员其目的是建立身份与岗位分离、可上可下、可进可出、灵活高效的用人机制。建立军队文职人员制度意义重大。一方面,文职人员制度是军队自身发展的需要。另一方面,实施文职人员制度是加强军校教员队伍建设的有效途径。施行文职人员制度对优化我军体制编制结构、合理利用社会智力资源具有重要的意义。随着文职人员制度的实施,从地方到军校来的文职人员更加注重保障自己的合法权益。随着更多文职人员走入军队院校,和更多的文职干部转业变成文职人员,由权益引发的各种问题会逐渐显现出来。如何更好的保障军校文职人员的合法权益,已经是放在总部机关和全军院校面前急需研究解决的一个重要问题。军校文职人员在了解军校管理制度的同时,应该通过学习法律法规知识来增强自己权益与义务的意识,提高自身的法律素质,以此来提升自我合法权益保障的能力。军校则应通过以下四个方面来加强对文职人员合法权益的保障:1.构建军校文职人员权益保障机制;2.构建军校文职人员发展机制;3.构建军校文职人员工作评价机制;4.构建军校文职人员维权机制。军队则应建立健全、有效的文职人员条例条令,实施配套的社会保障机制来保障文职人员的合法权益。三者有效的配合才能多方位、多层次的保障军校文职人员的合法权益。关键词:文职人员聘用制权益保障长春工业大学硕士学位论文IIAbstractCivilianstaffisthosewhoemployinmilitaryinaccordancewiththerelevantprovisionsofcivilestablishment,andperformtheobligationofofficersinactiveservicewhoareinthesameposition.Theybelongtonon-activecivilianstaff.Thesystemofemployingcivilianstaffreferstostipulatingtherights,obligationandresponsibilityofbothpartiesclearlyinaccordancewithequalprinciplesofbothpartiesbywayofcontract.Itissoimportantfordevelopingthenationaldefenseeducation.Theimplementationofemployingcivilianstaffsystemisamajormeasureofthereformofourarmedforceconstitutionandpersonnelmanagingsystem.EmployingCivilianstaffinmilitaryacademyistobuildpersonnelmanagingsystemwhichisseparationofidentityandpost,theflexibleandefficient.Itisofgreatsignificancetoestablishthecivilianstaffsystem.Ononehand,thecivilianstaffsystemistheneedofdevelopmentofthearmy.Ontheotherhand,theimplementationofemployingcivilianstaffsystemisaneffectivewaytostrengthentheconstructionofthemilitaryinstructors.Moreover,itisofgreatsignificancetooptimizetheorganizationalstructureofourarmyandmaketherationaluseofsocialintelligenceresources.Withtheimplementationofthecivilianstaffsystem,thecivilianstaffsthatarefromthelocaltothemilitaryacademypaycloserattentiontosafeguardtheirs’lawfulrightsandinterests.However,variousproblemscausedbyrightsandinterestswillgraduallyemergewithmoreandmorecivilianstaffsintomilitaryacademy,especiallyofficersinactiveservicedemobilizedintocivilianstaffs.HowtosafeguardrightsandinterestsofthecivilianstaffsinmilitaryacademyhasbecomeanimportantproblemandurgenttosolvebytheorganofPLAGeneralDepartmentsandinstitutionofthearmy.Civilianstaffsinmilitaryacademyshouldnotonlyenhancetheconsciousnessofrightsandobligations,butalsostrengthentheirownqualitiesbylearningtheknowledgeoflawsandregulationsonthebasisofgettingtoknowtheprinciplesofmanagement,sothatenhancethecapabilitytoself-protectthelegitimaterightsandinterests.Militaryacademieswillintensifytheprotectionofthelegitimaterightsandinterestsofcivilianstaffsbythefollowingfouraspects:1.Constituterightsandinterestsprotectionmechanismofcivilianstaffsinmilitaryacademy2.Constitutethedevelopmentmechanismofcivilianstaffsinmilitaryacademy3.Constitutetheworkevaluationmechanismofcivilianstaffsinmilitaryacademy长春工业大学硕士学位论文III4.ConstitutetherightprotectionmechanismofcivilianstaffsinmilitaryacademyThearmyshouldestablishthesoundandeffectiverulesandregulationsofcivilianstaffs,meanwhileshouldimplementmatchedsocialsecuritymechanismtoprotectthelegitimaterightsandinterestsofcivilianstaffs.Inconclusion,ifthethreeaspectscooperateeffectively,thelegitimaterightsandinterestsofcivilianstaffscanbeprotectedmultilayeredandmultiaspectedly.Keywords:Civilianstaffsystemofemploymentrightsandinterestsguarantee长春工业大学硕士学位论文1目录摘要.........................................................................................................................................IAbstract....................................................................................................................................II导言..........................................................................................................................................1(一)论文的选题意义.................................................................................................................................1(二)论文的结构及创新点.........................................................................................................................2(三)全文的研究方法及数据来源.............................................................................................................2(四)文献综述.............................................................................................................................................2(五)相关概念的界定.................................................................................................................................3一、军校文职人员的法律地位及其权益保障........................................................................5(一)我军文职人员的由来及文职人员的发展状况.................................................................................5(二)聘用制下的军校文职人员的法律
