U.S.NUCLEARREGULATORYCOMMISSIONREGULATORYSeptember1995GUIDEOFFICEOFNUCLEARREGULATORYRESEARCHREGULATORYGUIDE1.163(DraftwasDG-1037)PERFORMANCE-BASEDCONTAINMENTLEAK-TESTPROGRAMA.INTRODUCTIONTheNuclearRegulatoryCommissionhasamendeditsregulations(60FR49495)toprovideaperformance-basedoption,OptionB,forleakage-ratetestingofcontainmentsoffight-water-coolednuclearpowerplants.LicenseesmayvoluntarilycomplywiththisOptionBasanalternativetocompliancewiththecurrentrequirementsinAppendixJ,PrimaryReactorContainmentLeakageTestingforWater-CooledPowerReactors,to10CFRPart50,DomesticLicensingofProductionandUtilizationFacilities.Theamendmentisaimedatimprovingthefocusofthebodyofregulationsbyeliminatingprescriptiverequirementsthataremarginaltosafetyandbyprovidinglicenseesgreaterflexibilityforcost-effectiveimplementationmethodsforregulatorysafetyobjectives.Thisregulatoryguideprovidesguidanceonanacceptableperformance-basedleak-testprogram,leakage-ratetestmethods,procedures,andanalysesthatmaybeusedtocomplywiththeperformance-basedOptionBinAppendixJto10CFRPart50.TheinformationcollectionscontainedinthisregulatoryguidearecoveredbytherequirementsinAppendixJto10CFRPart50,whichhavebeenapprovedbytheOfficeofManagementandBudgetApprovalnumber3150-0011.B.DISCUSSIONTheCommissionhasstatedthatfutureregulatoryinitiativesshoulduseaperformance-orientedandriskbasedregulatoryapproachinwhichsafetystandardsareestablishedbaseduponrisk,regulatoryrequirementsareexpressedintermsofmeetingaperformancestandard,andregulatedentitiesareprovidedflexibilitytoadoptcost-effectivemethodsforcomplyingwiththeperformance-basedsafetystandard.SeeStaffRequirementsMemorandumdatedMay18,1994,onSECY-94-090,InstitutionalizationofContinuingProgramforRegulatoryImprovement.1Inaccordancewiththepolicythatregulatedentitiesshouldbeallowedflexibilitytoadoptcost-effectivemethodsforcomplyingwithregulatoryrequirements,detailedtechnicalmethodsforcompliancewiththeperformancestandardwouldnotbeincorporatedintotheregulatoryrequirement.Instead,thedetailedmethodswouldbedescribedeitherinNRCregulatoryguidesorinindustrystandardsandguidancedocumentsthatarereviewedandapprovedbytheNRClCopiesareavailableforinspectionorcopyingforafeefromtheNRCPublicDocumentRoomat2120LStreetNW.,Washington,DC;thePDR'smailingaddressIsMallStopLL-6,Washington,DC20555;telephone(202)634-3273;fax(202)634-3343.USNRCREGULATORYGUIDESWrittencommentsmaybesubmittedtotheRulesReviewandDirectivesBranch,DFIPS,ADM,U.S.NuclearRegulatoryCommission,WashingRegulatoryGuidesareIssuedtodescribeandmakeavailabletothepublicton,DC20555-0001.suchinformationasmethodsacceptabletotheNRCstaffforImplementingspecificpartsoftheCommission'sregulations,techniquesusedbyTheguidesareIssuedInthefollowingtenbroaddivisions:thestaffInevaluatingspecificproblemsorpostulatedaccidents,and1.PowerReactors6.ProductsdataneededbytheNRCstaffInitsreviewofapplicatlonsforpermitsand2.ResearchandTestReactors7.Transportationlicenses.Regulatoryguidesarenotsubstitutesforregulations,andcom-3.FuelsandMaterialsFacilitiesS.OccupationalHealthpliancewiththemIsnotrequired.Methodsandsolutionsdifferentfrom4.EnvironmentalandSiting9.AntitrustandFinancialReviewthosesetoutIntheguldeswillbeacceptableIftheyprovideabasisforthe5.MaterialsandPlantProtection10.GeneralfindingsrequisitetotheIssuanceorcontinuanceofapermitorlicensebySinglecopiesofregulatoryguidesmaybeobtainedfreeofchargebywrittheCommission.IngtheOfficeofAdministration,Attention:DistributionandServicesSection,U.S.NuclearRegulatoryCommission,Washington,DCThisguidewasIssuedafterconsiderationofcornmentsreceivedfromthe20555-0001;orbyfaxat(301)415-2260.public.CommentsandsuggestionsforImprovementsintheseguidesareIssuedguidesmayalsobepurchasedfromtheNationalTechnicalinforencouragedatalltimes,andguideswillberevised,asappropriate,tomationServiceonastandingorderbasis.DetailsonthisservicemaybeaccommodatecommentsandtoreflectnewInformationorexperience,obtainedbywritingNTIS,5285PortRoyalRoad,Springfield,VA22161.Istaffasanacceptablemeansfordemonstratingcompliancewiththeregulatoryrequirement.Consistentwiththisapproach,therevisiontoAppendixJof10CFRPart50islessprescriptive,utilizesrisk-basedinsights,andallowsthelicenseetheflexibilitytoadoptcost-effectivemethods,includingsettingtestintervals,forimplementingthesafetyobjectivesunderlyingtherequirementsofAppendixJ.Thisregulatoryguideapprovesanindustryguidelinethatdescribesindetailaperformance-basedleak-testprogram,leakage-ratetestmethods,procedures,andanalyses;theNRCstaffhasdeterminedthisindustryguidelinetobeanacceptablemeansofdemonstratingcompliancewiththerequirementsoftheamendmentofAppendixJto10CFRPart50.C.REGULATORYPOSITIONNEI94-01,Revision0,datedJuly26,1995,IndustryGuidelineforImplementingPerformanceBasedOptionof10CFR50AppendixJ,IpreparedbytheNuclearEnergyInstitute,providesmethodsacceptabletotheNRCstaffforcomplyingwiththeprovisionsofOptionBinAppendixJto10CFRPart50,subjecttothefollowing:1.NEI94-01referencesANSI/ANS-56.8-1994,ContainmentSystemLeakageTestingRequirements,2fordetaileddescriptionsofthetechnicalmethodsa
