TheU.S.NuclearRegulatoryCommission(NRC)issuesregulatoryguidestodescribeandmakeavailabletothepublicmethodsthattheNRCstaffconsidersacceptableforuseinimplementingspecificpartsoftheagency’sregulations,techniquesthatthestaffusesinevaluatingspecificproblemsorpostulatedaccidents,anddatathatthestaffneedsinreviewingapplicationsforpermitsandlicenses.Regulatoryguidesarenotsubstitutesforregulations,andcompliancewiththemisnotrequired.MethodsandsolutionsthatdifferfromthosesetforthinregulatoryguideswillbedeemedacceptableiftheyprovideabasisforthefindingsrequiredfortheissuanceorcontinuanceofapermitorlicensebytheCommission.Thisguidewasissuedafterconsiderationofcommentsreceivedfromthepublic.Regulatoryguidesareissuedin10broaddivisions:1,PowerReactors;2,ResearchandTestReactors;3,FuelsandMaterialsFacilities;4,EnvironmentalandSiting;5,MaterialsandPlantProtection;6,Products;7,Transportation;8,OccupationalHealth;9,AntitrustandFinancialReview;and10,General.ElectroniccopiesofthisguideandotherrecentlyissuedguidesareavailablethroughtheNRC’spublicWebsiteundertheRegulatoryGuidesdocumentcollectionoftheNRC’sElectronicReadingRoomat’sAgencywideDocumentsAccessandManagementSystem(ADAMS)at(DraftwasissuedasDG-1135,datedMay2006)ASMECODECASESNOTAPPROVEDFORUSEA.INTRODUCTIONInTitle10,Part50,oftheCodeofFederalRegulations(10CFRPart50),“DomesticLicensingofProductionandUtilizationFacilities”(Ref.1),Section50.55a(c),“ReactorCoolantPressureBoundary,”requires,inpart,thatcomponentsofthereactorcoolantpressureboundarybedesigned,fabricated,erected,andtestedinaccordancewiththerequirementsforClass1componentsofSectionIII,“RulesforConstructionofNuclearPowerPlantComponents,”oftheAmericanSocietyofMechanicalEngineers(ASME)BoilerandPressureVessel(BPV)Code(Ref.2)orequivalentqualitystandards.Section50.55a(f),“InserviceTestingRequirements,”requires,inpart,thatClass1,2,and3componentsandtheirsupportsmeettherequirementsoftheASMECodeforOperationandMaintenanceofNuclearPowerPlants(OMCode)(Ref.3)orequivalentqualitystandards.Finally,10CFR50.55a(g),“InserviceInspectionRequirements,”requires,inpart,thatClass1,2,3,MC(metalcontainment),andCC(concretecontainment)componentsandtheirsupportsmeettherequirementsofSectionXI,“RulesforInserviceInspectionofNuclearPowerPlantComponents,”oftheASMEBPVCodeorequivalentqualitystandards.TheASMEpublishesaneweditionoftheBPVandOMCodesevery3yearsandnewaddendaeveryyear.ThelatesteditionsandaddendaofSectionIII,SectionXI,andtheOMCodethattheU.S.RG1.193,Rev.2,Page2NuclearRegulatoryCommission(NRC)hasapprovedforusebylicenseesarereferencedin10CFR50.55a(b).TheASMEalsopublishesCodeCasesforSectionIIIandSectionXIquarterlyandCodeCasesfortheOMCodeyearly.CodeCasesprovidealternativesdevelopedandapprovedbytheASME.TheNRCstaffhasreviewedSectionIIIandSectionXICodeCaseslistedinSupplements7–12tothe2001Edition,andSupplement1tothe2004EditionoftheASMEBPVCode.Revision34ofRegulatoryGuide1.84,“Design,Fabrication,andMaterialsCodeCaseAcceptability,ASMESectionIII”(Ref.4),andRevision15ofRegulatoryGuide1.147,“InserviceInspectionCodeCaseAcceptability,ASMESectionXI,Division1”(Ref.5),havebeenrevisedtoidentifytheCodeCasesthattheNRChasdeterminedtobeacceptablealternativestoapplicablepartsofSectionIIIandSectionXI.TheselatestrevisionsspecifytheCodeCasesdeterminedtobeacceptable.ThisregulatoryguidedoesnotapprovetheuseoftheCodeCaseslistedherein.BecausethisregulatoryguidedoesnotapprovetheuseoftheCodeCaseslistedherein,itdoesnotcontainneworamendedinformationcollectionrequirementssubjecttothePaperworkReductionActof1995(Ref.6).TheNRCmayneitherconductnorsponsor,andapersonisnotrequiredtorespondto,aninformationcollectionrequestorrequirementunlesstherequestingdocumentdisplaysacurrentlyvalidcontrolnumberissuedbytheOfficeofManagementandBudget(OMB).B.DISCUSSIONThisregulatoryguideliststheCodeCasesthattheNRChasdeterminednottobeacceptableforuseonagenericbasis.AbriefdescriptionofthebasisforthedeterminationisprovidedwitheachCodeCase.LicenseesmaysubmitarequesttoimplementoneormoreoftheCodeCaseslistedbelowthrough10CFR50.55a(a)(3),whichpermitstheuseofalternativestotheCoderequirementsreferencedin10CFR50.55a,providedthattheproposedalternativesresultinanacceptablelevelofqualityandsafety.Licenseesmustsubmitaplant-specificrequestthataddressestheNRC’sconcernsabouttheCodeCaseatissue.C.REGULATORYPOSITIONForthisguide,theNRCstaffreviewedtheSectionIIIandSectionXICodeCaseslistedinSupplements7–12tothe2001Edition,andSupplement1tothe2004EditionoftheASMEBPVCode.LicenseesmustnotimplementCodeCaseslistedinthisguidewithoutpriorNRCapproval.1.UnacceptableSectionIIICodeCasesTheNRCdeterminedthatthefollowingSectionIIICodeCasesareunacceptableforusebylicenseesintheirSectionIIIdesignandconstructionprograms.RG1.193,Rev.2,Page3Table1.UnacceptableSectionIIICodeCasesCodeCaseNumberTable1UnacceptableSectio
