U.S.NUCLEARREGULATORYCOMMISSIONDecember2009Revision1REGULATORYGUIDEOFFICEOFNUCLEARREGULATORYRESEARCHTheNRCissuesregulatoryguidestodescribeandmakeavailabletothepublicmethodsthattheNRCstaffconsidersacceptableforuseinimplementingspecificpartsoftheagency’sregulations,techniquesthatthestaffusesinevaluatingspecificproblemsorpostulatedaccidents,anddatathatthestaffneedsinreviewingapplicationsforpermitsandlicenses.Regulatoryguidesarenotsubstitutesforregulations,andcompliancewiththemisnotrequired.MethodsandsolutionsthatdifferfromthosesetforthinregulatoryguideswillbedeemedacceptableiftheyprovideabasisforthefindingsrequiredfortheissuanceorcontinuanceofapermitorlicensebytheCommission.Thisguidewasissuedafterconsiderationofcommentsreceivedfromthepublic.Regulatoryguidesareissuedin10broaddivisions:1,PowerReactors;2,ResearchandTestReactors;3,FuelsandMaterialsFacilities;4,EnvironmentalandSiting;5,MaterialsandPlantProtection;6,Products;7,Transportation;8,OccupationalHealth;9,AntitrustandFinancialReview;and10,General.ElectroniccopiesofthisguideandotherrecentlyissuedguidesareavailablethroughtheNRC’spublicWebsiteundertheRegulatoryGuidesdocumentcollectionoftheNRC’sElectronicReadingRoomat’sAgencywideDocumentsAccessandManagementSystem(ADAMS)at(DraftwasissuedasDG-1218,datedMarch2009)RISK-INFORMED,PERFORMANCE-BASEDFIREPROTECTIONFOREXISTINGLIGHT-WATERNUCLEARPOWERPLANTSA.INTRODUCTIONThisregulatoryguideprovidesguidanceforuseincomplyingwiththerequirementsthattheU.S.NuclearRegulatoryCommission(NRC)haspromulgatedforrisk-informed,performance-basedfireprotectionprograms(FPPs)thatcomplywithTitle10,Section50.48(c),oftheCodeofFederalRegulations(10CFR50.48(c))(Ref.1)andthereferenced2001EditionoftheNationalFireProtectionAssociation(NFPA)standard,NFPA805,“Performance-BasedStandardforFireProtectionforLight-WaterReactorElectricGeneratingPlants”(Ref.2).Inaccordancewith10CFR50.48(a),eachoperatingnuclearpowerplantmusthaveafireprotectionplanthatsatisfiesGeneralDesignCriterion(GDC)3,“FireProtection,”ofAppendixA,“GeneralDesignCriteriaforNuclearPowerPlants,”to10CFRPart50,“DomesticLicensingofProductionandUtilizationFacilities.”Inaddition,plantsthatwerelicensedtooperatebeforeJanuary1,1979,mustmeettherequirementsofAppendixR,“FireProtectionProgramforNuclearPowerFacilitiesOperatingPriortoJanuary1,1979,”to10CFRPart50,excepttotheextentprovidedforin10CFR50.48(b).TheNRCrequiresplantslicensedtooperateafterJanuary1,1979,tocomplywith10CFR50.48(a),aswellasanyplant-specificfireprotectionlicenseconditionsandtechnicalspecifications.Rev.1ofRG1.205,Page2Paragraph(c)of10CFR50.48,“FireProtection,”adoptedbytheNRCin2004(69FederalRegister(FR)33536;June16,2004)(Ref.3),incorporatesNFPA805byreference,withcertainexceptions,andallowslicenseestoadoptandmaintainanFPPthatmeetstherequirementsofNFPA805,asanalternativeto10CFR50.48(b)ortheplant-specificfireprotectionlicenseconditions.Licenseeswhochoosetocomplywith10CFR50.48(c)mustsubmitalicenseamendmentapplicationtotheNRC,inaccordancewith10CFR50.90,“ApplicationforAmendmentofLicense,ConstructionPermit,orEarlySitePermit.”Paragraph(c)(3)of10CFR50.48describestherequiredcontentsoftheapplication.TheNuclearEnergyInstitute(NEI)developedNEI04-02,Revision2,“GuidanceforImplementingaRisk-Informed,Performance-BasedFireProtectionProgramUnder10CFR50.48(c),”issuedApril2008(Ref.4),toassistlicenseesinadopting10CFR50.48(c)andmakingthetransitionfromtheircurrentFPPtoonebasedonNFPA805.ThisregulatoryguideendorsesportionsofNEI04-02,Revision2,whereithasbeenfoundtoprovidemethodsacceptabletotheNRCforimplementingNFPA805andcomplyingwith10CFR50.48(c).TheregulatorypositionsinSectionCbelowincludeclarificationoftheguidanceprovidedinNEI04-02,aswellasNRCexceptionstotheguidance.TheregulatorypositionsinSectionCtakeprecedenceovertheguidanceinNEI04-02.AllreferencestoNEI04-02inthisregulatoryguiderefertoRevision2ofthatNEIguidancedocument.AllreferencestoNFPA805inthisregulatoryguiderefertothe2001editionofNFPA805.WherethisregulatoryguidereferstoanFPPorlicenseofanuclearpowerplantasbeingincompliancewith,ormeeting,therequirementsofNFPA805,thestaffmeanscompliancewith10CFR50.48(c)andtheapplicableportionsofNFPA805.Thisregulatoryguidecontainsinformationcollectionrequirementscoveredby10CFRPart50thattheOfficeofManagementandBudget(OMB)approvedunderOMBcontrolnumber3150-0011.TheNRCmayneitherconductnorsponsor,andapersonisnotrequiredtorespondto,aninformationcollectionrequestorrequirementunlesstherequestingdocumentdisplaysacurrentlyvalidOMBcontrolnumber.B.DISCUSSIONBackgroundThefireprotectionrequirementsof10CFR50.48(b),AppendixRto10CFRPart50,andtheassociatedregulatoryguidance,areprescriptiveinthattheyidentifyspecificmethodsforensuringnuclearsafetyintheeventofafire.Theindustryandsomemembersofthepublichavecharacterizedtheserequirementsascreatinganunnecessaryregulatoryburdentoachieveanacceptableleveloffiresafetyandcomplywiththegeneral,performance-basedr
