’sRepublicofChinaDecreeNo.70oftheChairmanofthePeople’sRepublicofChinaPromulgationDate:pd29thJune2002/pdEffectiveDate:ed1stNovember2002/edPromulgatedby:pbTheNinthNationalPeople’sCongress/pbTableofContentsChapterI.GeneralPrinciplesChapterII.ProductionSafetyGuarantiesforProductionOperationUnitsChapterIII.TheRightsandObligationsoftheEmployeesChapterIVTheSupervisionandAdministrationofProductionSafetyChapterVEmergencyRescueforanAccidentandItsInvestigationandDisposalChapterVILegalLiabilityChapterVIISupplementaryRulesChapterIGeneralPrinciplesArticle1Inordertostrengthenthesupervisionandadministrationofproductionsafety,topreventandreducetheaccidents,toguaranteethepeople’slifeandpropertysafety,andtopromotetheeconomicdevelopment,thislawisherebyenacted.Article2ThisLawshallapplytotheproductionsafetyinvolvingtheunitsengagedinproductionoperationswithintheterritoryofthePeople’sRepublicofChina(hereinafterreferredtoasthe“productionoperationunits”).Therelevantlawsandadministrativeregulationsconcerningfireprotectionsafety,roadtrafficsafety,railwaytrafficsafety,marinetrafficsafetyandcivilaviationsafetyshallalsoapplyifavailable..Article3Theadministrationofproductionsafetyshallcomplywiththeguidelineof“safetyandprecautionfirst.”Article4ProductionoperationunitsshallabidebythisLaw,otherlawsandadministrativeregulationsonproductionsafety,strengthenthecontroloverproductionsafety,establishandperfectliabilitysystemofproductionsafety,improvesafetyconditions,andensureproductionsafety.Article5Thepersonnelchieflyinchargeofproductionoperationunitsshalltakeoverallresponsibilityfortheirownproductionsafety.’sgovernmentsatalllevelsshallstrengthentheguidanceofproductionsafetywork,supportandoverseealltherelevantdepartmentstofulfilltheirresponsibilityforsafetycontrolandsupervisionaccordingtolaw.Article9TheStateCouncildepartmentinchargeofthecontrolandsupervisionofproductionsafetyshallcarryouttheoverallsupervisionandadministrationofproductionsafetythroughoutthenationaccordingtolaw;thedepartmentsofthepeople’slocalgovernmentsatandabovethecountylevelinchargeofthecontrolandsupervisionofproductionsafetyshallaccordingtolawcarryouttheoverallsupervisionandadministrationofproductionsafetywithintheiradministrativedivisions.AccordingtothisLawandtheprovisionsofotherlawsandadministrativeregulations,thedepartmentsconcernedintheStateCouncilshallcontrolandoverseetheproductionsafetywithintheirownresponsibilityrange;thedepartmentsconcernedinthelocalpeople’sgovernmentsabovethecountylevelshallcontrolandoverseetheproductionsafetywithintheirindividualresponsibilityrangeinaccordancewiththisLawandtheprovisionsofotherlawsandadministrativeregulations.Article10TheStateCouncildepartmentsconcernedshallaccordingtolawconstituteforthwithnationalstandardsortradestandardsbasedontherequirementsofproductionsafetyguaranties,andmaketimelyrevisionsinthelightoftechnologicalandeconomicdevelopment.Productionoperationunitsshallcarryoutthenationalstandardsortradestandardsguaranteeingproductionsafetyestablishedaccordingtolaw.Article11Thepeople’sgovernmentsatalllevelsandtherelevantdepartmentsshalladoptvariousmeanstostrengthenthelawsandprovisionsconcerningproductionsafetyandwidenthepublicityofproductionsafetyknowledge,andimprovetheemployees’awarenessofproductionsafety.Article12Theintermediaryorgansestablishedaccordingtolaw,shall,entrustedbytheproductionoperationunits,supplytechnologicalservicesforproductionsafetyworkinaccordancewiththelaws,administrativeregulationsandlicenseguidelines.(1)Toestablishandimproveproductionsafetyresponsibilitysystem(2)Toorganizeande
