DIRECTIVE2006/122/ECOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof12December2006amendingforthe30thtimeCouncilDirective76/769/EEContheapproximationofthelaws,regulationsandadministrativeprovisionsoftheMemberStatesrelatingtorestrictionsonthemarketinganduseofcertaindangeroussubstancesandpreparations(perfluorooctanesulfonates)(TextwithEEArelevance)THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyestablishingtheEuropeanCommu-nity,andinparticularArticle95thereof,HavingregardtotheproposalfromtheCommission,HavingregardtotheOpinionoftheEuropeanEconomicandSocialCommittee(1),ActinginaccordancewiththeprocedurelaiddowninArticle251oftheTreaty(2),Whereas:(1)AnOECD(OrganisationforEconomicCooperationandDevelopment)hazardassessmenthasbeendoneonthebasisofinformationthatwasavailablebyJuly2002.Thisassessmentconcludedthatperfluorooctanesulfonates(hereinafter‘PFOS’)arepersistent,bioaccumulativeandtoxictomammalianspeciesand,therefore,indicatecauseforconcern.(2)TherisksposedtohealthandenvironmentbyPFOShavebeenassessedinaccordancewiththeprinciplesofCouncilRegulation(EEC)No793/93of23March1993ontheevaluationandcontroloftherisksofexistingsub-stances(3).Theriskassessmentidentifiedaneedtoreducetheriskstohealthandtheenvironment.(3)TheScientificCommitteeonHealthandEnvironmentalRisks(hereinafter‘SCHER’)hasbeenconsulted.SCHERconcludedthatPFOSfulfilthecriteriaforclassificationasverypersistent,verybioaccumulativeandtoxic.PFOSalsohaveapotentialforlongrangeenvironmentaltransportandhavethepotentialtoproduceadverseeffectsandthereforefulfilthecriteriaforbeingconsideredaspersistentorganicpollutants(POPs)undertheStockholmConven-tion(4).SCHERidentifiedaneedforfurtherscientificriskassessmentofPFOSbutitalsoagreedthatriskreductionmeasuresmightbenecessarytoavoidthere-occurrenceofformeruses.AccordingtoSCHER,on-goingcriticalusesintheaviationindustry,thesemiconductorindustryandthephotographicindustrydonotappeartoposearelevantrisktotheenvironmentorhumanhealth,ifreleasesintotheenvironmentandworkplaceexposureareminimised.Withregardtofire-fightingfoams,SCHERagreesthathealthandenvironmentalrisksofsubstitutesshouldbeassessedbeforeafinaldecisioncanbetaken.SCHERalsoagreeswithrestrictingtheuseofPFOSintheplatingindustry,iftherearenoothermeasuresavailablethatcouldbeappliedtoreducetheemissionsduringmetalplatingtoasignificantlylowerlevel.(4)Inordertoprotecthealthandtheenvironment,itthereforeappearsnecessarythattheplacingonthemarketandtheuseofPFOSshouldberestricted.ThisDirectiveisintendedtocoverthemajorpartoftheexposurerisks.OtherminorusesofPFOSdonotseemtoposeariskandtheyarethereforecurrentlyexempted.However,specialattentionshouldbegiventoplatingprocessesusingPFOSandthereforethereleasesfromthoseprocessesneedtobeminimisedbyapplyingthebestavailabletechniques(hereinafter‘BAT’)fullytakingintoaccountallrelevantinformationcontainedintheBATreferencedocumentonSurfaceTreatmentofMetalsandPlasticsasdevelopedforuseunderCouncilDirective96/61/ECof24September1996concerningintegratedpollutionpreventionandcontrol(5)(IPPCDirective).Inaddition,MemberStatesshouldestablishinventoriesofthoseusesinordertoacquireinformationabouttheactualquantitiesusedandreleased.(5)Thesemi-finishedproductsandarticlescontainingPFOSshouldalsoberestrictedinordertoprotecttheenviron-ment.TherestrictionshouldcoveralltheproductsandarticlestowhichPFOSareintentionallyadded,takingintoaccountthatPFOSmayhavebeenusedonlyinsomedistinctpartsorincoatingsofcertainproductsandarticles,suchastextiles.ThisDirectiveshouldonlyrestrictnewproductsandshouldnotapplytoproductsalreadyinuseoronthesecondhandmarket.However,existingstocksoffire-fightingfoamscontainingPFOSshouldbeidentifiedandtheiruseshouldbeallowedtocontinueonlyforalimitedtimetopreventpossiblefurtheremissionsfromtheuseofsuchproducts.L372/32ENOfficialJournaloftheEuropeanUnion27.12.2006(1)OJC195,18.8.2006,p.10.(2)OpinionoftheEuropeanParliamentof25October2006(notyetpublishedintheOfficialJournal)andCouncilDecisionof11December2006.(3)OJL84,5.4.1993,p.1.RegulationasamendedbyRegulation(EC)No1882/2003oftheEuropeanParliamentandoftheCouncil(OJL284,31.10.2003,p.1).(4)CouncilDecision2006/507/ECof14October2004concerningtheconclusion,onbehalfoftheEuropeanCommunity,oftheStock-holmConventiononPersistentOrganicPollutants(OJL209,31.7.2006,p.1).(5)OJL257,10.10.1996,p.26.DirectiveaslastamendedbyRegulation(EC)No166/2006oftheEuropeanParliamentandoftheCouncil(OJL33,4.2.2006,p.1).RoHS()---RoHS---RoHSRoHS(),710Web::rohscn@163.com(6)Toensureultimatelythephase-outofusesofPFOStheCommissionshouldrevieweachderogationunderthisDirectivewhennewinformationontheusesandsaferalternativesdevelopedgivesgroundsforit.Thederogationshouldonlybeallowedtocontinueforessentialusesontheconditionthatsafersubstancesortechnologies,thataretechnicallyandeconomicallyfeasible,donotexistandBATareappliedtominimiseemissionsofPFOS.(7)Perfluorooctanoicacid(PFOA)anditssaltsaresuspectedtohaveasimilarriskprofil
