MD/J/EmplymentContract-1-KhanThorntonEMPLOYMENTCONTRACT劳动合同EMPLOYER’SNAME:____________________________________________________公司名称:______________________________________________________________ADDRESS:______________________________________________________________地址:_____________________________________________________________ThisstatementisissuedinaccordancewiththecurrentemploymentlegislationandsetsoutthetermsandconditionsofyouremploymentwiththeEmployer.本合同符合现行劳动法规,阐明了用工期间的各项条件条款。EMPLOYEE'SNAME:_____________________________________________________员工姓名:EMPLOYEE'SADDRESS___________________________________________________通讯地址:Youremploymentwillbeginon:_____________________________________________到岗时间:JOBTITLE:_____________________________________________________________职位:FromtimetotimetheManagementmayconsideritnecessaryforyoutodootherjobswithinyourskillandcompetence.根据现实需要,管理者有时会要求你做能力范围内的其他工作PAY:_____________________________________________________________________薪酬:YourwageswillbepaidatmonthlyintervalsandwillbepaiddirectlyintoyourBankaccountonthelastdayofeachmonth.工资实行每月结付,会在每月最后一天打入你的银行账户。Yourbasichourlyrateis£_______perhourper______hourweekandwillbesubjecttoreviewfromtimetotimebutnotlessthanannually.基本时薪为____英镑/时;____小时/周;可能会有微调,但年薪不变。WhenitisrequiredforyoutoworkovertimethiswillbecompensatedattheEmployer'sdiscretioneitherbytimeoffinlieuorbypaymentataratenolessthanyourbasichourlyrate.如需加班,则公司根据加班时间或不少于基本时薪的方式给付加班费。NORMALHOURSOFWORK:MD/J/EmplymentContract-2-KhanThornton正常工作时间:MondaytoFriday周一至周五09.00hoursto17.00hours9:00—17:00MD/J/EmplymentContract-3-KhanThornton(EmploymentContract–Cont’d.)(劳动合同——续上页)HOLIDAYENTITLEMENTANDPAY:休假及薪酬TheEmployeeisentitledto__________workinghoursholidayperyear.员工每年享有_____个工作时的假期。Theholidayyearwillcommenceon1stJanuaryandendon31stDecemberofthesameyear.休假年份计算从1月1日开始到同年12月31日结束。Holidayswillbepaidatbasicratesofpay.休假期间按基本工资计算ALLHOLIDAYSMUSTBEPRE-BOOKEDINAGREEMENTWITHMANAGEMENT.为便于管理,所有休假都必须提前申请。TheEmployerreservestherighttoreimbursementbytheemployeeforanypaymentinexcessofholidayentitlementonterminationofservice.协议终止时,对于员工额外享有的假期福利,公司保留索取赔偿的权利。Allholidaysmustbetakenintheholidayyear-noholidaysmaybecarriedforwardtothefollowingyearwithoutprioragreementwiththemanagement.所有假期都必须在当年休完,未经管理方同意,来年不再补休。CompassionateleavewillbegivensympatheticconsiderationbytheEmployer.TheEmployerhoweverdoesnotholditselfboundtomakeanypaymentforcompassionateleaveunlesstakenaspartofcurrentholidayentitlement.公司出于同情考虑会准许事假,但一般不带薪,除非现行假期福利另有规定。MaternityleavewillbesubjecttotheguidelineslaidoutbytheDepartmentSocialSecurity(DSS)orsuchotherrelevantgovernmentauthorityorlegislationfromtimetotime.产假则遵循社会保障部或政府法规的相关规定。SICKNESS:病假Shouldyoubeunabletoattendworkduetosicknessyouarerequiredtocontactyourimmediatesupervisorby11.00hoursonthefirstdayofincapacity.如果因病不能工作,则必须在生病的第一天11:00之前通知你的直接上司。WheresickleaveexceedsthreedaysinonecontinuousperiodtheEmployerwillpayathalfyourbasicratethefirstthreedays.ThereafterpaywillbeatthecurrentrateofStatutorySickPay.Whereperiodsofincapacityarelinked,aslaiddowninDSSStatutorySickPayregulations,youwillonlyreceiveStatutorySickPayatthecurrentratefromthefirstdayofincapacity.MD/J/EmplymentContract-4-KhanThornton若病假连续超过三天,公司支付三天基本工资的一半。超过三天的部分则按现行照法定病金支付。若病假持续,符合社会保障部法定病金的相关规定,则从病假的第一天起,公司只支付法定病金。ForshorttermperiodsofsicknesstheEmployerwillpayamaximumof10daysinanyoneyearatyourbasicrateforsickleave.对于短期病假,公司按基本工资一年最多可支付10天带薪病假。Wherelongtermsickleaveisnecessary,theEmployeratitsdiscretionwilltopupyourStatutorySickPayentitlementuptoamaximumofonethirdofyourbasicrate,foramaximumperiodof5weeksfromthestartoftheperiodofincapacity.ThereafteryouwillreceiveStatutorySickPaysubjecttotheratesandregulationscurrentlylaiddownbytheDSS.若需请长期病假,公司出于同情可将法定病金最多提升至基本工资的三分之一,支付从病假开始最长5周的时间。此后将按照社会保障部规定的现行法定病金进行支付。MD/J/EmplymentContract-5-KhanThornton(EmploymentContract–Cont’d.)(劳动合同——续上页)TheEmployerreservestheright(atitsowncost)toreimbursementofallpaymentsmadeduringsickleaveshouldtheemployeereceivecompensationfromathirdpartyforanyinjurysustainedorillnesscontractedwhilstrepresentingtheEmployerawayfromtheEmployer'spremises.若员工在病假期间因持续伤病或合同规定的疾病获得了第三方的补助,那么公司有权要求追回病假期间的一切补助。Allleaveduetosicknessmustbesupportedbyabonafidemedicalcertificate.ThismaybeintheformofaSelfCertificate(formSC1)forthefirst5workingdaysandthereafteraCertificatefromyourGeneralPractitioner.所有的病假都应有医学证明,前五天可以是自我证明(SC1格式),此后的由主治医师开具。TheEmployerreservestheright(atitsownexpense)tohaveanindependentmedicalopiniononanyinjuryorsicknessofalongtermnaturewithspecialregardtofuturefitnessforemployment.考虑到未来工作的需要,公司保留对长期伤病独立的医学鉴定权利(费用自理)。AllCompanysickleavewillbecalculatedfrom1stJanuaryto31stDecemberthesameyear.公司所有假条从每年1月1日开始计算至同年12月31日止RIGHTSTONOTICE:权利声明:After4weekscontinuousservicethefollowingperiodsofnoticewillapply:连续工作四周可申请以下休假的权利:ServiceCompletedByEmployerByEmployee工作完成情况公司员工Under12weeks1week1week12周之内1周1周Over12weeks4weeks4weeks12周以上4周4周Youmayberequiredtogiveyournoticeinwriting.请上交手写休假申请Byactualagreementthesenoticescanbewaivedbyeitherparty.TheEmployerreservestherighttow
