December20051FIFAMEDIAGUIDELINESGUIDELINESFORUSEOFFIFA’STRADEMARKSBYTHEMEDIATheseFIFAMediaGuidelinesareissuedbyFédérationInternationaledeFootballAssociation(“FIFA”),theworldgoverningbodyofassociationfootballandorganiserofthe2006FIFAWorldCupGermany™,whichwilltakeplaceinGermanyfrom9June2006to9July2006(the“Event”).PleaseseeAnnex2formoreinformationontheEvent.TheseFIFAMediaGuidelinesareapplicabletoanymediacompanies(inparticularnewspapers)reportingontheEventandsetforthcertainconditionsfortheuseoftheofficialeventtitlesandofficialeventmarks(the“Marks”)developedandusedbyFIFAfortheEvent.1.OfficialEventTitlesThemediaareencouragedtousetheseofficialeventtitlesintheirnon-commercialeditorialarticles.FIFAhassanctionedthefollowingofficialtitlesfortheEvent:•“2006FIFAWorldCupGermany™”•“2006FIFAWorldCup™”•“FIFAWorldCup™”2.OfficialEventMarksFIFAhasdevelopedandprotectedanumberofmarkswhichitwilluseinrelationtotheEventandwhichareshowninAnnex2oftheseFIFAMediaGuidelines.TheMarkshavebeenprotectedinnumerousterritoriesaroundtheworldbytrademarkregistrationand/orcopyrightand/orotherlawsofintellectualpropertysuchasunfaircompetitionorpassingoff.3.DifferentUseoftheMarksTheseMediaGuidelinesdistinguishbetweentheeditorial(non-commercial)andcommercialuseoftheMarks:•Editorial(Non-Commercial)UseoftheMarks:FIFAencouragesthemediatousetheMarkswithinoradjacenttonon-commercialarticlesaboutornewscoverageoftheEvent.However,careshouldbetakentousetheMarkscorrectly,instrictcompliancewithFIFA’sGraphicGuidelines,whichcanbereceivedalongwiththeartworkonrequestfromFIFAMarketing&TV.IncorrectuseoftheMarks,evenfornon-commercialpurposes,maystilldamagethecommercialvalueoftheMarksandFIFAwouldrequestthatanysuchusesbeavoided.December20052•CommercialUseoftheMarks:AnyuseoftheMarksforcommercialpurposesisexplicitlyreservedforFIFAandFIFA’sCommercialAffiliates(seeAnnex1).NootherentitiesareallowedtousetheMarksforcommercialpurposesincludingon,orinrelationto,thesale,advertisementorpromotionofanygoodsorservices.AlthoughitofcourseisnotpossibletolistallpossiblesituationsofunauthorisedcommercialuseoftheMarks,alistofcommonexamplesofsuchunauthorizeduseisattachedtotheguidelinesinAnnex4,toassistthemediainavoidinganypotentialproblems.4.ConditionsfortheUseoftheMarksThemediaisencouragedtousetheMarksforanyeditorialcoverageoftheEventincompliancewiththefollowingguidelines:•EditorialUse:AnyuseoftheMarksmustbesolelyforeditorialpurposes,namelyforthepurposeofidentifyingarticlesaboutornewscoverageoftherespectiveevent.•NoPromotional/AdvertisingUse:TheMarkscannotbeusedinanyadvertisingorpromotionalmannerbytheMediaincludingonanyproducts;inanycompetition,game,lotteryorothertypeofcontest;orinanybroadcastsequencesimmediatelybeforeorafteranyadvertisingorsponsoredprogramme.•NewspaperFrontPageUse:TheOfficialMarksmaybeusedonthefrontpagesofnewspapersandonthecoverandtitlesofspecialEventsectionsofanewspapertoillustratethepresenceofeditorialEventcoverageinthenewspapertofacilitatereaderorientation,e.g.forhighlightingteasersandinformationontheEvent.TheMarksshouldneverdominatethefrontpage.•MagazineFrontPageUse:TheOfficialMarksmayNOTbeusedonthecoverofregularlypublishedmagazinesexceptwhereothepublisherusestheMarkstoindicatethepresenceofEventcoverageorspecialEventsectionswithinthemagazineandotheMarksareofasizeandplacementwhichisapprovedbyFIFAandothepublisherhasreceivedFIFA’swrittenapprovalpriortosuchuse.TheMarksmaynot,however,beusedonthecoverpageofone-off,speciallyproducedcountdown/previewguides,Eventguides,round-upguides,teamguides,Eventmatchguides,travelguidesoranyotherspecificEvent-relatedprintproduct,includingsupplementstoanyregularlypublishedMagazines.”•GraphicGuidelines:TheMarksmustalwaysbeusedinfullcompliancewithFIFA’sGraphicGuidelinesintheexactformatsprovidedintheillustrationsandassetoutintheGraphicGuidelinessupplieduponrequestoravailableontheFIFADigitalArchive.Theymaynotbeadaptedormodifiedinanyway.Thisincludesthelegibilityofthelegalnotice.December20053•NoAssociation:TheMarksmustnotappearinsuchawayastosuggestanassociationwithanytradenameorthirdparty,logoorothermarksortheirgoodsand/orservices.•NoThirdPartyAssociation:ThemediashouldnotauthoriseorattempttoauthoriseanyoneelsetouseorassociatethemselveswiththeMarksandshouldnotpublishorbroadcastanyiteminwhichsomeoneotherthanFIFA’sCommercialAffiliatesusesorassociatesitselfwithMarks.•FIFADigitalArchive:ThemediamayordertheMarksdirectlyviatheFIFADigitalArchivebysubmittingaMarksRequestForm.Followingthis,andafterhavingreceivedapprovalfromFIFA,theywillreceivetheMarks.NBAnyentityusingtheMarks(oradaptations)forpromotionalpurposes,withoutFIFA’sexplicitwrittenauthorisation,willbedeemedtobeadopting“parasitemarketing”techniquesandFIFAreservestherighttotakeanyappropriateactiontostopthis.NBFIFAMarketing&TVisadivisionofFIFAandisresponsiblefortheprotectionofFIFA’smarketingrightsinrelationtoallFIFAevents.Forfurtherinformationoranyqueriesforclarificationofanyoftheabovepleasecontact:MarketingServices,FIFAMarketing&TVAG,Grafenauweg2,POBox4250,CH-6304Zug,Switzerland.Tel:+41(0)417270000,F
