ROMANIAINTRODUCTIONTheelectroniccommunicationsmarketisstillatanearlystageofdevelopmentinRomania,followingtheliberalisationofthemarketin2003.However,thetrendsidentifiedinpreviousyearshavecontinuedin2008,inparticularintermsofgrowthofthemobileandbroadbandmarkets.Thesepositivetrendshavemainlybeendrivenbymarketforces.SomeofthemeasurestakensofarbytheNationalRegulatoryAuthority,suchasreducingterminationrates,havealsosupportedthedevelopmentofthemarket.However,therehavebeennosignificantgovernmentmeasures,suchasanationalbroadbandstrategy,toprovideguidanceandsupporttothemarketplayersandtoovercometheobstaclesduetolowpenetrationofPCs,lackofconnectionsatafixedlocationandlowincomelevels87.RomaniastillhasthelowestfixedlineandoneofthelowestbroadbandpenetrationratesintheEU-27.Thelatetake-upofbroadbandisreflectedinusageofonlineservices,forwhichRomaniaisoneofthelowestrankingcountries.NeverthelessthenewCDMAlicencewhichhasbeengrantedtothefixedincumbentandtheopeningofthespectrumforWi-Maxcommunicationsmightprovidethebasistoclosetheruralgap.ThereisastrongpreferenceintheRomanianelectroniccommunicationsmarketforbundledservices,whichincludefour-playoffers.AccesstoinfrastructurebottlenecksisstilllimitedinRomania;howevertherearesignsofsignificantplatformcompetition.OnlyonemarketanalysishasbeennotifiedtotheCommissionin2008.EnsuringtheprovisionofuniversalserviceisataskwhichisyettobecompletedbytheRomanianauthoritiesandnosubstantialprogresscanbereportedwithinthelastyear,althoughseveralpreparatorymeasureshavebeentaken.Theimplementationoftherightsofwayregimecontinuestoraisedifficultiesinpractice.AmajordevelopmentistheavailabilityofnumberportabilitysinceOctober2008.TheemergentRomaniantelecomsmarketwasalsomarkedduringthelastfouryearsbysubstantialchangesaffectingtheRomanianRegulatoryAuthorityforCommunications(ANC),suchasreplacementoftwoofitsPresidentsbeforetheendoftheirmandatesandreorganisations.Thishasnothelpedtoestablishlegalcertaintyandstabilityinthemarket.REGULATORYENVIRONMENTMainregulatorydevelopmentsTheprimarylegislationtransposingthe2002regulatoryframeworkonelectroniccommunicationswasamendedtoensuretheproperenforcementoftheRoamingRegulation87RomaniascoresthelowestintheEUwith232PPPs(PurchasingPowerParities)anindicatorwhichmeasuresthepurchasingpoweroftheminimumwage(€137inJuly2008).HoweveritalsohasthehighestminimumwagegrowthrateintheEUforthelast8years—Source:EUROSTAT,Statisticsinfocus,105/2008.aswellasproperfunctioningoftheEuropeanEmergencynumberinRomania88.Inaddition,theEmergencyOrdinancerestructuringtheNationalRegulatoryAuthority,whichwaspassedbytheGovernmentinSeptember2008,shouldbementionedasasignificantchange.OrganisationoftheNRAOn18August2008thePrimeMinisteroftheRomanianGovernmentdecidedtoremovethePresidentoftheRomanianRegulatoryAuthority—theNationalRegulatoryAuthorityforCommunicationsandTechnologyInformation89(ANRCTI)onvariousgroundsincludingviolationsoftheElectronicCommunicationsAct90,beforetheendofthe5yearmandateprovidedforbythelaw.On20August2008thePrimeMinisterappointedanewPresidentoftheRegulatoryAuthority91.On17September2008,theBucharestCourtofAppealsuspendedboththeDecisionofthePrimeMinisterof18August2008dismissingthepresidentoftheNationalRegulatoryAuthorityandtheDecisionofthePrimeMinisterof20August2008appointingthenewPresident92.However,thecourtrulingcouldnotbeenforcedduetothefactthatonthesamedaytheRomanianGovernmentadoptedEmergencyOrdinanceNo106/200893,whichrestructuredandrenamedtheRegulatoryAuthorityastheNationalAuthorityforCommunications(ANC).TheCommissionsenttwoadministrativeletterson19Septemberandon14OctobertotheMinistryofCommunicationsaskingforclarificationsrelatingtothemeasurestakenbytheRomanianGovernmenttorestructuretheNationalRegulatoryAuthority,inordertoassesstheircompliancewiththeEUregulatoryframeworkforelectroniccommunications.TheCommissionwasinformedthattheurgencyrequirementestablishedbytheRomanianConstitutionforadoptingsuchanemergencyactwasfulfilledbytheneedtoallowthenewauthoritytofightmoreeffectivelyagainstinternetfraudandtoimprovethecoherenceinthemanagementofinternetresourcesinRomania;forthispurposeitwasvestedwiththeresponsibilitytomanagethe.roandsecondlevel.eudomains,andwithadditionaljurisdictionintheinternetsecurityarea.InJanuary2009,theCommissioninitiatedtheinfringementproceedingagainstRomaniafornon-compliancewiththeFrameworkDirective.DecisionmakingIn2008ANCcontinuedmainlywithpreparatoryworkforthemarketreviewprocesswiththeonlynotificationtotheCommissionbeingthefixedcallterminationmarket.ThebroadcastingtransmissionservicesmarketreviewwassubmittedtopublicconsultationbetweenOctoberandNovember2008;thevoicecallterminationonindividualmobilenetworksmarketreviewwassubmittedforpublicconsultationbetweenNovemberandDecember2008.Theother88GovernmentEmergencyOrdinanceNo60/2008amendingGovernmentEmergencyOrdinanceno.79/2002andtheGovernmentEmergencyOrdinanceNo34/2008fortheorganisationandfunctioningoftheSingleNationalSystemforEmergencyCalls.89DecisionofthePrimeMinisterno.165/18.08.2008.90GovernmentEmergencyOrdinanceNo79/2002onthe
