成都市房地产居间行业服务规范(试行)目录1总则······························································································12名词释义························································································13房地产居间行业服务规范···································································43.1机构服务规范·············································································43.2从业人员服务规范·······································································93.3禁止行为与行业自律··································································114买卖居间业务流程指引····································································164.1委托出售·················································································194.2买方寻找房源···········································································194.3带买方实地看房········································································204.4达成交易意向···········································································214.5签署《房屋买卖合同》·······························································224.6交易资金监管···········································································244.7《房屋买卖合同》网上签约备案···················································244.8办理过户手续···········································································254.9房款结算·················································································264.10交房·····················································································304.11其他售后服务·········································································305租赁居间业务流程指引····································································315.1委托出租·················································································325.2承租方寻找房源········································································315.3带承租方实地看房·····································································315.4达成租赁意向并签订租赁合同·····················································325.5支付押金及租金········································································335.6交房·······················································································345.7其他售后服务···········································································34附件:买卖和租赁居间服务信息公示栏及参考示范文本····························35成都市房地产居间行业服务规范11总则1.0.1为规范成都市从事房地产居间业务的经纪机构及经纪人员的服务行为,维护房地产居间行业市场秩序,保障房地产居间活动中各方当事人的合法权益,完善房地产居间行业监管机制和自律机制,提高房地产居间行业公信力,促进房地产居间行业健康发展,依据《中华人民共和国城市房地产管理法》、《中华人民共和国合同法》、《房地产经纪管理办法》、《成都市中介机构管理办法》等有关法律法规、部门规章和相关规定,制定本规范。1.0.2本规范是指导房地产居间行为的自律准则,是评判房地产居间行为是否符合房地产居间职业要求的行业标准,是行业组织对从事房地产居间业务的经纪机构及经纪人员进行自律管理的基本依据,也是房地产行政主管部门加强市场监管及指导行业服务规范的重要参考准则。1.0.3本规范是在房地产行政主管部门指导下,由成都市房地产经纪协会、从事房地产居间业务的经纪机构和经纪人员联合发起制定。1.0.4本规范适用于在成都市从事房地产居间业务的经纪机构及经纪人员。2名词释义2.0.1房地产居间是指房地产经纪机构或房地产经纪人员向委托人报告订立房地产交易合同的机会或者提供订立房地产交易合同的媒介服务,并向委托人收取佣金的行为。2.0.2从事房地产居间业务的经纪机构是指依法设立并经过工商登记的,且在房地产主管部门备案取得备案证书的,从事房地产居间活动的房地产中介服务机构。2.0.3房地产经纪机构的分支机构是指房地产经纪机构依法设立取得营业执照并经房地产主管部门备案的不成都市房地产居间行业服务规范2具有独立法人资格的组织。2.0.4从事房地产居间业务的经纪人员是指按相关规定取得相应资格并经注册,从事房地产居间业务的专业人员,包括房地产经纪人、房地产经纪人协理和房地产销售服务人员。2.0.5机构备案是指根据《房地产经纪管理办法》的规定,房地产经纪机构及其分支机构应当自领取营业执照之日起30日内,到所在直辖市、市、县人民政府建设(房地产)主管部门备案的行为。2.0.6经纪人员佩牌上岗是指房地产经纪人员经成都市房地产经纪协会登记造册后,佩戴协会统一编号的胸牌从事房地产经纪活动的行为。2.0.7委托协议是指委托人和房地产经纪机构约定,由房地产经纪机构提供专业服务,完成委托人委托事项的合同,也称为委托合同或契约。2.0.8房地产居间服务合同是指为促成委托人房地产交易,房地产经纪机构与委托人之间设立、变更、终止房地产经纪服务权利义务关系的协议。2.0.9佣金是指房地产经纪机构按照《房地产居间服务合同》的约定,向委托人收取的房地产经纪服务报酬。2.0.10定金是指当事人约定,为保证合同的履行,一方向另一方支付的用于债权担保的钱款。给付定金的一方不履行约定的债务的,无权要求返还定金;收受定金的一方不履行约定的债务的,应当双倍返还定金。定金应当以书面形式约定。当事人在定金合同中应当约定交付定金的期限,定金合同从实际交付定金之日起生成都市房地产居间行业服务规范3效。定金的数额由当事人约定,但不得超过主合同标的额的百分之二十。2.0.11交房保证金是指为了防范交易风险,督促卖方按约定交付物业和结清相关费用,而由买卖双方协商同意在交易总价款中预留出来的部分款项。2.0.12违约金是指由合同当事人在合同中预先约定,当一方不履行合同或不完全履行合同时,由违约方支付给履约方的一定金额的钱款。2.0.13违约责任是指当事人一方不履行合同债务或其履行不符合合同约定时,对另一方当事人所应承担的继续履行、采取补救措施或者赔偿损失等民事责任。2.0.14产权过户是指产权登记部门接受买卖双方提交的过户申请后,为其办理的产权转移登记手续。2.0.15房地产按揭是指以交易的房地产作为抵押物,获得银行贷款用以购买交易的房地产,并依合同分期偿还本息,贷款还清后解除房地产抵押状态的行为。2.0.16担保是指为确保特定的债权人实现债权,以债务人或第三人的信用或者特定财产来督促债务人履行债务的制度。2.0.17抵押是指债务人或者第三人不转移对特定财产的占有,将该财产作为债权的担保。债务人不履行债务时,抵押权人有权依照法律规定以该财产折价或者以拍卖、变卖该财产的价款优先受偿。2.0.18出租人是指对约定的物业享有所有权或经营权,通过让渡占有、使用、收益权能获取对价的一方。2.0.19承租人成都市房地产居间行业服务规范4是指物业租赁交易中对约定的物业享有占有、使用、收益权能,并支付对价的一方。2.0.20押金是指出租方交付出租房地产时,向承租方收取作为合同履行担保的钱款。2.0.21成都市房地产经纪协会是由成都市从事房地产居间、代理、咨询的企事业单位及从事房地产研究的专业机构自愿发起成立的行业性、地方性社会组织。2.0.22信用档案是指由房地产行政主管部门或协会建立的,房地产经纪机构和人员填报的,用于证明、判断房地产经纪机构及经纪人员资信状况的真实记录。3房地产居间行业服务规范3.1机构服务规范3.1.1经纪机构的备案3.1.1.1从事房地产居间业务的经纪机构备案程序如下:1、从事房地产居间业务的经纪机构及其分支机构,在取得营业执照之日起30日内,应当到房地产行政主管部门申请办理房地产经纪机构备案手续,领取《成都市房地产经纪咨询机构备案证书》(以下简称《备案证书》)或《成都市房地产经纪咨询分支机构备案证书》(以下简称《分支机构备案证书》)。机构注册地在五城区(含高新区)内的,应到市房地产交易中心办理备案手续;注册地在其他区(市)县的,应到当地房地产行政主管部门办理备案手续。2、申请办理备案应交验以下材料:备案申请表、营业执照副本(验原件收复印件)、法定代表人(负责人)有效身份证明(验原件收复印件)、公司章程、业务操作规程及相关规章制度、房地产经纪人员注册证明及劳动聘用合同(验原件收复印件)、其他。成都市房地产居间行业服务规范53、从事房地产居间业务的经纪机构在领取营业执照和机构备案证书后,方能在核准范围内开展经纪活动,同时接受有关行政管理部门的管理和社会监督。4、从事房地产居间业务的经纪机构或其下设的分支机构备案内容发生变更或者终止的,应在变更之日或者终止起30日内办理备案变更或者注销手续。从事房地产居间业务的经纪机构及分支机构备案证书所载内容、股东、从事房地产居间业务经纪人员备案情况发生变更的,应到房地产行政主管部门进行变更备案。从事房地产居间业务的经纪机构因备案业务类型变更,办理变更备案后其下设的全部分支机构也应办理变更备案。从事房地产居间业务的经纪机构及分支机构联系电话发生变更的,应及时书面通
