12TRIPs34Abstract5Theconstructionofourcountry’sintellectualpropertyrightsservicesystemhasalwaysbeenanissueofgreatcontentionandmajorsignificanceofourcountry.Scholars,legislators,professionalworkersandpersonalitiesofvarioussocialcirclesallhavedifferentopinionsintheunderstandingofthisproblem.Inthisthesis,theauthormeanstomakeaninitiativeprobeintotheconstructionourcountry’sintellectualpropertyrightsservicesystemwithregardtoitsrationality,functionalityandwaysofdevelopment.Theauthoronlyhopethatthisarticlewillserveasatheoreticalpromotingfactortotheconstructionofourcountry’sintellectualpropertyrightsservicesystem.Thethesiscanbedividedintofiveparts.Partoneofthethesisisfocusedontheconcept,characteristicsandscopeofintellectualpropertyrights.Mainlyintroducesourcountry’slegislationsituationsintermsofintellectualpropertyrightsandtheproblemsofourcountry’sintellectualpropertyrightsservicesysteminorganizationalstructure.Therearesomedisparitiesbetweenourcountry’sintellectualpropertyrightslegislationandtheAgreementonTrade-relatedAspectsofIntellectualPropertyRights(TRIPs).Tosolvethisproblem,ourcountryhassimultaneouslyrevisedthePatentLaw,theAuthorshipLaw,andtheTrademarkLaw.Throughtheselegislationworks,wehavebasicallysolvedtheproblemsthathavelongdistressedusintheprotectionofintellectualpropertyrights.Moreover,therearesomenewbreakthroughsintheselegislationworks.Viewingfromtheorganizationalstructure,theprofessionalservicepersonnelofintellectualpropertyrightsmainlyconcentrateinpatentagenciesandtrademarkagencies.However,theseorganizations’principletasksarelimitedintheapplicationandagencyofpatentrightsandtrademarkrights,seldomtouchinguponotherfields.Thelawfirms,accountant’sofficesandsometrademarkappraisalfirmswillalsogetsmallamountofbusinessconcerningintellectualpropertyrights,whileastheamountistoosmall,theseorganizationsrarelyhasprofessionalresearchersstudyingintellectualpropertyrights,hencetheirserviceishardtobesatisfying.Parttwoofthethesisdiscussestheidealpatternofourcountry’sintellectual6propertyrightsservicesystem.Theauthormakeshisexpositionfromsixaspects:theconsultingservicesystemprovidingknowledgeofintellectualpropertyrights;theagentregistrationsystemofintellectualpropertyrights;theinformationservicesystemofintellectualpropertyrights;themediumservicesystemofintellectualpropertyrights;and,thelegalremedyservicesystemoftheimpairmentofintellectualpropertyrights.Bydoingthis,theauthorhassystematicallydescribedthemostreasonable,mostidealandmostscientificactionmodeforourcountry’sintellectualpropertyrights.Inaddition,hehasmadesometheoreticalsupplementstoourcountry’scurrentintellectualpropertyrightssystem.Partthreeofthethesisisdedicatedtothefunctionsofourcountry’sintellectualpropertyrightslegalprotectionsystem.Herethediscussionismadefromfiveaspects:Acceleratetheestablishmentofahighly-effectiveintellectualpropertyrightsmarket;guaranteetheeffectiveusageofintellectualpropertyrights;promotethedevelopmentofenterprisecultureandsetuptheintegralimageofenterprise;increasethepercentageofthetransmissionfromtechnologicalachievementsintopatents,acceleratetheadvanceofscienceandtechnology;andfinally,fullymanifestthecapitalefficacyofintellectualpropertyrights.Firstofall,afterappraisalandwiththeadmissionofothershareholders,thepatentrightsandtrademarkrightscanbeconsideredastherightowner’sinvestmentintheenterprise.Secondly,thepatentrightsandtrademarkrightscanserveastheobjectiveinpledgeofrights.Thirdly,theycanbeusedasameanstoenliventhewaysofusingintangiblecapitalbytransferringorusagebylicense,soastoincreaseincomeortoactivatetheenterprise’scapital.Finally,theycanbedistributedasakindofpropertyatbankrupt,tomakeupthelossofthecreditors,andtomakethemcontinuetoservethesociety.Partfourofthethesisanalysesthetacticsoflegalpersonneltraininginourcountry’sintellectualpropertyrightsservicesystem,and,basicwaystotrainpersonnelintheaspectofintellectualpropertyrights.Withregardtothereasonsforourcountry’slackingofintellectualpropertyrightspersonnel,theauthor7pointsoutthreeaspects.First,thosescholarsinthefieldofcivillawresearchhavethepreferenceforinvemonpropertyinterestintheirstudy.Second,theresearchofintellectualpropertyrightsisneglectedfromtimetotime.Third,inourcountry,theutilizationofintellectualpropertyrightsisstillatacomparativelylowlevel.Thepracticalsituationofintellectualpropertyrightsisthemostdirectreasonforpeople’slackingofenthusiasminthestudyofit.Intermsofthewaysoftrainingourcountry’spersonnelinthefieldofintellectualpropertyrights,theauthorpointsoutthat:Ourlocalgovernmentsshouldasmuchaspossibleofferfinancialsupporttotheprofessionalsofthisfield,keepingtheirincomeatareasonablelevel,nottoomuchlowerthanthatofpersonnelofsimilartrades.Meanwhile,thechangeofconceptisalsoanimportantwaytopromotethetrainingofpersonnelinthefieldofintellectualpropertyrightsservicesystem.Weshould,therefore,reinforcethepropagandaforknowledgeeconomy,callingthesociety’sattentiontotheintellectualpropertyrightsservicesystem,soastoattractmoretalentedpeopleintothiscause.Suchkindofpropagandamaybeevenmoree
