中国人民大学硕士学位论文电信服务贸易协议与电信竞争性管制姓名：万敏申请学位级别：硕士专业：@指导教师：赵秀文20070701WTOWTOWTOWTOGATSGATS12323WTOWTO4AbstractThedissertation,withthetitleofTheAgreementonTelecommunicationTradeServiceandCompetitive-controllingofTelecommunicationIndustry,startsfromGeneralAgreementonTradeinServicesaswellasTheAgreementonBasicTelecommunicationsandsomerelatedacceptancealongwithAnnexonTelecommunicationsaftertheUruguayRound,andcombinestheissuecausedbycompetitivesafeguardaboutthefirstcaseoftheWTOtradeserviceontelecommunication-Mexico-measuresaffectingtelecommunicationsservices,thenexplainsthecognizanceofanti-competitivepracticesmadebythepaneloftheDisputeSettlementBody,thenanalyzingthepresentsituationanddevelopingorientationofthetelecommunicationservicesinChina,andfinallypointsoutthechallengeandtherespondedpolicyonlegislationanmarketregulationontelecommunicationservicesafterChinajoiningintheWTO.Thedissertationisbasedonthefollowingbackground:ourcountryhasbeenamemberofWTOandmadepromisetoopenthetelecommunicationmarketgradually,butourinternallegislationhasnotbeenmatchedtheinternationalrules.Howcanwedevelopourregulationintelecommunicationindustryinlinewiththeinternationalrules?ThisyearwewillundertakecomprehensivecommitmentstoWTOintelecommunicationservice,soitisveryurgenttosolvethisproblem.Thisdissertationiscomposedofthreeparts,thepreface,theformaltextandepilogue.Theprefacemainlyintroducesthemotiveofwritingthispaper.Theformaltextisdividedintofourchapters.Thedetailsofeachchapterareasfollows:Chapter1introducesthecontentaboutTheAgreementonTelecommunicationTradeService.IntheframeofGATS,therearesomedocumentsrelatedtothetelecommunicationservice:ScheduleofSpecificCommitments,theAnnexonTelecommunications,theDecisiononBasicTelecommunicationNegotiation,theAnnexonBasicTelecommunication,theAgreementonBasicTelecommunications,5ReferencePaper.Thischapterisdividedintofoursections.ThefirstsectionintroducesthebackgroundandcontentoftheAgreementonTelecommunicationTradeServices.ThesecondsectionintroducesthecontentofGATSAnnexonTelecommunications.ThethirdsectionintroducesthecontentoftheAgreementonBasicTelecommunicationsanditsinfluenceontelecommunicationservices.Thefourthsectionisthekeystoneofthischapter.Itmainlyintroducestheprescriptionofanti-competitivepracticesinReferencePaper.TherearesixprinciplesintheReferencePaper,whichareallabouttheregulationoftelecommunicationindustry.Thefirstprincipleiscompetitivesafeguard.Combiningthethemeofthisdissertation,thissectionmainlyexpatiatesonthecompetitivesafeguard,andliststhreeformsofanti-competitivepracticesregulatedintheReferencePaperparticularly.1Cross-subsidization.2Usinginformationfromothercompetitorsinordertorestricttrades.3Notletotherprovidersknowintimethenecessarytechniqueinformationrelatedtotheessentialfacilitiesandbusinessforprovidingservice.FinallythissectionsetforththemeaningoftheregulationofcompetitivesafeguardinReferencePaper.Chapter2introducesMexicotelecommunicationCase,atypicalcasewhichdisobeyedcompetitivesafeguardintelecommunicationtradeservices.Therearealotofdisputationsinthiscase,butinlightofthekeystoneofthisdissertation,Ionlypickouttheproblemrelatedtocompetitivesafeguard.Thischapterisdividedintothreeparts.ThefirstpartbrieflyintroducestheMexicotelecommunicationCase.Thesecondpartanalysesthecompetitivesafeguardreferredtothiscase.Thethirdpartanalysesthecognizanceofanti-competitivepracticesandthegovernmentpracticesofMexicomadebytheexpertpaneloftheDisputeSettlementBody.Theexpertpanelconsideredthatbesidesthethreeformsofanti-competitivepracticeslistedintheReferencePaper,horizontalrestrictionsuchaslimitingthemarketpriceandmarketsharingarrangementbelongtotheanti-competitivepractices.Andwhenamember’sinternallawprobablyleadstodiscrimination,evenitisalegalperformitmaybeananti-competitivepractice.Thefourthpartsummarizestheimpactofthiscaseontheregulationoftelecommunicationservice.Theissuesthattheexpertpanel6analyzedcanbegreatvaluetotheaspectoflegislationandexternalpolicyfortheareaoftelecommunicationserviceinChina.Thecognizanceofanti-competitivepracticesisveryvaluableforthosecountriesthatuseitforreferencetoestablishtheirinternallawandsupervisionpolicy.Chapter3expatiatesoncompetitive-controllingintheareaoftelecommunicationservice.Themainpurposeofcompetitive-controllingiseliminatingtheanti-competitivepractices,establishingafairmarketcompetitiveorder,promotingthetelecommunicationindustrydevelopingtobehealthy,inlineandbenign.Thischapterisdividedintothreeparts.Firstlyitintroducesthesignificationandcharacterofcompetitive-controlling.Thesocalledcompetitive-controllingmeansthattheindustryadministrationsupervisesthetelecommunicationmarketviasomeuniversalcompetitionrules.Thesecondpartintroducesothercountries’practicingexperienceofcompetitive-controllingintheareaoftelecom.Thethirdpartfirstlyintroducesthereformroadofourcountry’stelecomsupervision,andpointsoutthepresentsituationthatwejustremaininthephaseofdissymmetricalregulation.Thenaimingatthedevelopingtrendoftelecomindustry,analyzingthefuturesupervisionpolicyshouldbecompetitive-controlli
