广西师范大学硕士学位论文北美自由贸易区服务贸易制度研究——兼比较我国区域贸易协定中的服务贸易制度姓名：黄薇申请学位级别：硕士专业：国际法指导教师：杨丽艳20080401I200520NorthAmericanFreeTradeAreaNAFTANAFTARegionalTradeArrangementRTANAFTARTAGATSNAFTANAFTA1216GATSNAFTAIINAFTARTAsCEPACEPANAFTARTAsNAFTARTAsNAFTARTAsGATSRTAsIIIStudyontheSystemofNAFTATradeinService——ComparedwiththeSystemofTradeinServiceinRTAsofChinaABSTRACTAttheendofthe20thcentury,thedevelopmentofelectronicinformationtechnology,goods,serviceandotherfactorscross-bordermovementpromotetheproceedingoftheeconomicintegration.Atthesametime,thedevelopmentofeconomicglobalizationgrowsrapidly,alargenumberofregionaleconomicorganizationsappear,suchastheEuropeanUnion,NAFTA,andtheAssociationofSoutheastAsianNations.Internationalservicetrade,whichisinthetrendofregionaleconomicintegrationandeconomicglobalizationdevelopsrapidly,becomesanimportantpartofthenationaleconomyandinternationaltrade.NAFTAservicetradesysteminvolvesawiderangeof,accurateandhighlyoperablerules,whichregulatesmorecomprehensiveservicestotheprovisionsoftradeliberalizationmeasures.Chinaisapartoftheworldeconomy,whichactivelyjoinsinregionaleconomiccooperation,andvigorouslydevelopstradeinservice.ByanalyzingtherulesoftheNAFTAtradeinservice,thispaperiscomparingourcountryservicetradeintheregionaltradeagreementswiththesystemofNAFTAservicetrade.AndinaccordancewithChina'sconditions,combinedwiththenewdevelopmentofservicetrade,IwouldproposethemeasuresofregulatingChineseservicetradeintheregionaltradearrangement;sharethebenefitsoftheliberalizationoftheinternationalservicetrade.Thepaperiscomposedbyfiveparts.ThefirstpartintroducesthesystemofNAFTAservicetrade;thesecondpartandthethirdpartfocusesonthespecificsystemsofNAFTAservicetrade;thefourthpartintroducesthesystemofservicetradeinChineseRTA;thefifthpartcomparesthesystemofNAFTAtradeinservicewiththesystemoftradeinserviceinRTA.IwouldproposetherecommendationsofregulatingtradeinserviceinRTA.Thefirstpartintroducesseveralconceptsoftrade-relatedservice.First,introducesthedefinitionofservicetrade,thispaperadoptsthedefinitionofservicetradeofGATS,andintroducesitscharacteristicsandclassification.Servicetradeisintangible,whichisdifficulttocontrolandsoon.Secondly,thepaperexpoundsthemeaningoftherulesofservicetradeandthelegalbasisofit.AndthenthepaperdiscussestheestablishmentofNAFTAanditslegalframework,whichiscomposedoftheNorthAmericanFreeTradeAgreement,andthetworelatedtotheenvironmentandworkersofthesubsidiaryagreements.Inthissection,italsoprovidesanoverviewofNAFTAservicetrade’smainframeworkforthesystem,whichincludestheNorthAmericanFreeTradeAgreementChapter12toChapter16ofthecontent,andalsoIVcomparestheNorthAmericanFreeTradeAgreementwiththeGeneralAgreementonTradeinService(GATS)inthenon-discriminatoryprincipleandcertainaspectsofauthenticationmechanisms,sumsupthecharacteristicsofNAFTA.Thesecondandthethirdpartsexpoundcross-borderservicetrade,telecommunicationsservices,financialservices,competitionpolicy,monopoliesandstateenterprises,temporaryentryforbusinesspersons.Emphasizingonsystemofcross-borderservicetrade,fromitsscopetoapplicationofserviceproviders,nationaltreatmentandthemostfavorednationtreatmentdenythebenefitsinareas.Italsofocusesonthetermoffinancialservices,fromitsscopetoapplicationofbasicprinciple,systemofmarketaccess.FinancialservicesinNAFTAincludebank,insurance,securitiesservices.MeasuresadoptedormaintainedbyaPartyrelatingtofinancialinstitutionsofanotherParty,investorsofanotherParty,andinvestmentsofsuchinvestors,infinancialinstitutionsintheParty'sterritory,andcross-bordertradeinfinancialservices.Thebasicprincipleistheprincipleofnationaltreatmentandthemost-favored-nationtreatment.Thesystemofmarketaccessincludestheestablishmentoffinancialinstitutionsandmanagement,cross-bordertradeinfinancialservices,newfinancialservicesandothersecuritysystem.ThefinancialservicesprovisionsofNAFTAhavepromotedregionalfinancialfreedomandprovideareferencefortheotherregionaleconomicorganizationsinthisfield.ThefourthpartdiscussesChinesefirstparticipationoftheRTA,includingtheBangkokAgreement,China-theASEANAgreementonTradeinServices,theestablishmentoftheMainlandandHongKongCloserEconomicPartnershipArrangement(CEPA),China-ChileFreeTradeAgreement,China-Pakistanfreestradeagreement,China-NewZealandfreestradeagreement.Andthepaperthendescribestheseagreementsconcerningsystemofservicetrade.AnalyzingsystemofservicetradeofChina-theASEANAgreementonTradeinServices,CEPA,China-NewZealandfreetradeagreement.FifthpartcomparessystemofNAFTAtradeinservicesandsystemofservicetradeintheRTA.Choosingandanalyzingrulesoforiginonservices,specificcommitmentstable,marketaccessandnationaltreatmentofservicetrade.Firstly,intherulesoforiginonservices,thepaperintroducesandanalyzestherulesoforiginonservicesanditsmeaning.AndthenthepaperexpoundstheprovisionsofrulesoforiginonservicesinNAFTAandRTAofChina.Secondly,inthetablespecificcommitments,thepaperintroducestheconceptandstructureofspecificcommitmentsonthetable,whichcompareswiththeformofspecificcommitmentstableinNAFTAandRTAofChina.Thirdly,inthemarketaccessandnational
