AGREEEMENTFORCONSULTINGSERVICESCITYOFFARMINGTONHILLSTHISAGREEMENT,madeandenteredintothe________dayof__________,20,____,byandbetweentheCITYOFFARMINGTONHILLS,aMichiganMunicipalCorporation,referredtoastheCITY,and_______________________________________________________withofficeslocatedat_____________________________________________________________hereinaftercalledtheCONSULTINGENGINEER.WITNESSETH:That,inconsiderationofthemutualcovernantsandagreementshereincontained,thepartiesheretodomutuallyagreeasfollows:A.CONSTRUCTIONPROJECT:TheconstructionprojectshallconsistofB.REVIEWBYTHECITY:TheCitywillrequirethatreviewsbetweentheCityandtheConsultantstakeplaceinorderthattheCity’sinputcanbeanintegralpartoftheproject.Thisinputmayoccuratvarioustimesduringthedesignofsaidproject.Thesereviewswillconsist,asaminimum,ofapreliminaryreviewwhichwillfollowthepreliminarydesignbytheconsultant.Thesecondreviewwilltakeplacenolaterthantwoweekspriortotheplansbeingmadeavailabletocontractorsforbiddingpurposes.ThepurposeofthesereviewswillbetoallowtheCityandtheconsultantstodiscusstheactualdesignoftheproject.ThiswillalsoallowtheCityinputintotheprojectthatmayhavenotbeenformallydiscussedinpriormeetings.Itispossiblethatthisinputcouldresultinchangesinthedesignoftheproject.Thesereviewsmustbeconductedasthepaymentscheduleistiedtothesereviews.C.ENGINEERINGSERVICES:TheConsultingEngineershallprovideengineeringservicesasfollows:SECTION1–DESIGNPHASEa.PRELIMINARY:ConsultingAgreementPage2of7{Revised01/04)_________________________2Provideapreliminarydesignwhichwillincludethefollowingandwillbecompletein____calendardaysfollowingtheexecutionofthisagreement.1.DefinitionoftheProjectanditsboundaries/orscope.Thisincludesthedetailofdesign,i.e.:stormdrainagecalculations,basisforroadcross-sectiondesign,etc.2.Inputfromotheragencieswherepermitsorapprovalsmaybenecessary.Identifythespecificagenciesandtimingofobtainingpermits.3.Providesurveysanddrawingsand/orsketchestoshowtheconceptualdesignoftheproject.4.Itemizedpreliminaryestimateforthecostoftheprojectimprovements.5.Identifyanyspecialproblemsorconcernsthatmaycausetimedelaysorthatmayincreasetheprojectcost.6.ProvideinwritingtotheCitytheengineeringfee(expressedasapercentamount)baseduponthepreliminaryestimate.b.FINALDESIGN:1.ProcureallnecessaryfieldinformationandpreparedetaileddrawingsacceptabletotheCityandsuitableforadvertisingforbidsandconstructionoftheproject.2.ConferwithrepresentativesoftheCityasrequiredandsecureallnecessaryapprovalsandpermitsofotheragenciesfortheproperconstructionoftheproject.3.Preparespecifications,contractdocumentsandestimatesofprojectcost.4.FurnishtheCitywith______copiesofplans,specificationsandcontractdocuments.5.Preparetheadvertisementforbids,preparebiddocuments,securebids,tabulationsofbidsreceived,analyzebidsreceived,andmakerecommendationsastotheawardofthecontract.6.Preparefinalcontractdocuments.ConsultingAgreementPage3of7{Revised01/04)_________________________37.Obtainsoilborings,specializedsub-surfaceinvestigations,oranyotherspecializedworkthatistobedonebyotherconsultantsthatmayberequiredfortheproject.Theseserviceswillbesecuredbytheconsultantsexecutingthisagreement,withtheapprovaloftheCity.Thecostoftheseservices,alongwiththetestresults,willbebilleddirectlytotheCityfollowingthecompletionofthetestingbytheConsultantexecutingthisagreement.8.Prepareanyrequiredeasementand/orright-of-waydescriptions(includingnecessarycomputationsandlandsurveying)uponrequestbytheCity.Thisalsoshouldincludeasurveydrawingforacquisitionpurposes.9.TheConsultingEngineeragreestocompleteplansforthisprojectin______calendardays,followingtheexecutionofthisagreement.SECTION2-CONSTRUCTIONPHASEa.Consultationwith,andadviceto,theCityoritsrepresentativesduringconstruction.b.Makeplanchangesorsketchesasrequiredtomeetunforeseenconditionsthatmayariseduringconstruction.c.CheckallshopdrawingsorotherplanssubmittedbytheContractor.d.EvaluateandmakerecommendationstotheCityrelativetoanyfieldchangesnecessarytocompletetheproject.e.Makeperiodicobservationsandreviewsofworkinprogress,makefinalreviewandreportofthecompletedproject,andsupplytheCitywithfinalas-builtmylars,includingfieldworknecessaryforthesemylars.AllotherfieldnotesanddesigninformationshallbeforwardedtotheCity.SECTION3-LAYOUTANDSTAKINGFORCONSTRUCTIONTheConsultingEngineershallfurnishallnecessarystakingandre-stakingsoastocontrolthelocationofconstructionandlineandgradethereofinaccordancewiththeplans.SECTION4-INSPECTIONSERVICESTheConsultant,onlyifdirectedbytheCity,shallprovidedailyinspectionsoftheConsultingAgreementPage4of7{Revised01/04)_________________________4work.TheCityshalldetermine,baseduponthetypeofproject,thefrequencyoftheinspection.AdetaileddailyreportwillbecompletedeachdayaccountingfortheworkaccomplishedbytheContractor.SECTION5-SPECIALSERVICESAnyspecializedreports,costbenefitanalysis,asrequiredbytheCity,shallbepreparedbytheConsultingEngineer.ThisshouldbebilledtotheCityattherateof____________________________.SECTION6-PAYMENTSTOTHECONSULTINGENGINEERTheCityshallpaytheConsultingEngineerforeng
