1CONSTRUCTIONLAWOFTHEPEOPLE'SREPUBLICOFCHINA(EffectiveDate：1998.03.01--IneffectiveDate：)(IssuedonNovember1,1997andbyPresident'sdecreeofPRCNo.91.Adoptedatthe28thMeetingoftheStandingCommitteeoftheEighthNationalPeople'sCongressandimplementationasofMarch1st,1998)CHAPTERIGENERALPROVISIONSCHAPTERIICONSTRUCTIONLICENSINGSECTIONIWORKINGLICENSESFORCONSTRUCTIONPROJECTSSECTIONIIQUALIFICATIONSOFCONSTRUCTORSCHAPTERIIICONTRACTAWARDINGANDCONTRACTINGOFONSTRUCTIONPROJECTSSECTIONIGENERALRULESSECTIONIICONTRACTINGAWARDINGSECTIONIIICONTRACTINGCHAPTERIVSUPERVISIONOFCONSTRUCTIONPROJECTSCHAPTERVMANAGEMENTOFCONSTRUCTIONSAFETYANDOPERATIONCHAPTERVIMANAGEMENTOFCONSTRUCTIONPROJECTQUALITYCHAPTERVIILEGALRESPONSIBILITIESCHAPTERVIIIAPPENDIXArticle1Withaviewtostrengtheningsupervisionandregulationofconstructionactivities,maintainingconstructionmarketorder,ensuringthequalityandsafetyofconstructionprojectsandpromotingthehealthydevelopmentofconstructionindustry,thislawisherebyformulated.Article2ConstructionactivitiesandsupervisionofconstructionactivitiesconductedwithintheterritoryofthePeople'sRepublicofChinashallabidebythislaw.Article3ConstructionactivitieshavetoguaranteethequalityandsafetyofconstructionprojectsandcomplywiththeState'ssafetystandardsforconstructionprojects.Article4TheStateassiststhedevelopmentofconstructionindustry,supportsresearchonconstructionscienceandtechnologyinordertoraisethelevelofhousingandconstructiondesign,encouragessavingofenergyandenvironmentalprotectionandadvocatestheadoptionofadvancedtechnology,advancedequipment,advancedprocess,newbuildingmaterialsandmodernmanagerialmethods.Article5Conductofconstructionactivitiesshallobservelawsandregulationsandshouldinnowayunderminesocialandpublicinterestsaswellasthelegitimateinterestsofothers.Article6ThecompetentconstructionadministrativedepartmentundertheStateCouncilshallexerciseunifiedsupervisionandregulationoverconstructionactivitiesofthewholecountry.2CHAPTERIICONSTRUCTIONLICENSINGSECTIONIWORKINGLICENSESFORCONSTRUCTIONPROJECTSArticle7Beforethestartofconstructionprojects,constructionunitsshall,inaccordancewiththerelevantprovisionsoftheState,applytothecompetentconstructionadministrativedepartmentsundertheprefecture-countygovernmentsoraboveforconstructionlicenses,exceptforsmallprojectsbelowthethresholdvaluesetbythecompetentconstructionadministrativedepartmentundertheStateCouncil.ConstructionprojectswhichhaveobtainedapprovalofworkstartreportsinaccordancewiththepowerlimitsandprocedurestipulatedbytheStateCouncilarenolongerrequiredtoapplyforconstructionlicenses.Article8Thefollowingconditionsarerequiredfortheapplicationofconstructionlicenses:(1)Havinggonethroughtheapprovalformalitiesforconstructionprojectlanduse;(2)Constructionprojectswithinurbanplanneddistrictshaveobtainedlicensesofplanning;(3)Wheredemolitionandrelocationarenecessary,theprogressofdemolitionandrelocationcomplywiththerequirementsofconstruction;(4)Constructingenterprisesfortheprojectshavebeenchosen;(5)Workingdrawingsandtechnicaldataareavailabletomeettheneedofconstruction;(6)Specificmeasuresareavailableforensuringthequalityandsecurityofconstruction;(7)Fundsofconstructionareavailable;(8)Otherconditionsasstipulatedbylawsandadministrativeregulations.Thecompetentconstructionadministrativedepartmentsshallissueconstructionlicensestoqualifiedapplicantswithin15daysfromthedateofreceiptofapplications.Article9Unitsinchargeofconstructionshouldstarttobuildtheprojectswithinthreemonthssinceobtainingconstructionlicenses.Ifworkcannotstartonschedule,applicationsshouldbefiledtothelicenseissuingagenciesfordelay,whichshallonlybepermittedtwiceinmaximumforeachcase,eachpermissionofdelaycoveringamaximumperiodofthreemonths.Incasesofthoseprojectsthatneitherstartonschedulenorapplyfordelayorexceedtheperiodofpermitteddelay,thevalidityoftheworkinglicensesautomaticallyexpires.3Article10Forprojectsunderconstructionthatcometoahaltduetosomereasons,theconstructingunitsshouldreporttothelicenseissuingagencieswithinonemonthfromthestoppageofconstructionandshouldalsowellmaintainandmanagetheconstructionprojectsinaccordancewithprovisions.Whenconstructionworkresumes,reportsshouldbefiledwiththelicenseissuingagencies;Beforetheresumptionofworkonconstructionprojectswhichhavestoppedforoveroneyear,unitsinchargeofconstructionshallapplytothelicenseissuingagenciesforverificationoftheirworkinglicenses.Article11Forconstructionprojectswithapprovalofwork-startreportsinlightoftherelevantprovisionsoftheStateCouncilwhichfailtostartconstructiononscheduleorsuspendtheconstructionworkduetocertainreasons,theconstructorsshouldreportthecasestimelytotheapprovingauthorities.Iftheperiodofnon-startofworkduetocertainreasonsexceedssixmonths,theconstructorsshallre-gothroughtheformalitiesofapprovalforwork-startreports.SECTIONIIQUALIFICATIONSOFCONSTRUCTORSArticle12Constructionengineeringenterprises,prospectingunits,designunitsandprojectsupervisoryunitswhichengageinconstructionactivitiesshallpossessthefollowingconditions:(1)PossessionofregisteredcapitalthatcomplieswiththeStateprovisions;(2)Possess
