Anti-Dumping&Antisubsidymeasures:FAQsII.Anti-DumpingProcedureBackQ.1WhatistheinstitutionalarrangementinIndiaforantidumping,anti-subsidyandsafeguardactionagainstunfairtradepractices?Ans.Antidumpingandantisubsidies&countervailingmeasuresinIndiaareadministeredbytheDirectorateGeneralofAntidumpingandAlliedDuties(DGAD)functioningintheDept.ofCommerceintheMinistryofCommerceandIndustryandthesameisheadedbytheDesignatedAuthority.TheDesignatedAuthority’sfunction,however,isonlytoconducttheantidumping/antisubsidy&countervailingdutyinvestigationandmakerecommendationtotheGovernmentforimpositionofantidumpingorantisubsidymeasures.Suchdutyisfinallyimposed/leviedbyaNotificationoftheMinistryofFinance.Thus,whiletheDepartmentofCommercerecommendstheAnti-dumpingduty,itistheMinistryofFinance,whichleviessuchduty.Safeguardmeasures,ontheotherhand,areadministeredbyanotherAuthoritynamely,DirectorGeneral(Safeguard),whichfunctionsundertheDept.ofRevenue,MinistryofFinance.TheStandingBoardofSafeguards(chairedbytheCommerceSecretary)considerstherecommendationsoftheDG(Safeguards)andthenrecommendstheimpositionsoftheSafeguardDutyasitdeemsfit,totheMinistryofFinancewhichleviestheduty.Q.2WhocanmakeanapplicationforinitiationofAntiDumpinginvestigationandimpositionofADduty?Ans.ApplicationscanbemadebyoronbehalfoftheconcerneddomesticindustrytotheDesignatedAuthorityintheDept.ofCommerceforaninvestigationintoallegeddumpingofaproductintoIndia.UndertheRulesavalidapplicationcanbemadeonlybythosepetitioners/domesticproducerswhoexpresslysupporttheapplication,andaccountformorethan25%oftotaldomesticproductionofthelikearticleinquestion.Theapplicationisdeemedtohavebeenmadebyoronbehalfofthedomesticindustry,ifitissupportedbythosedomesticproducerswhosecollectiveoutputconstitutesmorethanfiftypercentofthetotalproductionofthelikearticleproducedbythatportionofthedomesticindustryexpressingeithersupportfororoppositionasthecasemaybe,totheapplication.However,suchproducersmayexcludethosewhoarerelatedtotheexportersorimportersoftheallegeddumpedarticleorarethemselvesimportersthereof.Inotherwords,adomesticproducerwhoisrelatedtotheexporterorimporterofthedumpedarticleorishimselfanimporterthereof,maynotbetreatedaspartofthedomesticindustryevenifhefilesorsupportsananti-dumpingpetition.Q.3Whoaretheinterestedpartiestoanantidumpinginvestigation?Ans.Theinterestedpartiestoanantidumpinginvestigationinclude:i.thedomesticindustryonwhosecomplainttheproceedingsareinitiated;ii.Theexportersortheforeignproducersofthelikearticlessubjecttoinvestigation;iii.TheimportersofthesamearticleallegedlydumpedintoIndia;iv.TheGovernmentoftheexportingcountry/countries.v.Thetradeorbusinessassociationsofthedomesticproducers/importers/userindustriesofthedumpedproduct.Q.4WhoallcanappearinAnti-dumpingcasestorepresenttheparties?Ans.Anyrepresentativedulyauthorisedbythepetitioner/interestedparties/Associationetc.canappearintheAnti-dumpingcasestorepresenttheconcernedparties.Q.5WhataretheessentialconditionsforinitiationofAntiDumpinginvestigation?Ans.TheDesignatedAuthorityshallnotinitiateananti-dumpinginvestigationunlessitreceivesawell-documentedapplication/petition,whichshouldhelpitdetermine:a.thatthedomesticproducers/petitionersfilingthepetitionand/orexpresslysupportingthepetitionaccountforatleast25%oftotaldomesticproductionofthelikearticleinquestion.Theapplicationisdeemedtohavebeenmadebyoronbehalfofthedomesticindustry,ifitissupportedbythosedomesticproducerswhosecollectiveoutputconstitutesmorethanfiftypercentofthetotalproductionofthelikearticleproducedbythatportionofthedomesticindustryexpressingeithersupportfororoppositionasthecasemaybe,totheapplication;andb.thatthereissufficientevidencefurnishedbythepetitioner/sregarding;Dumpingofgoodsinquestion;Injurytothedomesticindustry;andAcausallinkbetweenthedumpedimportsandallegedinjurytothedomesticindustry.Q.6CantheDesignatedAuthorityinitiateAntiDumpingcasesinrespectofitemssuo-motu,i.e.onitsown,withoutapetitionfiledbytheaggrievedparty?Ans.Normallyspeaking,theDesignatedAuthorityinitiatestheproceedingsforantidumpingactiononthebasisofapetitionreceivedfromthedomesticindustryallegingdumpingofcertaingoodsandtheinjurycausedtoitbysuchdumping.However,Rule5(4)oftheAntiDumpingRulesprovidesforsuo-motuinitiationofantidumpingproceedingsbytheDesignatedAuthorityonthebasisofinformationreceivedfromtheCollectorofCustomsappointedundertheCustomsAct,1962orfromanyothersource.Insuchcircumstances,theAuthorityinitiatestheantidumpinginvestigationonitsownwithoutanycomplaint/petitionfiledinthisregard,providedtheAuthorityissatisfiedthatsufficientevidenceexistsastotheexistenceofdumping,injuryandcausallinkbetweenthedumpedimportsandtheallegedinjury.Itisfurtherclarifiedthatafterinitiation,thesuo-motuinvestigationfollowsthesameprocedureastheonebasedonapetitionasmentionedintheAntiDumpingRules.Q.7WhatistheinformationrequiredtobesubmittedbytheDomesticIndustryforAntiDumpingproceedings?Ans.Anapplicationforinvestigationintoanyallegeddumpingfiledbytheaggrieveddomesticindustrymustcontainsufficientevidence(likeBillofEntry,I
