1反倾销条例（英文版）来源：涉外法律网Anti-dumpingRegulationofThePeople'sRepublicofChinaDecree[2001]No.328ofthestateCouncilTheAnti-DumpingRegulationofthePeople''sRepublicofChina,whichwereadoptedatthe46thexecutivemeetingoftheStateCouncilonOctober31,2001,areherebypromulgated,andshallcomeintoforceonJanuary1,2001.PremieroftheStateCouncil:ZhuRongjiNovember26,2001Attachment:Anti-dumpingRegulationofthePeople''sRepublicofChinaChapterIGeneralProvisionsArticle1ThepresentRegulationhasbeenenactedinaccordancewiththerelevantprovisionsoftheForeignTradeLawofthePeople''sRepublicofChinawithaviewtomaintainingforeigntradeorderandfaircompetition.Article2IncasethatimportedproductsenterthemarketofthePeople''sRepublicofChinabywayofdumping,andcausematerialdamageorconstituteathreatofmaterialdamagetoanalreadyestablisheddomesticindustry,orcauseamaterialimpedimenttotheestablishmentofadomesticindustry,aninvestigationshallbeconductedandanti-dumpingmeasuresshallbetakeninaccordancewiththepresentRegulation.ChapterIIDumpingandDamageArticle3ThetermdumpingshallrefertotheentryofimportedproductsintothemarketofthePeople''sRepublicofChina,intheordinarycourseoftrade,withtheirexportpricelowerthantheirnormalvalue.TheMinistryofForeignTradeandEconomicCooperation(hereinafterreferredtoastheMOFTEC)shallberesponsiblefortheinvestigationonanddeterminationofdumping.Article4Thenormalvalueofimportedproductsshallbedeterminedinthefollowingwaysonthebasisofdifferentcircumstances:(1)incasethattheproductsofthesamecategoryasthatoftheimportedproductshaveacomparablepriceinthedomesticmarketoftheexportingcountry(region)intheordinarycourseoftrade,thatcomparablepriceshallbethenormalvalue;(2)incasethattheproductsofthesamecategoryasthatoftheimportedproductsarenotsoldonthedomesticmarketoftheexportingcountry(region)intheordinarycourseoftrade,orthepriceorquantityoftheproductsofthesamecategorycannotbeusedasabasisforfaircomparison,thenormalvalueshallbethecomparablepriceatwhichtheproductsofthesamecategoryareexportedtoaproperthirdcountry(region)orshallbetheproductioncostoftheproductsofthesamecategoryinthecountry(region)oforiginplusreasonableexpensesandprofits.Wheretheimportedproductsdonotdirectlycomefromthecountry(region)oforigin,thenormalvalueshallbedeterminedinaccordancewithItem(1)oftheprecedingparagraph;however,iftheproductsaretransportedonlythroughtheexportingcountry(region)ortheproductsarenotproducedintheexportingcountry(region)ornocomparablepriceexistsinthe2exportingcountry(region),etc.,thepriceofthesaidproductsofthesamecategoryinthecountry(region)oforiginmayberegardedasthenormalvalue.Article5Theexportpriceoftheimportedproductsshallbedeterminedinthefollowingwaysaccordingtodifferentcircumstances:(1)incasetheimportedproductshaveanactualpaymentpriceorapayableprice,suchpriceshallbetheexportprice;(2)incasetheimportedproductsdonothaveanexportpriceoritspriceisnotreliable,thepricepresumedonthebasisofthepriceatwhichtheimportedproductsarere-soldforthefirsttimetoanindependentbuyershallberegardedastheexportprice;however,iftheimportedproductsarenotre-soldtoanindependentbuyerornotre-soldinthestatuswhentheyareimported,thepricepresumedbytheMOFTEConareasonablebasismayberegardedastheexportprice.Article6Themarginbetweentheexportpriceofimportedproductswhichislowerthantheirnormalvalueshallbethedumpingmargin.Theexportpriceoftheimportedproductsandthenormalvalueshallbecomparedinafairandreasonablemannerbytakingthevariouscomparablefactorswhichmayimpactthepriceintoconsideration.Thedumpingmarginshallbedeterminedwiththeweightedaveragenormalvalueandtheweightedaveragepriceofallthecomparableexporttransactionsbeingcompared,orwiththenormalvalueandtheexportpricebeingcomparedtransactionbytransaction.Wheretheexportpricesareconsiderablydifferentbetweendifferentbuyers,regionsorperiods,andthusaredifficulttobecomparedinthewaysprovidedintheprecedingparagraph,theweightedaveragenormalvaluemaybecomparedwiththepriceofasingleexporttransaction.Article7Thetermdamageshallrefertothefactthatdumpinghascausedmaterialdamageorconstituteathreatofmaterialdamagetoanalreadyestablisheddomesticindustry,orcausedamaterialimpedimenttotheestablishmentofadomesticindustry.TheStateEconomicandTradeCommission(hereinafterreferredtoastheSETC)shallberesponsiblefortheinvestigationonanddeterminationofdamage;whiletheanti-dumpinginvestigationonthedamagetoadomesticindustryrelatingtoagriculturalproductsshallbeconductedbytheSETCincollaborationwiththeMinistryofAgriculture.Article8Whendeterminingthedamagecausedtoadomesticindustrybydumping,thefollowingitemsshallbeexamined:(1)thequantityofthedumpedimports,includingasharpincreaseintheabsolutequantityofthedumpedimportsorthequantityascomparedwiththeproductionorconsumptionofthedomesticproductsofthesamecategory,orthepossibilityofasharpincreaseinthequantityofthedumpedimports;(2)thepriceofthedumpedimports,includingthepricecutsofthedumpedimportsortheimpactssuchasgreatrestraintorreduction,etc.tothepriceofthedomesticproductsofthesamecategory;(3)theimpactsofthedumpedimportsupontherelevanteconomicfactorsandtargetsofthedomesticindustry;(4)th
