外国人在中国永久居留审批管理办法(英文版)MeasuresfortheAdministrationofExaminationandApprovalofForeigners'PermanentResidenceinChina(ApprovedbytheStateCouncilonDecember13,2003,andpromulgatedbyOrderNo.74oftheMinistryofPublicSecurityandtheMinistryofForeignAffairsonAugust15,2004)Article1Inordertostandardizetheexaminationandapprovalofforeigners'permanentresidenceinChina,theseMeasuresareformulatedinaccordancewiththerelevantprovisionsoftheLawofthePeople'sRepublicofChinaonControlofEntryandExitofForeignersandtheDetailedRulesforitsimplementation.Article2Foreigners'permanentresidenceinChinareferstothattheperiodofforeigners'residenceinChinaisnotlimited.Article3TheForeigner'sPermanentResidenceCardisavalidIDcertificateforaforeignerwhohasobtainedpermanentresidencestatusinChinaandmaybeusedindependently.Article4AforeignerwithpermanentresidencestatusinChinamayenterandleaveChinawithhisvalidpassportandForeigner'sPermanentResidenceCard.Article5TheauthoritiestoaccepttheapplicationsofforeignersforpermanentresidenceinChinaarethepublicsecurityorgansofthepeople'sgovernmentsofcitieswithsubordinatedistrictsandthepublicsecuritybranchbureausandcounty-levelbureausofmunicipalitiesdirectlyundertheCentralGovernment.Theauthoritiestoexamineforeigners'applicationsforpermanentresidenceinChinaarethedepartmentsandbureausofpublicsecurityofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment.Theauthoritytoexamineandapproveforeigners'applicationsforpermanentresidenceinChinaistheMinistryofPublicSecurity.Article6ForeignersapplyingforpermanentresidenceinChinamustabidebyChineselaws,beingoodhealthandwithoutanycriminalrecord,andmustmeetatleastoneofthefollowingrequirements:(1)havingmadedirectinvestmentinChinawithstableoperationandagoodtaxpayingrecordforthreesuccessiveyears;(2)havingbeenholdingthepostofdeputygeneralmanager,deputyfactorydirectororaboveorofassociateprofessor,associateresearchfellowandotherassociateseniortitlesofprofessionalpostoraboveorenjoyinganequaltreatment,foratleastfoursuccessiveyears,withaminimumperiodofresidenceinChinaforthreecumulativeyearswithinfouryearsandwithagoodtaxpayingrecord;(3)havingmadeagreatandoutstandingcontributiontoandbeingspeciallyneededbyChina;(4)beingthespouseorunmarriedchildunder18yearsoldofapersonwithreferencetotheitem(1),(2)or(3)ofthisparagraph;(5)beingthespouseofaChinesecitizenorofaforeignerwithpermanentresidencestatusinChina,inamarriagerelationshipforatleastfiveyears,withatleastfivesuccessiveyearsofresidenceinChinaandatleastninemonthsofresidenceinChinaeachyear,andhavingstablesourceofsubsistenceandadwellingplace;(6)beinganunmarriedpersonunder18yearsoldturningtohisparent;or(7)beingapersonwhoisorabove60yearsold,whohasnodirectrelativeabroadandistoturntoanydirectiverelativeinChina,andhasstayedinChinaforatleastfivesuccessiveyearswithatleastnine-monthresidenceinChinaeachyear,andhasstablesourceofsubsistenceandadwellingplace.TheperiodsoftimeinthisArticlemeanthesuccessiveonestillthedateofapplication.Article7Inthecaseofaforeignerunderitem(1)ofthefirstparagraphofArticle6herein,theregisteredcapitalpaidbyhimasinvestmentinChinashallmeetanyofthefollowingrequirements:(1)inthecaseofinvestmentinanyindustryencouragedundertheCatalogueforGuidanceofForeignInvestmentIndustries,atleastUS$500,000intotal;(2)inthecaseofinvestmentinthewesternareaofChinaoranykeycountyunderpovertyreductionanddevelopmentprogram,atleastUS$500,000intotal;(3)inthecaseofinvestmentinthecentralareaofChina,atleastUS$1millionintotal;or(4)inthecaseofinvestmentinChina,atleastUS$2millionintotal.Article8Inthecaseofaforeignerunderitem(2)ofthefirstparagraphofArticle6herein,theentityinwhichheholdsapostmustbeanyofthefollowing:(1)aninstitutionsubordinatetoanydepartmentoftheStateCouncilortothepeople'sgovernmentattheprovinciallevel;(2)akeycollegeoruniversity;(3)anenterpriseorgovernment-sponsoredinstitutionimplementingakeyengineeringprojectormajorscientificresearchprojectofthestate;or(4)ahigh-techenterprise,foreigninvestedenterpriseinencouragedfields,technologicallyadvancedenterprisewithforeigninvestmentorexport-orientedenterprisewithforeigninvestment.Article9TheapplicantshallfaithfullyfillintheFormofApplicationforForeigner'sPermanentResidenceinChinaandsubmitthefollowingmaterials:(1)acopyofhisvalidpassportorothercertificatethatmaybeusedinsteadofthepassport;(2)ahealthcertificateissuedbyahealthquarantineagencydesignatedbytheChinesegovernmentorbyaforeignhealthquarantineagencyrecognizedbytherelevantChineseembassyorconsulate;(3)acertificateofnocriminalrecordinthecountryconcernedasissuedbytherelevantChineseembassyorconsulate;(4)fourrecentfull-facecolorphotos(2by2inches,bareheaded)oftheapplicant;and(5)otherrelevantmaterialsprovidedherein.Article10AnapplicantunderItem(1)ofthefirstparagraphofArticle6hereinshallsubmitacertificateofapprovalfortheforeign-investedenterprise,certificateofregistrationandajointannualinspectioncertificate,reportontheverificationcapitalandpersonaltaxpaymentreceiptinaddition.Inthecaseofaforeign-investedenterpriseinencouragedfields,aletterofconfirmationinrespecto
