LawofthePeople'sRepublicofChinaonPreventionandControlofEnvironmentalPollutionbySolidWaste(Adoptedatthe16thMeetingoftheStandingCommitteeoftheEighthNationalPeople’sCongressonOctober30,1995,revisedatthe13thMeetingoftheStandingCommitteeoftheTenthNationalPeople’sCongressandpromulgatedbyOrderNo.31ofthePresidentofthePeople’sRepublicofChinaonDecember29,2004)ContentsChapterIGeneralProvisionsChapterIISupervisionoverthePreventionandControlofEnvironmentalPollutionbySolidWasteChapterIIIPreventionandControlofEnvironmentalPollutionbySolidWasteSection1GeneralRegulationsSection2PreventionandControlofEnvironmentalPollutionbyIndustrialSolidWasteSection3PreventionandControlofEnvironmentalPollutionbyHouseholdWasteChapterIVSpecialRegulationsforPreventionandControlofEnvironmentalPollutionbyHazardousWasteChapterVLegalResponsibilityChapterVISupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisenactedforthepurposeofpreventingandcontrollingenvironmentalpollutionbysolidwaste,ensuringhumanhealth,maintainingecologicalsafetyandpromotingthesustainabledevelopmentoftheeconomyandsociety.Article2ThisLawisapplicabletothepreventionandcontrolofenvironmentalpollutionbysolidwastewithintheterritoryofthePeople’sRepublicofChina.ThisLawisnotapplicabletothepreventionandcontrolofmarineenvironmentalpollutionbysolidwasteorofenvironmentalpollutionbyradioactivesolidwaste.Article3Inpreventingandcontrollingenvironmentalpollutionbysolidwaste,theStatefollowstheprinciplesofreducingthequantityofsolidwastegeneratedanditsharmfulness,fullyandrationallyutilizingsolidwaste,andmakingitinnocuousthroughtreatment,inordertopromotecleanerproductionandthedevelopmentofacirculareconomy.TheStateadoptseconomicandtechnicalpoliciesandmeasuresthatfacilitatethecomprehensiveuseofsolidwaste,inordertofullyrecoverandrationallyutilizesolidwaste.TheStateencouragesandsupportstheadoptionofmeasuresforconcentratedtreatmentofsolidwasteforthebenefitofenvironmentalprotectionandpromotesthedevelopmentoftheindustrydesignedtopreventandcontrolenvironmentalpollutionbysolidwaste.Article4People’sgovernmentsatorabovethecountylevelshallincludethepreventionandcontrolofenvironmentalpollutionbysolidwasteintheirplansfornationaleconomicandsocialdevelopmentandadopteconomicandtechnicalpoliciesandmeasuresthatfacilitatethepreventionandcontrolofenvironmentalpollutionbysolidwaste.Whenmakingarrangementsfordrawingupplansfortownandtownshipconstruction,landuse,regionaldevelopment,industrialdevelopment,etc.,therelevantdepartmentsundertheStateCouncil,localpeople’sgovernmentsatorabovethecountylevelandtherelevantdepartmentsunderthemshallgiveoverallconsiderationtotheneedofreducingthequantityofsolidwastegeneratedanditsharmfulness,andpromotingthecomprehensiveuseofsolidwasteandmakingitinnocuousthroughtreatment.Article5Inpreventingandcontrollingenvironmentalpollutionbysolidwaste,theStatefollowstheprinciplewherebythepolluterisheldresponsibleinaccordancewithlaw.Manufactures,sellers,importersandusersofproductsshall,inaccordancewithlaw,beresponsibleforpreventingandcontrollingpollutionbysolidwastegeneratedbytheproducts.Article6TheStateencouragesandsupportsscientificresearchinanddevelopmentoftechnologiesforpreventionandcontrolofenvironmentalpollutionbysolidwaste,promotesthewideuseofadvancedtechnologiesforsuchpreventionandcontrol,anddisseminatesscientificknowledgeinthisfield.People’sgovernmentsatvariouslevelsshallenhancepublicityandeducationintheneedofpreventionandcontrolofenvironmentalpollutionbysolidwasteandpromotethemodeofproductionandwayoflifethatareconducivetoenvironmentalprotection.Article7TheStateencouragesunitsandindividualstopurchaseoruserecycledandrecyclableproducts.Article8Thepeople’sgovernmentsatvariouslevelsshallgiveawardstotheunitsandindividualsthathaveachievedoutstandingsuccessesinthepreventionandcontrolofenvironmentalpollutionbysolidwasteandinitsmultipurposeuse.Article9Allunitsandindividualshavetheobligationtoprotecttheenvironmentandhavetherighttoreportorfilechargesagainsttheunitsorindividualsthatcauseenvironmentalpollutionbysolidwaste.Article10TheadministrativedepartmentforenvironmentalprotectionundertheStateCouncilshallconductunifiedsupervisionoverthepreventionandcontrolofenvironmentalpollutionbysolidwastethroughoutthecountry.TherelevantdepartmentsundertheStateCouncilshallberesponsibleforsupervisionoverthepreventionandcontrolofenvironmentalpollutionbysolidwastewithinthescopeoftheirrespectiveduties.Theadministrativedepartmentsforenvironmentalprotectionunderthelocalpeople’sgovernmentsatorabovethecountylevelshallconductunifiedsupervisionoverthepreventionandcontrolofenvironmentalpollutionbysolidwastewithintheirownadministrativeareas.Therelevantdepartmentsofthesaidpeople’sgovernmentsshallberesponsibleforsupervisionoverthepreventionandcontrolofenvironmentalpollutionbysolidwastewithinthescopeoftheirrespectiveduties.TheadministrativedepartmentforconstructionundertheStateCouncilandtheadministrativedepartmentsforenvironmentalsanitationunderthelocalpeople’sgovernmentsatorabovethecountylevelshallberesponsibleforsuperv
