1中华人民共和国城市房地产管理法LawofthePeople’sRepublicofChinaonUrbanRealEstateAdministration(adoptedbythe8thmeetingoftheStandingCommitteeofthe8thNationalPeople’sCongressonJuly5,1994andamendedaccordingtotheDecisiononAmendingtheLawofthePeople’sRepublicofChinaonUrbanRealEstateAdministrationwhichwasadoptedatthe29thmeetingofthestandingcommitteeofthe10thNationalPeople’sCongressofthePeople’sRepublicofChinaonAugust30th,2007)CONTENTSCHAPTERIGENERALPRINCIPLESCHAPTERIILANDFORREALESTATEDEVELOPMENTPART1LEASINGOFRIGHTOFLANDUSEPART2ALLOCATIONOFRIGHTTOUSELANDCHAPTERIIIREALESTATEDEVELOPMENTCHAPTERIVTRANSACTIONSOFREALESTATEPART1GENERALPROVISIONSPART2TRANSFEROFREALESTATEPART3MORTGAGEOFREALESTATEPART4LEASINGOFHOUSESPART5INTERMEDIATESERVICEAGENCIESCHAPTERVREGISTRATIONOFREALESTATETITLECHAPTERVILEGALLIABILITIESCHAPTERVIISUPPLEMENTARYPROVISIONSCHAPTERIGENERALPRINCIPLESArticle1Thislawisformulatedforthepurposeofsafeguardingtherealestatemarketorder,protectinglawfulrightsandinterestsofrealestateownersandpromotinghealthydevelopmentoftherealestateindustrythroughastrengtheningofurbanrealestateadministration.Article2ThosewhoacquiretherighttousetheState-ownedlandwithinthedesignatedurbanareaofthePeople’sRepublicofChina(hereinafterreferredtoasState-ownedland)forrealestatedevelopment,engageinrealestatedevelopmentortransactionsofrealestateandexerciserealestateadministrationshallabidebythelaw.Thebuildingsreferredtointhislawshallmeanhousesandotherstructuresontheland.TherealestatedevelopmentreferredtointhislawshallmeantheactivitiesofconstructionofinfrastructuresandbuildingsonthelandthattherighttousetheState-ownedlandhasbeenassignedinaccordancewiththislaw.2Thetransactionsofrealestatereferredtointhislawshallmeantransferofrealestate,mortgageofrealestateandleasingofbuildings.Article3TheStatepracticessystemofusingState-ownedlandsunderduecompensationandtermsofusingthelandexcepttheuseofState-ownedlandallocatedbytheStateaccordingtothislaw.Article4TheStateshall,inaccordancewiththesocialandeconomicdevelopmentlevel,supportsconstructionofresidentialhousestograduallyimprovethelivingconditionsoflocalresidents.Article5Realestateownersshallabidebythelawsandadministrativedecreesandpaytaxaccordingtothelaw.Thelawfulrightsandinterestsofrealestateownersareprotectedbythelawagainstanyinfringementbyinstitutesandindividuals.Article6Forpublicinterests,thestatecanexpropriateanyentityorindividual’shousebuiltonstate-ownedland,butthestateshallgiverelocationcompensationsaccordingtolawandsafeguardthelegitimaterightsandinterestsoftheentityorindividual.Ifanindividual’sresidentialhouseistobeexpropriated,thestateshallguaranteethehousingconditionsoftheindividual.ThespecificmeasuresshallbeformulatedbytheStateCouncil.Article7TheadministrativedepartmentinchargeofconstructionandthelandadministrationdepartmentoftheStateCouncilshalladministertheworkofrealestatenationwideindividuallyorcooperativelyundertheirownpowers.Theorganizationalset-upandpowerofthereallestateadministrationandlandadministrationdepartmentsofthelocalpeople’sgovernmentsabovethecountylevelshallbedeterminedbytheprovincial,autonomousregionalormunicipalpeople’sgovernments.CHAPTERIILANDFORREALESTATEDEVELOPMENTPARTILEASINGOFRIGHTOFLANDUSEArticle8LeasingtherightoflandusemeansthattheStateleasestherightofusingtheState-ownedlandtolanduserswithinacertainperiodandthelandusersshallpaytheStatefeesforusingtheland.Article9Foracollectively-ownedlandwithinadesignatedurbanarea,itmustberequisitionedandturnedintoState-ownedlandinaccordancewithlawfirstandthenforleasingouttolanduserswithduecompensation.Article10Theleaseoutoflandforusemustcomplywiththeoveralllanduseplan,theurbanplanandtheannualconstructionlanduseplan.Article11Forleasingouttherightoftheirlandforrealestatedevelopment,theypeople’sgovernmentabovethecountrylevelmustfirstofalldraftplansoftotalareasoflandtobeleasedoutinayearinaccordancewiththecontrolquotasassignedbythepeople’sgovernmentator3abovetheprovinciallevel,andfollowingtheprovisionsoftheStateCouncil,reporttotheStateCouncilorprovincial-levelpeople’sgovernmentforendorsement.Article12Therighttouselandshallbeleasedstepbystepinaplannedmannerbycityorcountypeople’sgovernments.Acityorcountypeople’sgovernmentandtheurbanplanning,constructionandrealestateadministrationdepartmentsshalljointlydraftaplanonthetractsoflandtobeleasedoutwiththeiruses,termofuseandotherconditions,andfollowingtheprovisionsoftheStateCouncil,reporttotheempoweredpeople’sgovernmentforapprovalandthenhanddowntheplantothelandadministrationdepartmentofthecityorcountypeople’sgovernmentforexecution.Thepowerconsignedtocountypeople’sgovernmentsandtherelevantdepartmentsofthemunicipalitydirectlyunderCentralGovernmentforexecutionasreferredtointheaboveparagraphshallbedeterminedbythemunicipalpeople’sgovernment.Article13Therightofuselandshallbeleasedthroughauction,biddingornegotiationsbetweentherelatedparties.Therighttousethelandforconstructionofcommercial,tourist,recreationalfacilitiesorluxuryhousingmustbeleasedoutthroughauctionorbidding,whenconditionspermit;whenconditionsdonotpermitandauctionorb
