大学英语法学英语(二)学期小论文GunpolicyinAmericaandChina---implicationtoChina中美枪支政策研究和对中国的启示学号:2014812063专业:成思危现代金融姓名:王白雪学院:商学院年级:2014级英语班级:16完成日期:2015,6,18论文成绩:1GunpolicyinAmericaandChinaAbstract:Asuccessiveofshootingaccidentshappenedallovertheworldinrecentyears,whichhasheightenedtheurgeforawholesomegun-controlsystem.Toourdisappointment,however,recentgunlawsinChinaarefarfromsatisfactionandtheyneedsomesupplementandimprovement.ThestudywasmadebyconsultingagooddealofgunlawsbothinChinaandAmericaandanalysisthemfromdifferentperspective.Thepaperisorganizedasfollowingways.Inpart1,wewillcompareAmericaandChinaintermsofgunpolicy.Inpart2,reasonsthataccountforthedifferencewillbegiven.Andinpart3,constructiveadvicewillbeoffered,whichislikelytohelplawmakersmakebetterdecision.Hardaswetried,therearemanydeficienciesthatwewilltrytomakeup.Keywords:firearmscontrol;firearmslegalization;American;ChinaOnJune8th,apsychopathshotatinnocentpeoplemadlyinhisvillage,HebeiProvince,China.Theshockingaccidentcausesdeathof5,including2policeofficers.Actually,asuccessiveofshootingaccidentshappenedallovertheworldinrecentyears,whichhasheightenedtheurgeforawholesomegun-controlsystem.ItisgenerallyknownthatAmericapossessesalonghistoryofholdingfirearms,whoconsequentlyhasamorethoroughguncontrolsystem.MypurposeofwritingthispaperistocomparegunpolicybetweenAmericaandChina,andthenputforwardfeasiblesuggestionstothecompletionofChinesegun-controlpolicy.Itisvitaltodothisresearch,forfirearmproblemisdirectlyrelatedtolifesafetyandsocialstability.Bymakingnecessaryadjustmentandbeneficialcomplement,weareabletodefensecitizen’slegalrightsaswellasmaintainagoodsocialorder.Before,althoughconsiderableresearchhasbeendevotedtoAmericangun-controlproblem,ratherlessattentionhasbeenpaidtoitsimplicationtoChina,neithertoChinesegun-control2policyresearch.Hence,myresearchislikelytofillinthegaps.Generallyspeaking,theworldisdividedintotwocampswhenitcomestogunproblems:firearmscontrolandfirearmsban.Americaisatypicalcountrywhoentitlespeopletherightofkeepingandbearingarms,whileChinabangunthroughoutthecountry.IattributethedifferencesbetweenAmericaandChinatothefollowingsfacts:distincthistory,culture,lawandsocialroot.Firearm,asthemostpopularconventionalweapons,playsanimportantroleinhumansocietybutcausesmanyproblemsaswell.Gunaccidentshappeneveryday,anditseemsthattheynevercometoanend.Worsestill,mostofthevictimsareinnocentyoungkids.Ironically,nosubstantialactionsareseenthoughpeopleareratherindignantwhentalkingaboutthelatestviolence.Withsomanyseverecrimearound,itishightimethatweconductedastudyandfindsomesolutionstoit.AmericangunpolicydiffersfromwhichinChinaduetothefollowingreasons.First,thepurposeofAmericaandChinaisdifferent.Americamakeslawsinordertoimposerestrictionsonholdingguns,whileChina’spurposeistobanittotally.Insimpleterms,AmericaembodiessomerestrictionsinallowanceandChinaembodiessomeallowanceinrestrictions.Second,theobjectoffirearmpolicyaredistinct.InAmerica,peoplecanbeararmssolongastheyareoldenoughandhavenoseverecrimerecordormentaldisease.InChina,however,apersonhastobeaprofessionalhunter,ashootingathleteorotherspecialprofessionifhewantstoholdguns.Third,theprocedureisunlikeinthistwocountries.Americafocusesonproducingandfirst-handpurchasingofgunbutdolittleinintermediatetradinglikeblackmarkettrading.Bycontrast,Chinaisquitestrictineveryprocedure.Fourth,quantityandqualityoflaws.TheSecondAmendmenttotheUnitedStatesConstitution(1791.12.15)states:Awell-regulatedmilitia,beingnecessarytothesecurityofafreestate,therightofthepeopletokeepandbeararms,shallnotbeinfringed.ItisthefirstandthemostauthoritativelawsinAmerica.Otherthanthis,U.S.GunLaws(1934),FederalGunLaw(1938),BradyGunControlLaw(1993),and3numerouscantonalspecialgunlaws.China,however,hasonlyafewlawsrelatingtoguns.firearmlawsofthePeople’sRepublicofChinaisthemainnorminChinsnow.Thereasonscontributetothedifferencearenotdifficulttofind.Amongthem,historyandculturearetwoofthem.Asweallknow,Americaisacolonialcountryandearlierpeoplearmeduptohunt,fightforland,andstriveforrights.FirearmsplayanimportantroleAmericanhistory,especiallyintheWarofIndependence.Forthem,gunsarefarmorethantoolsbutthesymbolofpeopleseekingforlegalrights.ButChinahasnohistoryofbearingarms.TheFirstEmperorofQindestroyedallweaponsnationwide,andsincethen,governorshaveforbiddenpeoplefrompossessingfirearmsforalmosttwothousandyears.SinceConfucianismhasahugeimpactonChineseculture,itisunlikelyforChinatopursuepersonalrightsattheexpenseofpeople’ssafety.What’smore,differentsocialsystems,orrathercapitalismandsocialism,arealsoimportantfactorsthatinfluencefirearmspolicy.Fromtheanalysisabove,wecancometoconclusionthat:Becauseofthedistinctnationalconditions,itisunwiseforChinatoadoptAmericanpolicyrashly.However,somereferencefromAmericaisnecessaryifChinawantstoregulatefirearmsbetter.First,Chinashouldrecognizethepositivepartoffirearms.Americaregardsgunsasusefultoolsinself-defense,entertainment,hunting,athleticcontestandevencollectionobjects.China,however,usegunsmainlyformaintainingsecurityofsocietyandnationaldefense.Ac
