船舶建造保险条款第一条保险期限本保险在保险单列明的保险期限内从保险船舶建造开工之日或上船台之日起生效，直至保险船舶建成在投保前已分配在船上的物资和机械设备，自保险单中列明的保险起期日开始时生效。在保险开始生在本保险单列明的保险期限内，保险船舶若提前交付给所有人满一个月者，本公司可退还被保险人规定的保险费，不足一个月者不退费。如超过保险期限交付，必须事先书面通知本公司办理展延保险期限手第二条保险价值和保险金额保险价值为船舶的建成价格或最后合同价格。保险金额应按保险价值确定。被保险人如以暂定价值作为保险金额投保，应在船舶建成或确定最后合同价格后通知本公司调整保险金额。对暂定价值超过或低于如果保险价值超过暂定价值125%时，本保险对任何一次事故或同一事件引起的一系列事故的保险船舶损失的赔偿总额，以暂定价值的125%为限。但由于保险船舶改变设计、装修或改动船型、物资变更所引起第三条责任范围1.保险船舶在船厂建造、试航和交船过程中，包括建造该船所需的在保险价值内的一切材料、机械和设备在船厂范围内装卸、运输、保管、安装、以及船舶下水、进出坞、停靠码头过程中，由于下列原因所(1)(2)(3)(4)因船台、支架和其他类似设备的损坏(5)(6)(7)为确定保险责任范围内损失所支付的合理费用，以及对船舶搁浅后为检查船底而支付的费用，即使2.(1)(2)(3)发生碰撞事故后，保险船舶对被碰撞船舶及其所载货物、浮动物件、船坞、码头或其他固定建筑物损失和延迟。丧失使用的损失以及施救费用、共同海损和救助费用依法应负的赔偿责任，但以保险船舶的(4)保险船舶遭受本条款责任范围内的损失事故后引起的清除保险船舶残骸的费用、对第三者人身伤亡(5)在发生碰撞或其他事故后，被保险人在事先征得本公司书面同意后，为争取限制赔偿责任所支付的(6)保险船舶的保险金额如低于保险价值，本公司对本款所列各项的责任或费用，按保险金额和保险价第四条除外责任1.由于被保险人故意或非法行为所造成2.对设计错误部分本身的修理、修改、更换或重建的费用及为了改进或更改设计所发生的任何费用；3.4.5.由于战争、恐怖活动、敌对行为、武装冲突、炸弹的爆炸、战争武器、没收、征用、罢工、暴动、6.7.由于任何国家或武装集团的拘留、扣押、禁第五条承保区域1.建造期间：限于造船厂范围内。建造船舶所需的材料、机器、设备在造船厂范围以外的任何运输、装卸、保管和建造船舶在造船厂范围以外的任何拖航必须事先通知本公司并交付规定的保险费后方予负责；2.试航、交船期间：20，000总吨以上的船舶的单程自航距离限于500海里，1，000总吨至20，000总吨船舶的单程自航距离限于250海里，1，000总吨以下船舶的单程自航距离限于100海里。如超过上述距离，必须事先通知本公司，并交付规定的保险费后方予负责。第六条赔款处理1.被保险人索赔时，应以书面说明事故经过、原因，并提供损失清单、发票、检验报告等必要单证和2.3.对保险船舶由于每一事故引起的部分损失，包括施救费用、船舶碰撞、清除保险船舶的残骸等。本在两个相连续的港口之间一个单独航程中，由于恶劣气候所致的损失索赔，应被视为一次意外事故；4.保险船舶试航时，在预计返回建造地点日期起超过六个月，尚未得到它的行踪消息，即构成船舶的失踪。船舶失踪或船舶遭受损失后，其估计救助、修理和其他必要支出的费用将超过保险船舶的保险价值时，5.第七条被保险人义务1.2.被保险人应遵守有关安全法令，采取合理的预防措施，避免发生意外事故，本公司代表有权对船舶3.保险船舶发生本保险单责任范围内的事故后，被保险人应立即通知本公司，并采取一切必要措施救护，防止损失扩大。对被保险人因此而支付的合理措施费用，本公司可予偿付，但以不超过受损保险项目4.5.保险船舶的损失涉及第三者责任时，被保险人必须采取必要措施向责任方追偿，为此而必须支付的6.第八条争议的处理被保险人与本公司之间的一切有关保险的争议，应通过友好协商解决。如果协商达不成协议，可申请BUILDERS’RISKSINSURANCECLAUSESⅠ.PeriodofInsuranceSubjecttotheperiodofinsurancespecifiedintheScheduletothePolicy,theinsuranceattachesfromthedayofcommencementofthebuildingoftheInsuredVesselorfromthedayonwhichtheInsuredVesselisallocatedtothebuildingberthuntilthetimeofdeliverytotheOrdererorOwneroftheInsuredVesseluponcompletionofbuilding,oruntilthetimeofexpiryoftheperiodofinsuranec,whicheverfirstoccurs.Theinsuranceonthematerials,machineryandequipmentallocatedtotheInsuredVesselpriortoapplicationforinsuranceattachesfromthedayofinceptionofinsurancespecifiedintheScheduletothePolicy.Theinsuranceonthematerials,machineryandequipmentallocatedordeliveredtotheBuildersafterinceptionoftheinsuranceattachesfromthetimeofallocationordelivery.TheCompanywillreturntotheInsuredtheagreedpremiumiftheInsuredVesselisdeliveredtotheOwneronemonthbeforeexpiryoftheperiodofinsurancestipulatedintheScheduletothePolicy.NopremiumwillbereturnediftheInsuredVesselisdeliveredtotheOwnerlessthanonemonthbeforeexpiryoftheperiodofinsurance.Wheredeliveryismadebeyondtheperiodofinsurance,previouswrittennoticeshallbegiventotheCompanyforanextensionoftheperiodofinsurance.Anagreedadditionalpremiumwillbechargedifthetimeofextensionattainsonemonth;noadditionalpremiumwillbechargedifitislessthanonemonth.Ⅱ.InsuredValueandInsuredAmountThetotalbuildingcostorthefinalcontractvalueoftheInsuredVesselshallbetheInsuredValueandtheInsuredAmountshallbedetermineduponthebasisoftheInsuredValue.WhereatthetimeofapplicationforinsurancetheInsuredAmountisbasedontheprovisionalvalue,theInsuredshallnotifytheCompanytoeffectadjustmentoftheInsuredAmountwhentheInsuredVesseliscompletedorthefinalcontractvalueisdetermined.OnthedifferencebetweentheProvisionalValueandtheInsuredValueanadditionalpremiumwillbechargedprorataiftheprovisionalvalueislowerandaproratareturnofpremiumwillbechargedprorataiftheprovisionalvalueislowerandaproratareturnofpremiumwillbemadeiftheprovisionalvalueishigher.Nevertheless,shouldtheInsuredValueexceedtheprovisionalvalue,thentheindemnityunderthisinsuranceshallbelimitedto125%oftheprovisionalvalueanyoneaccidentorseriesofaccidentsarisingoutofthesameevent.Thisprovision,however,shallnotapplytoanyvariationofthebuildingcostoftheInsuredVesselresultingfromamaterialalterationindesign,fittingsortypeoftheVessel.Ⅲ.ScopeofCoverTheCompanyshallbeliableforthefollowinglossofand/ordamageto,andliabilityandexpensesinconnectionwith,theInsuredVessel:1.LossordamageandexpensescausedbytheundermentionedeventswhilsttheInsuredVesselisincourseofconstruction,trialsanddelivery,includingloadingandunloading,transportation,storageandinstallationofallthematerials,machineryandequipmentnecessaryinbuildingtheInsuredVesselwithintheInsuredValueandwithintheShipyard,andwhilsttheInsuredVesselisincourseoflaunching,proceedingtoandfromdocksormooringalongsideawharf:(1)Naturalcalamitiesand/oraccidents;(2)Negligence,faultandlackofskillofworkers,technicians,Master,CrewandPilots;(3)Latentdefectsinhull,machineryandequipment;(4)Damagetoorbreakdownofdocks,cradlesandotherlikeequipment;(5)FaultydesignofanypartorpartsoftheInsuredVessl;(6)Expensesnecessarilyincurredincompletinglaunchafterfailureoflaunch;(7)Expensesreasonablyincurredforascertainingthelossordamagefallingwithinthescopeofcover,andexpenseofsightingthebottomafterstranding,ifincurredspeciallyforthatpurpose,eventhoughnodamageisfound.2.Liabiliti
