外商投资建筑业企业管理规定》[英文版]中华人民共和国建设部、对外贸易经济合作部令第113号WangGuangtaoShiGuangsheng二〇〇二年九月二十日RegulationsonAdministrationofForeign–InvestedConstructionEnterprisesTheMinistryofConstructionofthePeople’sRepublicofChinaTheMinistryofForeignTradeandEconomicCooperationofthePeople’sRepublicofChinaDecreeNo.113RegulationsonAdministrationofForeign-InvestedConstructionEnterprisesapprovedrespectivelyatthe63rdExecutiveMeetingoftheMinistryofConstructionon9September2002andatthe10thMinisterialMeetingoftheMinistryofForeignTradeandEconomicCooperationon17September2002arenowissuedandshallgointoeffecton1December2002.MinisteroftheMinistryofConstruction:WangGuangtaoMinisteroftheMinistryofForeignTradeandEconomicCooperation:ShiGuangsheng27September2002RegulationsonAdministrationofForeign–InvestedConstructionEnterprisesChapter1GeneralprovisionsArticle1TheseRegulationshereofareformulatedtofurthertheopeninguptotheoutsideandstandardisetheadministrationofforeign-investedconstructionenterprisesinaccordancewithsuchlawsandregulationsastheConstructionLawofthePeople’sRepublicofChina,theTenderingandBiddingLawofthePeople’sRepublicofChina,theLawofthePeople’sRepublicofChinaonSino-foreignEquityJointVentures,theLawofthePeople’sRepublicofChinaonSino-ForeignCooperativeJointVentures,theLawofthePeople’sRepublicofChinaonWhollyForeign-OwnedEnterprisesandtheRegulationsonAdministrationofConstructionandEngineeringQuality.Article2Theseregulationsshallapplytotheestablishmentofforeign–investedconstructionenterpriseswithintheterritoryofthePeople’sRepublicofChina,theapplicationforconstructionenterprisequalificationsandtheadministrationandsupervisionofforeign–investedconstructionenterprises.Theterm‘foreign-investedconstructionenterprise’mentionedintheseregulationsreferstoawhollyforeign-ownedconstructionenterprise,oraSino-foreignequityconstructionjointventureoraSino-foreigncooperativeconstructionenterpriseestablishedwithintheterritoryofthePeople’sRepublicofChinainaccordancewithChineselawsandregulations.Article3Aforeigninvestor,whichintendstoestablishaforeign-investedconstructionenterprisewithintheterritoryofthePeople’sRepublicofChinaandconductconstructionbusiness,shall,inaccordancewithlaws,obtaintheapprovalcertificatefromtherelevantforeigntradeandeconomiccooperationadministrationdepartmentandregisterwiththeStateAdministrationofIndustryandCommerceoritsauthorisedadministrationofindustryandcommerceatlocallevels,andthequalificationcertificatefromtherelevantconstructionadministrationdepartment.Article4Foreign-investedconstructionenterpriseswhichengageinconstructionbusinesswithintheterritoryofthePeople’sRepublicofChinashallabidebythelaws,regulationsandrulesofthePeople’sRepublicofChina.Thelawfuloperationofforeign-investedconstructionenterprisesandtheirlegalrightsandinterestswithintheterritoryofthePeople’sRepublicofChinashallbeprotectedbyChineselaws,regulationsandrules.Article5TheforeigntradeandeconomiccooperationadministrationdepartmentoftheStateCouncilshallberesponsiblefortheadministrationoftheestablishmentofforeign-investedconstructionenterprises.TheconstructionadministrationdepartmentoftheStateCouncilshallberesponsiblefortheadministrationofthequalificationsofforeign–investedconstructionenterprises.Theforeigntradeandeconomiccooperationadministrationdepartmentsofthepeople’sgovernmentofprovinces,autonomousregionsordirectlyadministeredmunicipalitiesshallberesponsiblefortheadministrationoftheestablishmentofforeign-investedconstructionenterpriseswithintheirauthorisedjurisdiction;theconstructionadministrationdepartmentsofthepeople’sgovernmentoftheprovinces,orautonomousregionsordirectlyadministeredmunicipalitiesshall,inaccordancewiththeseRegulations,beresponsiblefortheadministrationofqualificationsofforeign–investedconstructionenterpriseswithintheiradministrativeregions.Chapter2ApplicationforandExaminationandApprovalofEstablishmentofForeign–investedConstructionEnterprisesandtheirQualificationsArticle6Theapplicationforandtheexaminationandapprovaloftheestablishmentofforeign-investedconstructionenterprisesandtheirqualificationsshallbemanagedbyagradingandcategorizationsystem.WhereanapplicantistoapplytoestablishacontractorwithSuperGradeorGradeAqualificationsortoestablishaspecialisedcontractorwithGradeAqualifications,theestablishmentoftheforeign-investedconstructionenterpriseshallbeexaminedandapprovedbytheforeigntradeandeconomiccooperationadministrationdepartmentoftheStateCouncilanditsqualificationsshallbeexaminedandapprovedbytheconstructionadministrationdepartmentoftheStateCouncil;whereanapplicantistoapplytoestablishacontractororaspecialisedcontractorwithGradeBorlowerqualificationsoranyofthesubcontractorqualifications,theestablishmentoftheforeign–investedconstructionenterpriseshallbeexaminedandapprovedbytheforeigntradeandeconomiccooperationadministrationdepartmentofthepeople’sgovernmentoftheprovince,theautonomousregionorthedirectlyadministeredmunicipalityanditsqualificationsshallbeexaminedandapprovedbytheconstructionadministrationdepartmentofthepeople’sgovernmentoftheprovince,theautonomousregio
