AnIntroductiontoHealthandSafetyatWorkIncludesHealthandSafetyatWorketcAct1974andmanyRegulationsWhodoesitapplyto?Employersmustsafeguard,sofarasisreasonablypracticable,thehealth,safetyandwelfareoftheiremployeesandotherswhomaybeaffectedbytheworkactivity.Appliestoallpeopleatworkincludingtheselfemployed,todesigners,manufacturersandsuppliersDutiesofemployers(Whatmusttheydoforme)Mostdutiesaresubjectto“sofarasisreasonablypracticable”i.e.theprotectionmustbeworththecostToprotectthehealth,safetyandwelfareofstaffToprovideandmaintainsafeequipmentandsafesystemsofworkSafeuse,handling,storageandtransportofarticlesandsubstancesProvideasafeworkplacewithasafeentranceandexitDutiesofemployerscont….Provideinformation,instruction,trainingandsupervisionProvideawrittensafetypolicy(ifthereare5ormorestaff)Carryoutriskassessments(inwritingif5ormorestaff)provideahealthandsafetylawposterentitled“HealthandSafetylaw:Whatyoushouldknow”displayedinaprominentpositionandcontainingdetailsoftheenforcingauthority.Dutiesofemployees(yourresponsibilities)N.b.“employee”includesvoluntaryworkersandpersonsonworkexperienceDuties:•Totakecareofthemselvesandothers•Tofollowsafetyadviceandinstructions•Notinterferewithanysafetydevice•Toreportaccidents•ToreporthazardsandrisksWhocanIaskabouthealthandsafety?YoursupervisorwillusuallybeyourfirstcontactifyouhaveahealthandsafetyissueYoursafetyrepresentative–maycomefromtheunioniftheworkplaceisunionisedIfyouhaveaseriouscomplaintthatcannotbesettledintheworkplace,yourInspector(seenextslide)EnforcementInspectorsfromtheHealthandSafetyExecutive(HSE)•Manufacturers;schoolsandcolleges;repairers;specialistplaceslikehospitalsandpowerstationsEnvironmentalHealthOfficers•Placeswherethepublicgolikeshops,offices,leisurefacilitiesFireOfficers–justenforcethebitsrelatingtofiresafetyPenaltiesMagistrate’scourt•£20,000peroffence•Upto6monthsinprisonEmployers,managersoremployeescanbeprosecutedCrowncourt(formoreseriousoffencesandwherethereisaJudgeandjury)•Unlimitedfines•Imprisonmentforupto2yearsAccidentsatworkAllaccidents,howeverminor,shouldbereportedtoyoursupervisorSimilarly,allincidentsofill-health(causedfromwork)shouldalsobereportedAccidentsincludethosethatresultedininjuryordamageand“nearmisses”–thosewhichCOULDhaveresultedininjuryordamageYoursupervisorwilldecideiftheincidentsneedstoberecordedintheaccidentrecordsViolentincidentsareincluded(thisincludesverbalthreats)ReportingofIncidents,DiseasesandsDangerousOccurrencesSomeaccidents,incidentsandillnesseshavetobereportedtothegovernmentTheseincludeaccidentsthatcauseanemployeetobeoffsickforthreedaysormore,if(followingaworkaccident)heisadmittedtohospitalfor24hoursormore;seriousinjuries;certainworkrelatedillnesses(suchasrepetitivestraininjuries;)accidentstonon-employeesiftheyaretakentohospitalfromthesceneoftheaccident(eveniftheyaredischargedstraightaway.Ifyouareunfortunateenoughtosufferareportableaccident,aspecialformwillbefilledinandtheremaybeaformalinvestigationSummaryEmployers•mustprotectyouwhilstatworkandprovidesuitablesupervisionandtraining•ProvidewrittenriskassessmentsandsafetypolicyEmployees(i.e.you)mustworksafelywithoutriskingyourselforothersThelawappliestoeveryoneatworkandanyonecanbeprosecutediftheydonotactsafelyYourmanageroryoursafetyrepresentativearetheretoansweryoursafetyqueriesYoumustreportaccidentsPreventionofFallsEmployersmustensurethatanyworkingareasabovethegroundorbelow(e.g.inspectionpits)areguardedorprotectedIfyouhavetoworkabovegroundlevelyoumustbekeptsafee.g.bywearingasafetyharnessifitisanareasuchasaflatroofwhichisnotguardedStepladdersshouldonlybeusedforjobsthatdonottakelongandtheymustbesafeandstablewheninusePreventingfallsDO•Usekickstoolssafely–theymustbeonaneven,levelsurface•Followtrainingwhenusingastepladder•CarryoutavisualcheckonanystepsbeforeuseDonot–•Standontheverytopofastepladder•Standonchairsortables•Climbonrackingorshelving•StandontheforksofaforklifttruckWelfareatWorkFacilitiesEmployersmustprovide:-•Toilets(canbesharedbymenandwomeninsmallworkplaces)•Sanitarydisposalfacilitiesforwomen•Washbasinsforhandsnearthetoiletwithhotandcold(orwarm)water,soapanddryingfacilities•Colddrinkingwater(preferablynotinthetoiletarea)•Seating(ifthejobcanbedonesittingdown)•Somewherecleantoeatlunch(ifitisa“dirty”job•FacilitiesfordisabledpeopleandpregnantwomenEnvironmentTheremustbesufficientspacetoworksafelyandenoughlightingandventilationWorkplacesmustbekeptgenerallycleanandtidyChairsmustbesafeandcomfortableTemperature–mustbe“reasonable”•Reasonablemeansatleast16oCforofficeworkand13oCwherethereisphysicalwork•Inveryhotweather,employersonlyneedtoprovidelocalcoolinge.g.fansSummaryAtworkyouareentitledto:-Asafeworkplace–thisincludesareasaboveorbelowthegroundlevelToiletsDrinkingwaterAplacetoeatlunchSafeseatingFirstAidEmployershavetoprovidefirstaidfacilitiesatworkAsaminimum,thereshouldbeafullystockedgreenfirstaidboxandapersonappointedtotakechargeinanemergencySomeworkplaceshavequalifiedfirstaidersandfirstaidroomsGreenandwhitenoticesshouldinformyouwher
