广西师范大学硕士学位论文我国传统中医药的知识产权保护研究姓名：唐新华申请学位级别：硕士专业：法学理论指导教师：陈宗波20080401I2005IIIIIResearchonIntellectualPropertyProtectionofChina'sTraditionalChineseMedicineAuthor:TangXin-huaSupervisor:ChenZong-boMajor:JurisprudenceResearchArea:CivilandCommercialLawGrade:2005AbstractAtpresent,intellectualpropertyprotectionoftraditionalknowledgeisthehotissuewhichacademicsconcernsabout,theChinesemedicineknowledgeisanimportantcomposingpartofthetraditionalknowledgeinourcountry,therefore,italsocausesgreatconcernofscholarsofintellectualpropertyfieldinChina.Atpresent,intellectualpropertyacademicshasmadesomeachievementinthestudyoftraditionalknowledge,butgenerallyspeaking,thestudyofintellectualpropertyprotectionofTraditionalChinesemedicineisfairlyinsufficient,andthestudyachievementalsocannotmeettheneedsofsocialdevelopment.Now,theintellectualpropertysystemstillhasmanyshortcomingsintheprotectionofTraditionalChinesemedicineinourcourtry,coupledwiththeinadequateunderstandingoftheimportanceofintellectualpropertyprotectionofTraditionalChinesemedicine,whichcausesintellectualpropertyoftraditionalChinesetoloseinagreatquantity,thepreciouswealthofthousandsofyearsisfacingatremendousimpact.Therefore,furtherexploringandstudyingseriouslytotheintellectualpropertysystemandconstructingtheprotectionsystemofintellectualpropertyofTraditionalChinesemedicine,hasgreatsignificanceinTheoryandPractice.ThisthesisdiscriminatestheconceptofTraditionalChinesemedicineandotherrelatedconceptsbydrawingontheresearchachievementswhichthepredecessorshavedone,discussesthebasictheoriesofintellectualpropertyprotectionofChina'sTraditionalChinesemedicine.OnthebasisoftheanalysisofthestatusoftheprotectionoftheTraditionalChinesemedicine,problemsandtheirreasonsintheexistingframeworkoftheintellectualpropertysystem,focusesonresearchingtheprotectionsystemfortheTraditionalChinesemedicineinintellectualpropertyontheaspectsofprotectionofpatentright,trademarkright,tradesecretandcopyright.Thisthesisiscomposedoffourparts.ThefirstpartanalyzestheconceptofTraditionalChinesemedicineandotherrelativeconcepts,clarifiestherelationshipbetweentheconcepts,liketraditionalknowledge,traditionalIVmedicineandTraditionalChinesemedicine,makesclearonthesubjectofstudyisanessentialprerequisiteinthisthesis.Traditionalknowledgeisintellectualachievementsbasedoninventionandcreationoftradition,iscrystallizationofthewisdomofmankind.BasedonthetheoryofTraditionalChinesemedicine,TraditionalChinesemedicineisforminganddevelopingChineseTraditionalmedicineinthemedicalpractice,isanimportantpartoftraditionalknowledge.TraditionalChinesemedicineisthecenteralconceptinthisthesis.First,usingtraditionalistodistinguishbetweenmodernWesternmedicine,andemprisethetraditionalandauthentic;Secondly,bothinTraditionalChinesemedicinetheoryorfromourcurrentformofdevelopmentofpracticeofTraditionalChinesemedicine,themedicineandpharmaceuticalsisnotcompletelyseparated.Inmodernsociety,thetraditionalknowledgeincludingTraditionalChinesemedicineplaysanincreasinglyimportantrole,itshouldbewellprotected.However,thefactisnotlikethat.CharacteristicsofTraditionalChinesemedicinesuchastradition,historicity,Group’sglobalityandregionalismisthebiggestobstacle,whichmakestheintellectualpropertyprotectiontobedifficulttoaccommodateTraditionalChinesemedicineenough.So,descriptionofCharacteristicsofTraditionalChinesemedicineemprisesondifferencesofTraditionalChinesemedicineandcharacteristicsoftheobjectofexistingintellectualproperty,andtopavethewayonconstructingthetheoryofintellectualpropertyprotectionofTraditionalChinesemedicine,amendingandimprovingtheexistingintellectualpropertysystem.ThesecondpartisofthetheoreticalbasisofdiscussionofintellectualpropertyprotectionofChina'sTraditionalChinesemedicine.Tomastertheconcept,scopeandcharacteristicsofintellectualpropertyishelpfulforunderstandingthenatureandeffectofintellectualpropertysystem.Toacertainextent,intellectualpropertysystemcanprotectTraditionalChinesemedicineindirectly,butTraditionalChinesemedicinecannotbeprotectedbytheintellectualpropertysystemdirectlyandstronglybecauseTraditionalChinesemedicinedoesn'tconformtheelementsrequiredinintellectualpropertysystemcompletely.Atthesametime,intellectualpropertyprotectionofTraditionalChinesemedicineisnecessaryforpursuingfairness,preventingTraditionalChinesemedicineresourcesfromlosing,promotingtheusageofTraditionalChinesemedicine,constructingthenationalculturalsecuritystrategyandmakingTraditionalChinesemedicinemovearoundtheworld.Therefore,intellectualpropertyprotectionofTraditionalChinesemedicineisimperative.ItispossibletoprotectTraditionalChinesemedicineinabroaderscopebydeterminingthescopeofintellectualpropertyprotectionofTraditionalChinesemedicine.ThethirdpartistostudythestatusquooftheprotectionoftheTraditionalChinesemedicine,problemsandtheirreasons.WiththedevelopmentofsocietyandtheconsciousnessofintellectualpropertyprotectionofTraditionalChinesemedicineisstrengthened,toanextent,thelegislativesituationofintellectualpropertyprotectionofTraditionalChinesemedicinehasbeenVimproved,thesyste
