UrbanandRuralPlanningLawofthePeople’sRepublicofChina中华人民共和国城乡规划法OrderofthePresidentofthePeople’sRepublicofChina(No.74)TheUrbanandRuralPlanningLawofthePeople’sRepublicofChina,whichwasadoptedatthe30thmeetingoftheStandingCommitteeoftheTenthNationalPeople’sCongressofthePeople’sRepublicofChinaonOctober28th,2007,isherebypromulgatedandshallcomeintoforceasofJanuary1st,2008.PresidentofthePeople’sRepublicofChina:HuJintaoOctober28th,2007UrbanandRuralPlanningLawofthePeople’sRepublicofChina(Adoptedatthe30thmeetingoftheStandingCommitteeoftheTenthNationalPeople’sCongressofthePeople’sRepublicofChinaonOctober28th,2007)1ContentsChapterIGeneralProvisionsChapterIIEstablishmentofUrbanandRuralPlanningChapterIIIImplementationofUrbanandRuralPlanningChapterIVModificationofUrbanandRuralPlanningChapterVSupervisionandInspectionChapterVILegalLiabilityChapterVIISupplementaryProvisions2ChapterIGeneralProvisionsArticle1ThisLawisformulatedforthepurposeofstrengtheningurbanandruralplanningadministration,harmonizingurbanandruralspatiallayout,improvingpeople’slivingenvironmentandpromotingtheintegrated,harmoniousandsustainabledevelopmentofurbanandruralsocietyandeconomy.Article2MakingandimplementingurbanandruralplanningaswellasconductingconstructionactivitiesinplanningareasshallbegovernedbythisLaw.Theterm“urbanandruralplanning”asmentionedinthisLawincludesurbansystemplanning,cityplanning,townplanning,townshipplanningandvillageplanning.Cityortownplanningincludesoverallplanninganddetailedplanning.Detailedplanningincludesregulatorydetailedplanningandsitedetailedplanning.Theterm“planningarea”asmentionedinthisLawreferstothebuilt-upareasofcities,townsandvillagesaswellasareasthatmustbeunderplanningcontrolforurbanandruralconstructionanddevelopment.Thespecificscopeofaplanningareashallbedefinedbytherelatedpeople’sgovernment,inlightoftheurbanandruraleconomicandsocialdevelopmentlevelandtheneedsfortheoveralldevelopmentofurbanandruralareas,inorganizingtheestablishmentoftheoverallplanningofacityortown,atownshipplanningoravillageplanning.Article3CitiesandtownsshallworkoutcityplanningandtownplanninginaccordancewiththisLaw.Constructionactivitieswithinacityortownplanningareashallbeconductedinaccordancewiththeplanningrequirements.Thelocalpeople’sgovernmentatorabovethecountylevelshall,inlightofthelocalruraleconomicandsocialdevelopmentlevelandin3accordancewiththeprinciplesofadjustingmeasurestolocalconditionsandfeasibility,determineregionsrequiredtoestablishtownshiporvillageplanning.ThetownshipsandvillagesinsidetheregionsshallworkouttheirrespectiveplanninginaccordancewiththisLaw.Thetownshipandvillageconstructionwithintheplanningareasshallbeinlinewiththeplanningrequirements.Thelocalpeople’sgovernmentatorabovethecountylevelshallencourageandguidethetownshipsandvillagesoutsidetheregionstoworkoutandimplementtownshipandvillageplanning.Article4Urbanandruralplanningshallbeworkedoutandimplementedbyfollowingtheprinciplesofplanningtheurbanandruralareasasawhole,reasonablelayout,savingtheland,intensivegrowthandplanningbeforeconstructingsoastoimproveecologicalenvironment,enhancetheconservationandcomprehensiveutilizationofresourcesandenergy,protectfarmlandandothernaturalresourceaswellasculturalheritages,maintainlocalfeatures,ethnicfeaturesandtraditions,preventpollutionandotherpublicnuisance,andsatisfytheneedsofregionalpopulationdevelopment,nationaldefenseconstruction,disasterpreventionandalleviation,publichealthandpublicsafety.Constructionactivitiesintheplanningareashallbeconductedbyobservinglawsandregulationsgoverninglandmanagement,naturalresourcesandenvironmentalprotection,etc.Thelocalpeople’sgovernmentatorabovethecountylevelshall,inlightofthelocalsocialandeconomicdevelopmentlevel,reasonablydeterminethedevelopmentscale,stepsandconstructionstandardsofacityortownintheoverallplanningofthecityortown.Article5Theestablishmentoftheoverallplanningofacityortown,atownshipplanningoravillageplanningshallbebasedonthenational4economicandsocialdevelopmentplanningaswellastheoverallplanningonlanduse.Article6Thepeople’sgovernmentsatvariouslevelsshallbringtheexpensesnecessaryfortheestablishmentandadministrationofurbanandruralplanningintothefiscalbudgetatthecorrespondinglevel.Article7Anurbanandruralplanningwhichhasbeenapprovedaccordingtolawshallbeabasisforurbanandruralconstructionaswellasplanningadministration,andmaynotbealteredwithoutgoingthroughthelegalprocedure.Article8Organsorganizingtheestablishmentofurbanandruralplanningshallpublicizelegallyapprovedurbanandruralplanninginatimelymanner,exceptforcontentswhichshallnotbedisclosedasrequiredbylawsoradministrativeregulations.Article9Allentitiesandindividualsshallabidebyurbanandruralplanningwhichhavebeenlegallyapprovedanddisclosed,besubmittotheadministrationofsuchplanning,andhavetherighttoinquiryofthecompetentdepartmentofurbanandruralplanningaboutwhetheraconstructionactivityaffectingtheirinterestsisincompliancewiththeplanningrequirements.Anyentityorindividualshallhavetherighttoreportoraccuseofanyactinviolationofanyurbanandruralplanningtothecompetentdepa
