DIRECTIVE2013/56/EUOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof20November2013amendingDirective2006/66/ECoftheEuropeanParliamentandoftheCouncilonbatteriesandaccumulatorsandwastebatteriesandaccumulatorsasregardstheplacingonthemarketofportablebatteriesandaccumulatorscontainingcadmiumintendedforuseincordlesspowertools,andofbuttoncellswithlowmercurycontent,andrepealingCommissionDecision2009/603/EC(TextwithEEArelevance)THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,andinparticularArticle192(1)thereof,HavingregardtotheproposalfromtheEuropeanCommission,Aftertransmissionofthedraftlegislativeacttothenationalparliaments,HavingregardtotheopinionoftheEuropeanEconomicandSocialCommittee(1),AfterconsultingtheCommitteeoftheRegions,Actinginaccordancewiththeordinarylegislativeprocedure(2),Whereas:(1)Directive2006/66/ECoftheEuropeanParliamentandoftheCouncil(3)prohibitstheplacingonthemarketofportablebatteriesandaccumulators,includingthoseincorporatedintoappliances,thatcontainmorethan0,002%ofcadmiumbyweight.However,portablebatteriesandaccumulatorsintendedforuseincordlesspowertoolsareexemptedfromthatban.(2)TheCommissionhasreviewedthatexemptioninaccordancewithArticle4(4)ofDirective2006/66/EC.(3)Thatreviewhasledtotheconclusionthat,inordertograduallydiminishtheamountofcadmiumreleasedintotheenvironment,theprohibitionoftheuseofcadmiumshouldbeextendedtoportablebatteriesandaccumulatorsintendedforuseincordlesspowertoolsbecausesuitablecadmium-freesubstitutesforsuchapplicationsareavailableonthemarket,namelynickel-metalhydrideandlithium-ionbatterytechnologies.(4)Theexistingexemptionforportablebatteriesandaccumulatorsintendedforuseincordlesspowertoolsshouldcontinuetoapplyuntil31December2016inordertoenabletherecyclingindustryandconsumersalongthewholevaluechaintofurtheradapttotherelevantsubstitutetechnologiesacrossalltheregionsoftheUnioninauniformmanner.(5)Directive2006/66/ECprohibitstheplacingonthemarketofallbatteriesoraccumulators,whetherornotincorporatedintoappliances,thatcontainmorethan0,0005%ofmercurybyweight.However,buttoncellswithamercurycontentofnomorethan2%byweightareexemptedfromthatprohibition.TheUnionbuttoncellmarketisalreadyexperiencingashifttowardsmercury-freebuttoncells.Itisthereforeappropriatetoprohibitthemarketingofbuttoncellswithamercurycontentexceeding0,0005%byweight.(6)AsaconsequenceoftheentryintoforceoftheLisbonTreaty,thepowersconferredontheCommissionunderDirective2006/66/ECneedtobealignedwithArticles290and291oftheTreatyontheFunctioningoftheEuropeanUnion(TFEU).(7)InordertosupplementoramendDirective2006/66/EC,thepowertoadoptactsinaccordancewithArticle290TFEUshouldbedelegatedtotheCommissioninrespectofcriteriafortheassessmentofequivalentconditionsregardingtreatmentandrecyclingoutsidetheUnion,capacitylabellingofportableandautomotivebatteriesandaccumulatorsandexemptionsfromthelabellingrequirements.ItisofparticularimportancethattheCommissioncarryoutappropriateconsultationsduringitspreparatorywork,includingatexpertlevel.TheCommission,whenpreparinganddrawing-updelegatedacts,shouldensureasimultaneous,timelyandappropriatetransmissionofrelevantdocumentstotheEuropeanParliamentandtheCouncil.EN10.12.2013OfficialJournaloftheEuropeanUnionL329/5(1)OJC229,31.7.2012,p.140.(2)PositionoftheEuropeanParliamentof10October2013(notyetpublishedintheOfficialJournal)anddecisionoftheCouncilof15November2013.(3)Directive2006/66/ECoftheEuropeanParliamentandoftheCouncilof6September2006onbatteriesandaccumulatorsandwastebatteriesandaccumulatorsandrepealingDirective91/157/EEC(OJL266,26.9.2006,p.1).(8)Whereverappropriate,theproducerregistrationrequirementsandformatshouldbecoherentwithregardtotheregistrationrulesandformatestablishedpursuanttoArticle16(3)of,andPartAofAnnexXtoDirective2012/19/EUoftheEuropeanParliamentandoftheCouncil(1).(9)InordertoensureuniformconditionsfortheimplementationofDirective2006/66/EC,implementingpowersshouldbeconferredontheCommissioninrespectoftransitionalarrangementsregardingminimumcollectionrates,acommonmethodologyforthecalculationofannualsalesofportablebatteriesandaccumulatorstoend-users,detailedrulesregardingthecalculationofrecyclingefficiencies,andaquestionnaireoroutlinefornationalimplementationreports.ThosepowersshouldbeexercisedinaccordancewithRegulation(EU)No182/2011oftheEuropeanParliamentandoftheCouncil(2).(10)Directive2006/12/ECoftheEuropeanParliamentandoftheCouncil(3)wasrepealedbyDirective2008/98/ECoftheEuropeanParliamentandoftheCouncil(4)witheffectfrom12December2010.(11)Directive2006/66/ECshouldthereforebeamendedaccordingly,HAVEADOPTEDTHISDIRECTIVE:Article1Directive2006/66/ECisamendedasfollows:(1)Article4isamendedasfollows:(a)paragraph2isreplacedbythefollowing:‘2.Theprohibitionsetoutinparagraph1(a)shallnotapplytobuttoncellswithamercurycontentofnomorethan2%byweightuntil1October2015.’;(b)point(c)ofparagraph3isreplacedbythefollowing:‘(c)cordlesspowertools;thisexemptioninrespectofcordlesspowertoolsshallapplyuntil31December2016.’;(c)paragraph4isreplacedbythefollowing
