RealRightLawofthePeople'sRepublicofChina(Adoptedatthe5thsessionoftheTenthNationalPeople'sCongressonMarch16,2007)PartIGeneralRulesChapterIBasicPrinciplesArticle1InaccordancewiththeConstitutionLaw,thepresentLawisenactedwithaviewtomaintainingthebasiceconomicsystemofthestate,protectingthesocialistmarketeconomicorder,clearlydefiningtheattributionoftheres,bringingintoplaytheutilitiesoftheresandsafeguardingtherealrightoftherightholder.Article2ThecivilrelationshipsincurredfromtheattributionandutilizationoftheresshallbegovernedbythepresentLaw.ThetermresasmentionedinthepresentLawmeansrealtiesandchattels.Whereitisprescribedinanyprovisionthatcertainrightshallbetakenasanobjectofrealright,suchprovisionshallbeapplicable.ThetermrealrightasmentionedinthepresentLawmeanstheexclusiverightofdirectcontroloveraspecificresenjoyedbytheholderinaccordancewithlaw,includingownership,usufractuaryrightandrealrightsforsecurity.Article3Intheprimaryphaseofsocialism,thestateadherestothebasiceconomicsystemwiththepublicownershipplayingadominantroleanddiverseformsofownershipdevelopingsidebyside.Thepubliceconomyshallbeconsolidatedanddevelopedbythestate,andthedevelopmentofthenonpubliceconomyshallbeencouraged,supportedandguided.Thesocialistmarketeconomysystemshallbepracticedbythestateaswellastheequallegalstatusanddevelopmentrightsofallmarketsubjectsshallbeprotected.Article4Therealrightofthestate,collective,individualoranyotherrightholdershallbeprotectedbylaw,andmaynotbedamagedbyanyentityorindividual.Article5Thevarietiesandcontentsofrealrightsshallbeprescribedbylaw.Article6Thecreation,alteration,alienationorterminationoftherealrightofarealtyshallbesubjecttoregistrationinaccordancewithlaw.Thecreationoralienationoftherealrightofachattelshallbedeliveredinaccordancewithlaw.Article7Oneshall,whenacquiringorexercisingarealright,complywiththelaw,respectsocialmoralsandmaynotinfringeuponthepublicinterestsorthelawfulrightsandinterestsofanyotherperson.Article8Incasethereexistsanyotherspecialprovisioninrespectofrealrightinanyotherlaw,suchspecialprovisionshallprevail.ChapterIICreation,Alteration,AlienationandTerminationofRealRightSection1RealityRegistrationArticle9Untilitisregisteredinaccordancewithlaw,thecreation,alteration,alienationorterminationoftherealrightofarealtyshallcomeintoeffect;unlessitisotherwiseprescribedbyanylaw,itshallhavenoeffectifitisnotregisteredinaccordancewithlaw.Asregardstheownershipofthenaturalresourcesownedbythestateinaccordancewithlaw,theregistrationisnotrequired.Article10Theregistrationofarealtyshallbehandledbytheregistrationorganatthelocalityoftherealty.Auniformregistrationsystemoverrealtiesshallbepracticedbythestate.Thescope,organandmeasuresofuniformregistrationshallbespecifiedbytherelatedlawsandadministrativeregulations.Article11Inlightofthedifferentregistrationitems,anapplicantshall,whenapplyingfortheregistrationofarealty,providetheownershipcertificateoftherealtyandsuchnecessarymaterialsasthelocationandareaoftherealty.Article12Aregistrationorganshallperformthedutiesasfollows:(1)toexaminetheownershipcertificateandothernecessarymaterialsasprovidedbytheapplicant;(2)toinquiretheapplicantabouttheregistrationitemsconcerned;(3)toregistertherelateditemsinaccordancewiththefactsandinatimelymanner;and(4)otherdutiesasprovidedforinanylaworadministrativeregulation.Incasetherelatedsituationoftherealtyunderapplicationforregistrationneedsfurtherproving,theregistrationorganmayrequesttheapplicanttoprovidesupplementarymaterialsandconducton-the-spotinspectionwherenecessary.Article13Noregistrationorganmaycommitanyofthebehaviorsasfollows:(1)toaskforanevaluationofarealty;(2)torepeatedlyregisterregistrationinthenameofannualinspection;or(3)otherbehaviorsconductedbeyonditsscopeofregistrationduties.Article14Asregardsthecreation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectsincethedatewhenitisrecordedintherealtyregisterincasetheregistrationthereofisrequiredbylaw.Article15Asregardsacontractenteredintobytherelatedpartiesconcernedonthecreation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectupontheconclusionofthecontract,unlessitisotherwiseprescribedbyanylaw;andthevalidityofthecontractisnotaffected,whethertherealrighthasbeenregisteredornot.Article16Therealtyregistershallbethebasisfordecidingtheownershipandcontentsofarealtyandshallbeunderthemanagementoftheregistrationorgan.Article17Therealtyownershipcertificateshallbetheevidencefortheholder'sownershipofarealty.Theitemsrecordedintherealtyownershipcertificateshallaccordwiththoserecordedintherealtyregister;unlessitisprovedthatthereisanythingwrongintherealtyregister,theonerecordedthereinshallprevailinthecaseofanyinconsistence.Article18Anyrightholderorinterestedpartymayfileanapplicationforconsultingorcopyingtheregistrationmaterials,andtheregistrationorganmaynotreject.Article19Incaseanyrightholderorinterestedpartyholdsthatthereisanythingwronginanyitemrecordedintherealtyregister,it/hemayapplyforacorrectionoftheregistration.Theregistrationorganshallrevisetheregis
