劳动法LabourLawofthePeople'sRepublicofChina(AdoptedattheEighthMeetingoftheStandingCommitteeoftheEighthNationalPeople'sCongressonJuly5,1994andpromulgatedbyOrderNo.28ofthePresidentofthePeople'sRepublicofChinaonJuly5,1994)ContentsChapterIGeneralProvisionsChapterIIPromotionofEmploymentChapterIIILabourContractsandCollectiveContractsChapterIVWorkingHours,RestandVacationsChapterVWagesChapterVIOccupationalSafetyandHealthChapterVIISpecialProtectionforFemaleStaffandWorkersandJuvenileWorkersChapterVIIIVocationalTrainingChapterIXSocialInsuranceandWelfareChapterXLabourDisputesChapterXISupervisionandInspectionChapterXIILegalResponsibilityChapterXIIISupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisformulatedinaccordancewiththeConstitutioninordertoprotectthelegitimaterightsandinterestsoflabourers,regulatelabourrelationship,establishandsafeguardalaboursystemsuitedtothesocialistmarketeconomy,andpromoteeconomicdevelopmentandsocialprogress.Article2ThisLawshallapplytoenterprises,individualeconomicorganizations(hereinafterreferredtoasemployingunits)andlabourerswhoformalabourrelationshiptherewithwithintheterritoryofthePeople'sRepublicofChina.Stateorgans,institutionsandpublicorganizationsaswellaslabourerswhoformalabourcontractrelationshiptherewithshallbeboundbythisLaw.Article3Labourersshallhaveequalrighttoemploymentandchoiceofoccupation,therighttoremunerationforlabour,torestandvacations,toprotectionofoccupationalsafetyandhealth,totraininginvocationalskills,tosocialinsuranceandwelfare,tosubmissionoflabourdisputesforsettlementandotherrightsrelatingtolabourstipulatedbylaw.Labourersshallfulfilltheirlabourtasks,improvetheirvocationalskills,followrulesonoccupationalsafetyandhealth,andobservelabourdisciplineandprofessionalethics.Article4Theemployingunitsshallestablishandperfectrulesandregulationsinaccordancewiththelawsoastoensurethatlabourersenjoytherighttoworkandfulfilllabourobligations.Article5TheStateshalltakevariousmeasurestopromoteemployment,developvocationaleducation,laydownlabourstandards,regulatesocialincomes,perfectsocialinsurancesystem,coordinatelabourrelationship,andgraduallyraisethelivingstandardoflabourers.Article6TheStateshalladvocatetheparticipationoflabourersinsocialvoluntarylabourandtheunfoldingoflabouremulationandrationalproposalscampaign,encourageandprotectlabourersinconductingscientificresearch,technicalrenovation,inventionsandcreations,andcommendandrewardmodelandadvancedworkers.Article7Labourersshallhavetherighttoparticipatein,andorganize,tradeunionsinaccordancewiththelaw.Tradeunionsshallrepresentandsafeguardthelegitimaterightsandinterestsoflabourers,andindependentlycarryouttheiractivitiesinaccordancewiththelaw.Article8Labourersshalltakepartindemocraticmanagementornegotiatewiththeemployingunitsonanequalfootingaboutprotectionofthelegitimaterightsandinterestsoflabourersthroughtheassemblyofstaffandworkersortheircongressorotherformsasprovidedbylaw.Article9TheadministrativedepartmentoflabourundertheStateCouncilshallbeinchargeofthemanagementoflabourinthewholecountry.Theadministrativedepartmentsoflabourunderthelocalpeople'sgovernmentsatorabovethecountylevelshallbeinchargeofthemanagementoflabourintheirrespectiveadministrativeareas.ChapterIIPromotionofEmploymentArticle10TheStateshallcreateconditionsforemploymentandincreaseopportunitiesthereforebymeansofpromotionofeconomicandsocialdevelopment.TheStateshallencourageenterprises,institutionsandpublicorganizationstoinitiateindustriesorexpandbusinessesfortheincreaseofemployment,withinthescopeprovidedbylaws,andadministrativerulesandregulations.TheStateshallsupportlabourerstoachieveemploymentbyorganizingthemselvesonavoluntarybasisorbyengaginginindividualbusinesses.Article11Localpeople'sgovernmentsatvariouslevelsshalltakemeasures,bydevelopingemploymentagenciesofvariousforms,toprovideemploymentservices.Article12Labourers,regardlessoftheirethnicgroup,race,sex,orreligiousbelief,shallnotbediscriminatedagainstinemployment.Article13Womenshallenjoytheequalright,withmen,toemployment.WithexceptionofthespecialtypesofworkorpostunsuitabletowomenasprescribedbytheState,nounitmay,inemployingstaffandworkers,refusetoemploywomenbyreasonofsexorraisetheemploymentstandardsforwomen.Article14Inrespectoftheemploymentofthedisabled,peopleofminorityethnicgroups,anddemobilizedarmymen,wheretherearespecialstipulationsinlaws,rulesandregulations,suchstipulationsshallapply.Article15Noemployingunitsareallowedtorecruitminorsundertheageof16.Institutionsofliteratureandart,physicalculture,andspecialartsandcraftsthatrecruitminorsundertheageof16mustgothroughtheformalitiesofexaminationandapprovalinaccordancewiththerelevantprovisionsoftheStateandguaranteetheirrighttocompulsoryeducation.ChapterIIILabourContractsandCollectiveContractsArticle16Alabourcontractisanagreementthatestablishesthelabourrelationshipbetweenalaborerandanemployingunitanddefinestherightsandobligationsofrespectiveparties.Alabourcontractshallbeconcludedwherealabourrelationshipistobeestablished.Article17Conclusionandmodificationofalabourcontractsha
