1编号：兼职外教雇佣协议PARTTIMETEACHEREMPLOYMENTAGREEMENT甲方（雇用方）：湖南中健外教信息技术有限公司PartyA(EmployingParty):ZhongjianEducationForeignServices地址：湖南省长沙市开福区新一佳超市六楼A11房Address:NoA11,Sixfloor,“ABest”supermarket,Huaxiarood,Kaifudistrict,Changsha,Hunanprovince,China.法定代表人：李健荣/阿米尔LegalRepresentative：Lijianrong/AmeerSherbaz乙方：（受雇方）：PartyB(EmployedParty)：I.乙方自愿作为甲方兼职外教在甲方从事教学服务工作。双方在友好合作的基础姓名：性别：国籍：Name:Gender:Nationality:出生日期：护照号码：BirthDate:PassportNo.:地址：Address:电子邮件Email:手机号码Cellphone:2上签订本合同，并保证遵守合同中所规定的各项条款。PartyBiswillingtoprovidesevicesforPartyAasaforeignteacher.Thetwopartiessignthecontractinthebasisoffriendlycooperationandfulfiltheclauses.甲方在甲方服务期限为至。Theperiodofservicewillbefromto.III.乙方的报酬1.乙方在甲方工作期间的课时费按照：元/次计算，工作时间9:00至11:30，下午02:30至05:30；每周______次授课，以人民币形式支付。如乙方每月授课时间多于110小时，超出的授课时间，可按照120元每课时计算课时费。如乙方在工作期间迟到早退旷课等，迟到早退一小时罚款50元，迟到两小时罚款一百，依此类推。若未经批准请假罚款100一次。1.PartyB'steaching-hoursalarywillbeRMB/timebycash.Teachingtimewillbefrom09:00-11:30amand02:30-05:30pm,__time(times)aweek.Iftheteachinghoursaremorethan110hoursperwork-month,PartyBwillget120RMBforteachingcompensationperextrateachinghour.2.乙方的报酬支付时间为次月25日。2.Thesalarywillbepaidon25thpermonth(thenextregularworkingmonth)IV.甲方义务PartyA'sObligations1.甲方对乙方的工作负责指导、监督以及评价。PartyAshallconductdirection,superviseandevaluatethePartyB'swork.1.甲方应向乙方提供必要的工作设施。PartyAshallprovidePartyBnecessaryworkingfacilities.2.甲方应向乙方每月25日按期发放报酬。PartyAshallpayPartyB'ssalaryregularlyby25th.(thenextregularworkingmonth)V.乙方义务PartyB'sobligations1.乙方必需遵守甲方的工作制度及与外国专家管理相关的规定，并接受甲方在工作方面的安排、指导、监督和评价。同时，乙方应提供包括能证明其身份的护照、学籍卡等。1.PartyBshallabidetoPartyA'sworksystemandregulationsconcerningadministrationofforeignexpertsandshallacceptPartyA'sarrangement,3guidance,supervisionandevaluation.Meanwhile,PartyBshallprovideidentification,includepassport,student’scardandthecopyofcurrentvisa.2.乙方必须按照指定学期的课时计划保质保量完成甲方委派的工作，同时，乙方应遵守被派遣单位的相关工作制2.PartyBshallcompletethetasksontimeandensureitisqualified.PartyBshallabidetotheworkingsystemofdispatchedschool.3.乙方同意并授予甲方处于市场和宣传活动使用乙方真实的个人信息和肖像。3.PartyAispermittedandauthorizedbyPartyBtousehis/hertruepersonalinformationformarketingandadvertisingactivities,includingtheusingofPartyB’spersonalphotographs.VI.合同的终止TerminationofContract1.在以下情形下，甲方将书面通知解除与乙方的合同：1.PartyAwillterminatethecontractwithwrittennoticeunderthosecircumstances:(1)如果乙方违反了中华人民共和国相关法律法规造成乙方无法继续履行本合同的，甲方有权单方解除与乙方的兼职聘用合同。(1)contractwillbeterminatedimmediatelyifPartyBviolatesthelawsandregulationsofChina,PartyA’sworksystemofemployer,andtheregulationofChinesegovernmentaboutForeignTeachersorothercontractterms.Inthissituation,nocompensation;(2)如果乙方不能胜任本合同中关于工作的要求，且在合理期限内仍不能改善的，甲方可单方解除与乙方之间的聘用合同。。(2)IfPartyBfailstomeettherequirementsofthecontractthecontractwillbeterminatedimmediately,AnothercircumstanceisPartyBwillbegiven15daystoimprovehis/herjobperformance.If,theforeignteacherhasnotimprovedhis/herjobperformanceafter15dayslaterandmakePartyAsatisfaction,thecontractwillthenbeterminatedandPartyBwillnotreceiveanyadditionalpay;2.如果乙方提出解除与甲方的合同，乙方必须于合同解除日前30天向甲方书面提出解除合同。在这种情况下，乙方将能够得到工作时间范畴内的课时报酬。否则，乙方将不能获得未发放的课时报酬。2.IfPartyBchoosestoterminatethecontract,he/shemustprovidethirtydayswrittennoticetoPartyA.Ifthisistobedone,PartyBwillreceivefullsalaryfortheperiodworked.Otherwise,salaryandsubsidiarywillnotbepaid.VII.违约金BreachPenalty任何一方不能按照合同中所规定内容执行，都将视为违约。违约方应承担10,000元人民币的违约金。Wheneitherofthetwopartiesfailstofulfillthecontractorfailstofulfillthe4contractobligationsaccordingtothetermsstipulated,thatistobetoconsideredtobreakthecontract,itmustpayabreachpenaltyof10,000RMB.VIII.延期本合同自签订之日起生效，到合同期满自然终止。合同到期后，经双方协商一致可以继续续签。Thiscontracttakeseffectonthedatesignedbybothpartiesandwillautomaticallyexpirewhenthecontractends.Ifeitherofthetwopartiesasksforanewcontract,itshouldprofounditsrequesttoanotherparty2weekspriortotheexpirationofthecontract,andsignthenewcontractwithmutualpermission.IX.仲裁Arbitration有关合同内容的含义，须双方及时互相沟通，及时处理其中可能存在的争议。如果经双方协商不能达成一致，可申请可向甲方所在地仲裁机构申请仲裁。对仲裁不服的，可以向人民法院提起诉讼。Thetwopartiesshallconsultwitheachotherandmediateanydisputeswhichmayariseaboutthecontract.Ifallattemptsfail,thetwopartiescanappealtothelocalArbitration.甲方：PartyA（签章Signature+Stamp）日期Date乙方：PartyB（签名Signature）日期Date
