华盛顿州柠檬法字体显示：大中小WashingtonLemonLawTitle19Chapter118MotorVehicleWarrantiesWashingtonLemonLawRCW19.118.005Legislativeintent.Thelegislaturerecognizesthatanewmotorvehicleisamajorconsumerpurchaseandthatadefectivemotorvehicleislikelytocreatehardshipfor,ormaycauseinjuryto,theconsumer.Thelegislaturefurtherrecognizesthatgoodcooperationandcommunicationbetweenamanufacturerandanewmotorvehicledealerwillconsiderablyincreasethelikelihoodthatanewmotorvehiclewillberepairedwithinareasonablenumberofattempts.Itistheintentofthelegislaturetoensurethattheconsumerismadeawareofhisorherrightsunderthischapterandisnotrefusedinformation,documents,orservicethatwouldotherwiseobstructtheexerciseofhisorherrights.Inenactingthesecomprehensivemeasures,itistheintentofthelegislaturetocreatetheproperblendofprivateandpublicremediesnecessarytoenforcethischapter,suchthatamanufacturerwillbesufficientlyinducedtotakenecessarystepstoimprovequalitycontrolatthetimeofproductionorprovidebetterwarrantyserviceforthenewmotorvehiclesthatitsellsinthisstate.WashingtonLemonLawRCW19.118.010Motorvehiclemanufacturers.Expresswarranties;Serviceandrepairfacilities.Everymanufacturerofmotorvehiclessoldinthisstateandforwhichthemanufacturerhasmadeanexpresswarrantyshallmaintaininthisstatesufficientserviceandrepairfacilitiesreasonablyclosetoallareasinwhichitsmotorvehiclesaresoldtocarryoutthetermsofthewarrantiesordesignateandauthorizeinthisstateasserviceandrepairfacilitiesindependentrepairorservicefacilitiesreasonablyclosetoallareasinwhichitsmotorvehiclesaresoldtocarryoutthetermsofthewarranties.Asameansofcomplyingwiththissection,amanufacturermayenterintowarrantyservicecontractswithindependentserviceandrepairfacilities.WashingtonLemonLawRCW19.118.021Definitions.Unlessthecontextclearlyrequiresotherwise,thedefinitionsinthissectionapplythroughoutthischapter.(1)Boardmeansnewmotorvehiclearbitrationboard.(2)Collateralchargesmeansanysalesorleaserelatedchargesincludingbutnotlimitedtosalestax,usetax,arbitrationservicefees,unusedlicensefees,unusedregistrationfees,unusedtitlefees,financecharges,prepaymentpenalties,creditdisabilityandcreditlifeinsurancecostsnototherwiserefundable,anyotherinsurancecostsproratedfortimeoutofservice,transportationcharges,dealerpreparationcharges,oranyotherchargesforservicecontracts,undercoating,rustproofing,orfactoryordealerinstalledoptions.(3)Conditionmeansageneralproblemthatresultsfromadefectormalfunctionofoneormoreparts,ortheirimproperinstallationbythemanufacturer,itsagents,orthenewmotorvehicledealer.(4)Consumermeansanypersonwhohasenteredintoanagreementorcontractforthetransfer,lease,orpurchaseofanewmotorvehicle,otherthanforpurposesofresaleorsublease,duringthedurationofthewarrantyperioddefinedunderthissection.(5)Courtmeansthesuperiorcourtinthecountywheretheconsumerresides,exceptiftheconsumerdoesnotresideinthisstate,thenthesuperiorcourtinthecountywhereanarbitrationhearingordeterminationwasconductedormadepursuanttothischapter.(6)Incidentalcostsmeansanyreasonableexpensesincurredbytheconsumerinconnectionwiththerepairofthenewmotorvehicle,includinganytowingchargesandthecostsofobtainingalternativetransportation.(7)ManufacturermeansanypersonengagedinthebusinessofconstructingorassemblingnewmotorvehiclesorengagedinthebusinessofimportingnewmotorvehiclesintotheUnitedStatesforthepurposeofsellingordistributingnewmotorvehiclestonewmotorvehicledealers.Manufacturerdoesnotincludeanypersonengagedinthebusinessofset-upofmotorcyclesasanagentofanewmotorvehicledealerifthepersondoesnototherwiseconstructorassemblemotorcycles.(8)MotorcyclemeansanymotorcycleasdefinedinRCW46.04.330whichhasanenginedisplacementofatleastsevenhundredfiftycubiccentimeters.(9)Motorhomemeansavehicularunitdesignedtoprovidetemporarylivingquartersforrecreational,camping,ortraveluse,builtonorpermanentlyattachedtoaself-propelledmotorvehiclechassisoronachassiscaborvanthatisanintegralpartofthecompletedvehicle.(10)Motorhomemanufacturermeansthefirststagemanufacturer,thecomponentmanufacturer,andthefinalstagemanufacturer.(a)Firststagemanufacturermeansapersonwhomanufacturesincompletenewmotorvehiclessuchaschassis,chassiscabs,orvans,thataredirectlywarrantedbythefirststagemanufacturertotheconsumer,andarecompletedbyafinalstagemanufacturerintoamotorhome.(b)Componentmanufacturermeansapersonwhomanufacturescomponentsusedinthemanufactureorassemblyofachassis,chassiscab,orvanthatiscompletedintoamotorhomeandwhosecomponentsaredirectlywarrantedbythecomponentmanufacturertotheconsumer.(c)Finalstagemanufacturermeansapersonwhoassembles,installs,orpermanentlyaffixesabody,cab,orequipmenttoanincompletenewmotorvehiclesuchasachassis,chassiscab,orvanprovidedbyafirststagemanufacturer,tocompletethevehicleintoamotorhome.(11)Newmotorvehiclemeansanynewself-propelledvehicle,includinganewmotorcycle,primarilydesignedforthetransportationofpersonsorpropertyoverthepublichighwaysthatwasoriginallypurchasedorleasedatretailfromanewmotorvehicledealerorleasingcompanyinthisstate,andthatwasinitiallyregisteredinthisstateorforwhichatemporarymotorvehiclelicensewasiss
