ABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool1ABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool甲方:ABC教育培训学校PartyA:ABCTrainingschool乙方:PartyB:本合同由ABC教育培训学校制定和印刷2017年版ThiscontractismadeandprintedbyABCTrainingschool2017Edition甲方：ABC教育培训学校（以下简称“甲方”）PartyA:ABCTrainingschoolABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool2referredtoas“PartyA”)法定代表人：高文英LegalRepresentative:wenyinggao注册地址：内蒙古呼伦贝尔海拉尔金水岸一号写字层楼RegisteredAddress:thethirdfloor,jinshuianareahailerinnermongolia邮编：022108PostCode:022108乙方：（以下简称“乙方”）PartyB:______________________(hereafterreferredtoas“PartyB”)国籍：性别：Nationality:Gender:______________护照号码：出生日期：年月日PassportNo.:______________DateofBirth:______________在华通讯地址：PermanentAddressinChina:______________________________邮政编码：_________PostCode:_________国外住所地通讯地址：PostalAddressforOriginalDomicile:______________________邮政编码：_________ABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool3PostCode：_________电子邮箱：_________EmailAddress:____________电话：_________传真：_________Tel.No.:_________FaxNo.:_________根据中华人民共和国法律、法规，双方在平等、自愿、协商一致的基础上签订本聘用合同。甲、乙双方的权利和义务由本合同中约定，双方确认已经充分理解，并且将完全履行合同的任何条款。除非乙方在订立合同当时明确表示保留或者取消，否则乙方放弃任何针对本合同条款的抗辩权。TherightsandobligationsofPartyAandPartyBareestablishedintheContract.BothPartiesconfirmtheyfullyunderstandandwillimplementcompletelyanyprovisionsintheContract.UnlessPartyBexplicitlyexpresseshisreservationsoverandhiswishtocancelcertainprovisionswhenmakingtheContract,PartyBwaiveshisrightofdefenseonanyoftheprovisions.一、合同期限ChapterI.ContractTerm第一条Article1.1.1本合同期限自2017年9月3日起，至2018年9月3止。ABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool4TheContractcoversthetermfrom3dayofSept.,2017to3dayofsep.2018.1.2本合同规定乙方的试用期为1个月，自2017年9月102017年10月10日止。TheprobationaryperiodforPartyBisonemonth,startingfrom1dayofSept.10,2017to30dayofSept.10,20171.3甲方可根据乙方的实际工作能力和表现决定是否缩短试用期。试用期内任何一方可依法书面通知对方解除本合同。PartyAwilldecidewhetherornottoshortentheprobationaryperiodbaseduponPartyB’sprovedcapacity.Duringtheprobationaryperiod,eitherPartycanterminatetheContractuponinformingtheotherPartyinawrittenformaccordingtolaw.1.4试用期内乙方有不符合甲方录用标准的行为，由于乙方故意隐瞒原因使甲方在试用期满后才得以知晓的，甲方有权按照试用期内解除本合同的规定解除与乙方的聘用合同，甲方不需向乙方支付经济补偿金。ShouldPartyBconductactsduringtheprobationaryperiodthatdonotmeetPartyA’srecruitmentrequirementsandPartyAdoesnotknowthemuntilaftertheprobationaryperiodbecauseofPartyB’sintentionaleffortstoconcealthem,thenPartyAhastherighttoterminatetheContractinaccordancewithprovisionsconcerningterminationoftheABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool5ContractduringtheprobationaryperiodwithoutpayinganycompensationtoPartyB.二、工作岗位ChapterⅡ.JobDescription第二条工作岗位Article2.JobDescription.2.1甲方根据工作需要及乙方的岗位意向，聘用乙方在部门，担任英语教师专业岗位工作。PartyAemploysPartyBservedinEnglishteacherpostintheService,accordingtoPartyA’sneedsandPartyB’sdesire.2.2乙方应始终胜任受聘岗位，并且高效履行相应的各项职责和义务。PartyBshouldallalongremainqualifiedforthepostandperformrelevantresponsibilitiesandobligationsinahighlyefficientmanner.2.3乙方在本合同履行期间不能直接或间接地受聘于其他单位。PartyBshouldnotbeemployedbyanyothercompanyorindividualeitherdirectlyorindirectlyduringtheContractterm.三、工作报酬及纳税ChapterⅢ.SalaryandIncometaxABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool6第三条工资Article3.Salary3.1甲方按国家分配制度的有关规定确定乙方应得的工资报酬。乙方的月工资为8000人民币（税前）。PartyAfixesPartyB’ssalaryinaccordancewithrelevantrulesunderthenationalallotmentsystem.PartyB’smonthlypaymentis5000RMBYuan(taxable).3.2乙方病假工资按照中国相关法律规定发放。Whentakingsickleave,PartyBispaidinaccordancewiththerelevantlawsandregulationsinChina3.4由于乙方违反甲方规章制度损坏甲方财产，或者违反聘用纪律和制度受到经济处罚，或者违反本合同应当支付违约金、赔偿金的，甲方有权从乙方的工资中予以扣除。PartyAhastherighttomakedeductionsfromPartyB’ssalaryincasePartyBdisregardsPartyA’srulesanddamagesPartyA’sproperty,finedeconomicallyforviolationofemploymentrulesandregulations,andpaypenaltyorcompensationforviolatingtheContract.第四条工资支付Article4.Paymentofsalaries4.1甲方每月10日以前以货币形式支付当月的工资。如遇法定节假日，则提前至最近的一个工作日发放。ABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool7PartyAshallgivepaymenttoPartyBintheformofcurrencybeforethe10thofthecorrespondingmonth.Ifthedatecoincideswithalegalholiday,thepaydayismoveduptotheprecedingworkday.九月的薪水将与十月的薪水一并于十月给付。4.2如果甲方因为不可控原因或者其他重大事件造成不能按时支付乙方工资的，甲方应提前三天通知乙方，经通知乙方后最长可以延期十日支付。ShouldPartyAbeunabletomakethepaymentontimebecauseofuncontrollablereasonsorothersignificantevents,PartyAshouldnotifyPartyB3daysinadvance.PartyAcanpostponethepaymentforamaximumof10days.第五条个人所得税Article5.Personalincometax5.1申报和缴纳个人所得税是乙方的义务，甲方按国家有关规定在乙方的工资或其他报酬内代扣代缴。ItisPartyB’sobligationtoreportandpaypersonalincometax.Inaccordancewithrelevantnationalregulations,PartyAperformsthedutyofdeductingthetaxfromPartyB’ssalaryandotherincomeandpaysittotaxauthorities.5.2除非甲、乙双方另有约定，乙方依据本合同取得的均为含税工资和其他报酬。ABC教育培训学校外国文教专家聘用合同书ForeignStaffer’sEmploymentContractofABCTrainingschool8UnlessPartyAandPartyBagreeotherwise,allthesalaryandotherincomethatPartyBreceivesunderthisContractaretaxable.四、行政审批ChapterⅣ.Administrativeexaminationandappr
