ACE/BD.VOL.I/17.10.03.docPage1of52400BEDHOSPITAL/IRAQ400BEDHOSPITALATSULEIMANIYEHINNORTHERNIRAQ伊拉克北部苏莱曼尼亚市400床位医院项目BIDDINGDOCUMENTS招标文件CONTENTS目录VolumeI-BiddingProceduresandContractConditions第一卷：招标程序和合同条款VolumeII-Specifications第二卷：技术说明VolumeIII-BillofQuantities第三卷：工程量清单VolumeIV-Drawings第四卷：施工图ACE/BD.VOL.I/17.10.03.docPage2of52400BEDHOSPITAL/IRAQBIDDINGDOCUMENTS招标文件VOLUMEI–BIDDINGPROCEDURESANDCONTRACTCONDITIONS第一卷：招标程序和合同条款CONTENTS目录InstructionstoBidders投标人须知ConditionsofContractPartI-GeneralConditionsPartII-ConditionsofParticularApplication合同条款第一部分：一般条款第二部分：特别条款TenderandAppendixtoBid投标人承诺函和标书附件FormofTenderSecurity投标保函格式FormofAgreement协议格式FormofPerformanceSecurity履约保函格式FormofBankGuaranteeforAdvancePayment预付款银行保函格式ACE/BD.VOL.I/17.10.03.docPage3of52400BEDHOSPITAL/IRAQINSTRUCTIONSTOBIDDERS投标人须知A.General一般条款1.ScopeofBid1.1TheWorldHealthOrganization,hereinaftertheEmployer,wishestoreceivebidsfortheconstructionofa400BedHospitalatSuleimaniyehinNorthernIraq,hereinafterreferredtoastheWorks,招标范围1.1世界卫生组织，以下称为“雇主”，期望能收到修建伊拉克北部苏莱曼尼亚市400床位医院的投标书，以下简称为“本工程”1.2ThesuccessfulbidderwillbeexpectedtocompletetheWorkswithintheperiodstatedintheAppendixtoBid.1.2中标人需要在标书附页所规定的工期内完成本工程1.3Throughoutthesebiddingdocuments,thetermsbidandtenderandtheirderivatives(bidder/tenderer,bid/tendered,bidding/tendering,etc.)aresynonymous,anddaymeanscalendarday.Singularalsomeansplural.1.3在整个标书文件中，术语“投标”和“招标”以及他们的派生词（投标人/招标人，已投标/已招标，进行投标/进行招标）均为同义词，天是指日历天，单数也可以表示复数。2.Qualification2.1Biddersshall,aspartoftheirbid,submitinaseparatefoldermarked“QualificationoftheBidder,thefollowingdocuments:2.资质文件2.1作为标书的一部分，投标人应该单独提交装在标有“投标人资质”的文件袋里的下列资质文件：(a)Awrittenpowerofattorneyauthorizingthesignatoryofthebidtocommitthebidder;（1）一份授权标书签字人代理履行投标人义务的书面授权书。(b)Thenameofthecompany,registeredaddress,description,dateestablished,yearsofexperienceascontractor,structureandorganization,detailsofthenumberoftechnical,administrativeandlabourresources,detailsofcontractor’sequipmentandfacilities;（2）公司名称，注册地，公司介绍，成立日期，作为承包商有多少年的工程承包经验，公司结构和组织体ACE/BD.VOL.I/17.10.03.docPage4of52400BEDHOSPITAL/IRAQ系，技术人员，管理人员和劳动力资源等详细信息，承包商所拥有的设备及设施的详细情况；(c)Registrationcertificatesandcertificatesofgoodstanding;(3)公司注册证明文件和良好的信誉证明文件；(d)Statementconfirmingcurrentownership,directorsandauthorizedexecutives;（4）确认当前公司所有权，经理和经授权的执行经理（项目经理）的申明书；(e)Auditedaccountsforthelast3years;（5）最近3年来的审核账目；(f)Bankstatementconfirmingfinancialstanding,accesstolinesofcreditandavailabilityofotherfinancialresources;用于证明公司财务状况的银行对账单，获得信用贷款的最高额度以及所拥有的其他金融资源。(g)Experiencerecordincludingrelevantprojectscompleted(nameofproject,location,employer,projectvalue,yearstarted,yearcompleted);（7）包括已竣工的类似工程在内的业绩证明（项目名称，地点，雇主，项目造价，开工年份，竣工日期）(h)Listofallprojectsinprogressincludingname,location,employer,value,yearstatedandexpectedcompletiondate.（8）所有在建项目清单，包括项目名称，地点，雇主，造价，开工年份和预期的竣工日期。AllabovedocumentsshallbeinEnglishor,wheretheoriginaldocumentisinanyotherlanguage,itshallbeaccompaniedbyanyofficialEnglishtranslation.以上所有文件应以英语书写或者，若原始文件使用其他任何一种语言，这些文件应附上正式的英语翻译。2.2Bidssubmittedbyajointventureoftwoormorefirmsaspartnersshallcomplywiththefollowingrequirements:2.2由两个公司或两个以上合作伙伴公司组成的联合体提的标书应满足下列要求。(a)ThebidshallincludealltheinformationlistedinSub-Clause2.1above;（1）标书应包含上述2.1条所提及的所有内容。(b)Thebidand,incaseofasuccessfulbid,theAgreement,shallbesignedsoastobelegallybindingonallpartners;（2）若联合体中标，则所签署的标书和协议对所有合伙公司都具有法律约束力；ACE/BD.VOL.I/17.10.03.docPage5of52400BEDHOSPITAL/IRAQ(c)Oneofthepartnersshallbenominatedasbeingincharge,andthisauthorizationshallbeevidencedbysubmittingapowerofattorneysignedbylegallyauthorizedsignatoriesofallthepartners;（3）应提名合伙公司其中之一作为主承包商，同时应通过提交所有合作伙伴法定授权签字人签字的授权书来证明这种授权委托关系；(d)Thepartnerinchargeshallbeauthorizedtoincurliabilitiesandreceiveinstructionsforandonbehalfofanyandallpartnersofthejointventureandtheentireexecutionofthecontract,includingpayment,shallbedoneexclusivelywiththepartnerincharge;（4）所有合伙公司应授权这个主管公司代表联合体内的任意或所有公司承担责任或接受指令，并且只能由该主管公司来执行包括支取工程款在内的整个合同内容；(e)Allpartnersofthejointventureshallbeliablejointlyandseverallyfortheexecutionofthecontractinaccordancewiththecontractterms,andastatementtothiseffectshallbeincludedintheauthorizationmentionedunder(c)above,aswellasinthebidandintheAgreement(incaseofasuccessfulbid);and(5)联合体内的所有合伙公司都对依照合同条款来执行合同负有连带责任，对于此项连带责任的申明应在上文（c）款中提及的授权书中写明，也应在投标书和协议书中写明此项责任（如果中标的话）(f)Acopyoftheagreemententeredintobythejointventurepartnersshallbesubmittedwiththebid.（6）联合体合作伙伴之间签订的协议书副本应与投标书一起提交3.OneBidper3.1EachbiddershallsubmitonlyonebideitherbyBidderhimself,orasapartnerinajointventure.Abidderwhosubmitsorparticipatesinmorethanonebidwillbedisqualified.3.一人一标3.1不论是单独投标还是作为联合体合伙人投标，每个投标人只能提交一份标书。若投标人提交多份或参与多份标书投标，将取消其竞标资格。4.Costof4.1ThebiddershallbearallcostsassociatedwiththeBiddingpreparationandsubmissionofitsbid,andtheEmployerwillinnocaseberesponsibleorliableforthosecosts,regardlessoftheconductoroutcomeofthebiddingprocess.ACE/BD.VOL.I/17.10.03.docPage6of52400BEDHOSPITAL/IRAQ4.中标价4.1不管投标过程如何操作以及投标结果如何，投标人应承担所有编制和提交标书的相关费用，业主没有责任和义务来承担这些费用5.SiteVisit5.1ThebidderisadvisedtovisitandexaminetheSiteofWorksanditss
