密级：学校代码：10075分类号：学号：20090203法学硕士学位论文学位申请人：韩一博指导教师：刘志刚教授学位类别：法学硕士学科专业：民商法学授予单位：河北大学答辩日期：二○一二年六月ClassifiedIndex：CODE：10075U.D.C：NO：20090203ADissertationforthedegreeofM.LawTheResearchonLegalSystemforTheUrbanBuildingAcquisitionandCompensationinChinaCandidate:HanYiboSupervisor:Prof.LiuZhigangAcademicDegreeAppliedfor:MasterofLawSpecialty:CivilandCommercialLawUniversity:HebeiUniversityDateofOralExamination:June,2012摘要I摘要随着我国的综合国力不断提升，国民经济和居民的生活水平不断发展，城市房屋征收工作应运而生。城市房屋征收活动伴随着城市基础性设施建设、住宅建设和旧城区改造日益发展起来，对改善广大群众的居住环境、提高居民的生活水平，促进城市繁荣有着举足轻重的作用。但是，因征收活动引起的种种纠纷却频频见诸报端，甚至还引发冲突升级出现了一些悲剧性事件，究其原因主要在于城市房屋征收的核心问题---征收补偿问题。作为一名法律人，从制度方面考虑，关键在于我国现有的征收补偿法律制度不够健全，一些利益未能得到有效兼顾或平衡，较多时候不能切实保护被征收人的合法权益，就使得被征收人与征收人之间的冲突不断出现，甚至愈演愈激烈，由此引发了一系列社会问题。本文以征收与补偿为研究对象，结合国务院新颁布的《国有土地上房屋征收与补偿条例》在当前实施过程中出现的问题，旨在以法律的角度对预防和处理征收补偿纠纷提供一些切实可行的建议和构想。全文一共分为引言、正文、结语三个部分。引言部分主要从分析当前在城市征收与补偿活动中出现的问题而引出本文的选题意义，以及本文的研究内容和方法。正文部分主要包括三个章节：第一章主要介绍了我国城市房屋征收补偿法律制度的概况，主要内容包括：城市房屋征收补偿的概念、范围和方式，以及城市房屋征收补偿法律制度的历史沿革。第二章主要介绍了我国城市房屋征收补偿法律制度的立法现状及缺陷，主要内容包括：（1）《国有土地上房屋征收与补偿条例》的立法进程及亮点。我国各阶位法律对城市房屋征收与补偿的相关规定，比如宪法、法律、行政法规和地方性规章等的规定；（2）我国城市房屋征收补偿法律制度存在的问题，详细剖析了关于城市房屋征收与补偿相关制度的不足。第三章主要阐述了关于我国城市房屋征收补偿法律制度的完善，主要内容包括：（1）相关实体法律规范的完善；（2）相关后续制度的设计与增加；（3）重视程序公正方面的问题；（4）建立科学的城市被征收房屋价值评估机制；（5）提升征收补偿过程中的公正程度，并且结合具体事例详细分析了关于社会稳定风险评估前置的必要性；（6）结合国外相关先进制度，提出对我国的制度设计有益的借鉴。摘要II结语部分是对全文的总结性概述，以及笔者对未来的美好展望。本文采用文献研究法和比较法相结合的研究方法，利用数据库及互联网查阅、搜集、鉴别、整理、分析现存的文献资料，同时比较分析国内外关于征收补偿法律制度，从中探索值得我国借鉴的部分，结合具体事例，对城市房屋征收补偿中涉及的法律问题进行研究，并提出个人的建议和观点，希望对进一步完善我国城市房屋征收补偿相关法律制度尽自己的微薄之力。关键词城市房屋征收补偿立法现状缺陷完善程序AbstractIIIAbstractWithChina'scomprehensivenationalstrengthsuccessiveascensions,thenationaleconomyandpeople'slifeleveldevelopment,urbanhousecollectionworkarisesatthehistoricmoment.Urbanhousecollectionactivitieswithbasicfacilitiesconstruction,urbanresidentialconstructionandoldreformdevelopmentup,toimprovethepeople'slivingenvironmentandimprovethestandardofliving,andpromotetheurbanprosperityhasapivotalrole.But,forallsortsofactivitiescreatetaxdisputebutfrequentlybeenmadepublic,andevencauseconflictupgradeappearedsometragicevents,themainreasonisthecoreoftheurbanhousecollection-collectionofcompensation.Asalegalperson,fromsystemintoconsideration,thekeyliesinourcountry'sexistingcollectionofcompensationlawsystemwasn'tstrongenough,someinterestsfailedtogetboththeeffectiveorbalance,moretimecan'tprotectthelegalrightsoftheexpropriated,makesexpropriatedontheconflictbetweenappearconstantly,evenbecomesincreasinglyfierce,whichcausedaseriesofsocialproblems.Basedonthecollectionandcompensationforexample,combinedwiththenewdepartmentunderthestatecouncilissuedbythehousesonthestate-ownedlandtaxandcompensationordinanceinthecurrentimplementationprocessproblems,istothepointofviewofthelawonthepreventionandtreatmentcompensationdisputesprovidesomepracticalSuggestionsandideas.Fulltextsaredividedintopreface,text,endnotesthreeparts.Introductionofthemainfromtheanalysisofthecurrentinthecitywithcompensatoryactivityontheproblemsinandoutofthispapertopicsignificance,andthispapertheresearchcontentandthemethod.Textmainlyincludesthreesections:Thefirstchaptermainlyintroducedintheurbanbuildingacquisitionforthegeneralsituationofthelegalsystem,andthemaincontentsinclude:theconceptofurbanhousecollectionofcompensation,thescopeandtheway,thehousesonthestate-ownedlandtaxandcompensationoftheregulationsofthelegislativeprocessandthenewcollectionandcompensationordinancewindow.Thesecondchaptermainlyintroducedintheurbanbuildingacquisitionforthepresentlegislationandlegalsystemdefect,themaincontentincludes:(1)everyChineseorderalawofurbanhouseswiththerelatedprovisionsoncompensation,suchastheconstitution,theAbstractIVlaws,administrativerulesandregulationsandtheprovisionsofthelocalregulations;(2)intheurbanbuildingcollectioncompensationlegalproblemsinthesystem,analyzesthedetailedurbanhousecollectionandcompensationonthelegislativelayerdefectsandrelatedsystemthelackofcontent.Thethirdchapterbasicallyexpoundedonintheurbanbuildingacquisitionfortheperfectionoflegalsystemandideasandmaincontentincludes:(1)theperfectionoflegalnormsrelatedentities;(2)relatedfollow-upsystemdesignandincrease;(3)payattentiontotheproblemofjusticeprogram;(4)establishascientificcitytaxcollectiononhousingvalueevaluationmechanism;(5)intheprocessofascensionacquisitionforfairdegree,andcombinationofcasedetailedanalysisaboutsocialstabilityriskassessmentofthenecessityoflead;(6),basedontheforeignrelatedadvancedsystem,putsforwardthedesignofthesysteminourcountrythebeneficialreference.Epiloguepartistooverviewthefulltextsummary,andtheprospectsofthegoodfuture.Thispaperadoptsliteratureresearchandcomparisonmethodresearchmethods,theuseofdatabaseandtheInternetaccess,collect,identification,arrangeandanalyzetheexistingliteraturematerial,atthesametime,comparativeanalysisaboutthelegalsystemathomeandabroadoncompensation,itisworthexploringreferencepart,withspecificcases,tothecitybuildingacquisitionforthelegalissuesinvolvedinresearch,andputforwardtheSuggestionsandviewsoftheindividual,andIhopetofurtherperfectourcountrycityhouseacquisiti
