湘潭大学博士学位论文社会保障权的法律救济机制研究姓名：成志刚申请学位级别：博士专业：诉讼法学指导教师：胡肖华20080418IVVVIAbstractInrecentyears,socialsecurity,asahotandcomplexissueinpresentsociety,hasarousedhighlyattentionofourpartyandcountryandalsohasbeengivenacloseconcernbythemajorityofthepeople.Particularly,ourcountry,atpresent,hasenteredanewhistoricera,inwhichwemakeeveryefforttotakethewholesituationofruralandurbandevelopmentintoaccountandtoestablishaharmonioussociety,thus,thestabledevelopmentofeconomy,theprogressesofsociety,andthewelfareofthepeopleallshouldbecountedonaperfectsocialsecuritysystem.Asabasicrightofmodernsociety,socialsecurityrightsserveasacoreissueofsocialsecuritysystem,alongtheway,asalogicalbeginningtofigureoutsocialsecurityproblems.Socialsecurityrightscanbedefinedasthebasicrightswhichaimtomeettheneedofmaintainingsocialmembers’basiclifeconsumptionandevenprovingtheirlifestandards.Whenthesocialmembersareintroublewithsurvivalanddevelopment,theycangetamaterialhelpfromourcountryandsociety.Inshort,socialsecurityrightsarenotonlythebasichumanrights,butalsothebasicrightsenjoyedbyeverycitizen,andwhat’smore,concretelegalrights.Withoutrights,noonecanenjoyrelief;conversely,anyreliefisassociatedwithrights.And,thepromulgationandendowmentofrightsandtheirpracticalenjoymentshoulduserightsreliefsystemasitsbacking.Duetosomespecifictraits,socialsecurityrightsareexposedtoinvasionsandencroachmentsespeciallylaunchedbystateorganizations,artificialpersonsorsomeotherorganizations,thusmayarouseaconflictanddisputebetweenthebodyofsocialsecurityrightsanddutyrelatedpersons,then,therelativestateinstitutionsandorganizationshavetocompensate.Lawsshouldendowtherightsofcitizen’sreliefandgiveadefiniteregulationtothewaywelaunchrelief.Thisisessentialbecauseitisaneffectivetechniqueandmoreimportantly,apowerfulguaranteetorealizesocialsecurityrights.Reliefsystemofsocialsecurityrightscanbedefinedasareliefmethod,style,andarelatedproceduredesignusedbytherelieforganizationsthatdealwiththeencroachments.Thispaperemploysrightsrelieftheoryasanalysistechnique,startingfromtheelaborationofsocialsecurityrights,thepaperlaunchesanexplorationtothelegalfoundingofsocialsecurityrights’legaltraitsandlegalreliefofsocialsecurityrightsfromtheanglesofinternationalanddomesticlaws,thusrevealsthenecessityoflegalreliefofsocialsecurityrights.Meanwhile,thispaperexaminesandtriestoprovethefeasibilityofthelaunchingoflegalreliefmechanismofsocialsecurityrightsandthewayitrunsbyaVIIsystemicinterpretationtothedefinition,principles,mechanicstructureoflegalreliefofsocialsecurityrightsandaninterpretationtolegaleffectandthefeasibilityoflawsuitofsocialsecurityrights.Asamechanismtosolveencroachments,legalreliefofsocialsecurityrightsrunswiththefollowingfeatures:legalreliefofsocialsecurityrightssubmitsitselftoadministrativeprocedureandcivilprocedurerespectively,andfiguresoutsolutionstotheadministrativedisputesoversocialsecuritybymeansofadministrativereconsiderationandadministrativelawsuit;eliminatingthelabordisputesoversocialsecuritybythewayofmediation,arbitrationandlawsuit.Thankstotheparticulartraitsofsocialsecurityrightsandthelimitsofourcountry’slegalmechanism,manyproblemsdoexistinourcountry’slegalreliefofsocialsecurityrights.Usingtheoverseasmainlandlegalsystem’sandBritain-Americalegalsystem’swayofdealingwithdisputesoversocialsecurityandsocialsecurityrights’reliefforreference,theydohavesomeadvantageousforustotake,namely,settingupspecialreliefstructure,adoptingspecialreliefprocedure,advocatingmulti-reliefmethods,adheringtotheultimatetraitsoflegalreliefandthelike.Thispaperaimstoexplorethepathoflegal,administrativeandlegalreliefmechanismadaptingtoourstatesituationinthelightofthecurrentconditionoflimitedrelieflegislationandadministrativerelief,andthebackwardlegalreliefofourcountry’slegalreliefofsocialsecurityrights.Inthemeantime,inviewofthecurrentstateoftheimplementoflegalreliefmechanism,whichhastheultimateeffectandrolesasthemosteffective,themostpopularoneinlegalreliefofsocialsecurityrights,thispapergivesaprofoundresearchtoaconcretewaytoperfectourcountry’slegalreliefmechanismofsocialsecurityrightsintermsofthreeaspects,namely,launchingconstitutionallawsuitmechanism,improvingcivillawsuitmechanismandperfectingadministrativelawsuitmechanism.Thepaperhopesthatamulti-reliefinterconnectionmightbesetupsoastopromoteourcountry’ssocialsecuritysystemtoamorematurestage,andalongtheway,motivatetheperfectingofsocialsecurityconstitution,then,ultimately,allofthesocialmembersmightsharetheachievementofsocialcivilizationprogress—socialsecurityrights.Keywords:SocialSecurityRights;SocialInsuranceRights;LegalRelief;MechanismIII11.11.1.121.1.231.21.2.1NevilleHarrisNevilleHarrisRobertEast[],:[M].:2006,220-2442090[],:[M].:2003,25-3041.2.21[],:[M].:2003,193-200:,:[M].:2005,137-147:[J].20023,3-9:[J].20065,26-32:[J].[J].200436,57-6167-71:200412,58-60:[J].20069,216-218523111213:[J].20055,24-28:[J].20064,137-139:[M].:1998,349-446:[M].:2003,437-492:[J].20005,68-75:[M]200150-58:[J].20066,24-28:[M].:2005,284-306:[J].20063,90-92:200511:[J].20061,87-9312:[J].20062,36-371
