Cap132BD-PRESERVATIVESINFOODREGULATION1Chapter:132BDPRESERVATIVESINFOODREGULATIONGazetteNumberVersionDateEmpoweringsectionL.N.85of200801/07/2008PRESERVATIVESINFOODREGULATION(L.N.85of2008)(Cap132,sections55and143)[2February1973](OriginallyL.N.20of1973)Section:1(RepealedL.N.85of2008)L.N.85of200801/07/2008Section:2InterpretationL.N.85of200801/07/2008(1)InthisRegulationunlessthecontextotherwiserequires-(L.N.85of2008)airtranshipmentcargo(航空轉運貨物)hasthemeaningassignedtoitinsection2oftheImportandExportOrdinance(Cap60);(29of2000s.5)airtransitcargo(航空過境貨物)meansanyarticleintransitthatisbothimportedandconsignedforexportinanaircraft;(29of2000s.5)alternativeform(替代物),inrelationtoapermittedfoodadditivesetoutincolumn1ofSchedule1A,meansasubstancespecifiedinrelationtothatfoodadditiveincolumn2ofthatSchedule;(L.N.85of2008)antioxidant(抗氧化劑)meansanysubstancethatprotectsfoodagainstdeteriorationcausedbyoxidation(includingfatrancidityandcolourchanges)butdoesnotinclude-(a)lecithin;(b)ascorbicacidorsaltsorestersofascorbicacid;(c)tocopherols;(d)erythorbicacid,citricacid,tartaricacid,phosphoricacid,lacticacidorthecalcium,potassiumorsodiumsaltsofanysuchacid;(e)calcium,potassiumorsodiumsaltsofgluconicacid;(f)aceticandfattyacidestersofglycerol,lacticandfattyacidestersofglycerolorcitricandfattyacidestersofglycerol;or(g)glucoseoxidasederivedfromAspergillusnigervar.;(L.N.85of2008)articleintransit(過境物品)hasthemeaningassignedtoitinsection2oftheImportandExportOrdinance(Cap60);(29of2000s.5)cannedfood(罐頭食物)meansfoodinahermeticallysealedcontainerwhichhasbeensufficientlyheatprocessedtodestroyanyClostridiumBotulinuminthatfoodorcontainerorwhichhasapHoflessthan4.5;cargotranshipmentareaofHongKongInternationalAirport(機場貨物轉運區)hasthemeaningassignedtoitinsection2oftheImportandExportOrdinance(Cap60);(29of2000s.5)cateringbusiness(飲食供應業)includesthebusinessorundertakingofaninn,publichouse,hotel,restaurant,cafe,tea-shop,buffet,coffee-stalloranyplaceofrefreshmentopentothepublic,orofaclub,boardinghouse,apartmenthouse,refreshmentcontractor,schoolfeedingcentre,staffdiningroomorcanteen;CodexAlimentariusCommission(食品法典委員會)meansthebodycreatedin1963bytheWorldHealthOrganizationandtheFoodandAgricultureOrganizationtodevelopfoodstandards,guidelinesandrelatedtexts;(L.N.85of2008)compoundedfood(合成食物)meansfoodcontaining2ormoreingredients;container(容器)includesanyformofpackagingoffoodforsaleasasingleitem,whetherbywayofwhollyorpartlyenclosingthefoodorbywayofattachingthefoodtosomeotherarticle,andinparticularincludesawrapperorconfiningband;Cap132BD-PRESERVATIVESINFOODREGULATION2deterioration(變壞)inrelationtofood,meansdeteriorationduetotheactionofbacteria,yeastsormoulds;foodadditive(食物添加劑)meansapreservativeoranantioxidant;(L.N.85of2008)GMP(優良製造規範)meansgoodmanufacturingpractice,whichincludesamanufacturingpracticethatcomplieswiththefollowing-(a)thequantityofthefoodadditiveaddedtothefoodislimitedtothelowestpossiblelevelnecessarytoaccomplishthedesiredeffectofaddingit;(b)thequantityofthefoodadditivethatbecomesacomponentofthefoodasaresultofitsuseinthemanufacturing,processingorpackagingofafoodandthatisnotintendedtoaccomplishanyphysicalorothertechnicaleffectinthefooditself,isreducedtoareasonablypossibleextent;and(c)thefoodadditiveispreparedandhandledinthesamewayasafoodingredient;(L.N.85of2008)importer(進口商)includesanypersonwho,whetherasowner,consignee,agentorbroker,isinpossessionoforentitledtothecustodyorcontrolofanyarticleoffoodbroughtfromaplaceoutsideHongKong;(10of1986s.32(2))INS(國際編碼系統)meansthesystemknownastheInternationalNumberingSystemforFoodAdditivesthatwasadoptedbytheCodexAlimentariusCommissionforidentifyingfoodadditivesinthelistofingredientsofanypre-packagedfood;(L.N.85of2008)maximumpermittedlevel(昀高准許含量),inrelationtoapermittedfoodadditivesetoutincolumn2ofSchedule1,meanstheproportionspecifiedinrelationtothatfoodadditiveincolumn3ofthatSchedule;(L.N.85of2008)permittedantioxidant(准許抗氧化劑)meansasubstancespecifiedincolumn2ofSchedule1thatfunctionsprimarilyasanantioxidant;(L.N.85of2008)permittedcolouringmatter(准許染色料)meansanycolouringmatterinasmuchasitsuseispermittedbytheColouringMatterinFoodRegulations(Cap132sub.leg.H);permittedfoodadditive(准許食物添加劑)meansafoodadditivespecifiedincolumn2ofSchedule1;(L.N.85of2008)permittedpreservative(准許防腐劑)meansasubstancespecifiedincolumn2ofSchedule1thatfunctionsprimarilyasapreservative;(L.N.85of2008)pre-packed(預先包裝)meansmadeupinadvancereadyforretailsaleinoronacontainer;andonanypremiseswherefoodofanydescriptionissomadeup,oriskeptorstoredforsaleafterbeingsomadeup,anyfoodofthatdescriptionfoundmadeupinoronacontainershallbedeemedtobepre-packedunlessthecontraryisproved;preparation(配製)inrelationtofood,includesmanufactureandanyformoftreatment;andpreparationforsale(配製以供出售)includespackaging;preservative(防腐劑)meansanysubstancewhichiscapableofinhibiting,retardingorarrestingtheprocessoffermentation,acidificationorotherdeteriorationoffoodorofmaskinganyoftheevidenceofputrefactionbutdoesnotinclude-(a)(RepealedL.N.85of2008)(b)anypermittedcolouringmatter;(c)commonsalt(sodiumchlori
