Page139AGREEMENTONTRADE-RELATEDINVESTMENTMEASURESMembers,ConsideringthatMinistersagreedinthePuntadelEsteDeclarationthatFollowinganexaminationoftheoperationofGATTArticlesrelatedtothetraderestrictiveanddistortingeffectsofinvestmentmeasures,negotiationsshouldelaborate,asappropriate,furtherprovisionsthatmaybenecessarytoavoidsuchadverseeffectsontrade;Desiringtopromotetheexpansionandprogressiveliberalisationofworldtradeandtofacilitateinvestmentacrossinternationalfrontierssoastoincreasetheeconomicgrowthofalltradingpartners,particularlydevelopingcountryMembers,whileensuringfreecompetition;Takingintoaccounttheparticulartrade,developmentandfinancialneedsofdevelopingcountryMembers,particularlythoseoftheleast-developedcountryMembers;Recognizingthatcertaininvestmentmeasurescancausetrade-restrictiveanddistortingeffects;Herebyagreeasfollows:Article1CoverageThisAgreementappliestoinvestmentmeasuresrelatedtotradeingoodsonly(referredtointhisAgreementasTRIMs).Article2NationalTreatmentandQuantitativeRestrictions1.WithoutprejudicetootherrightsandobligationsunderGATT1994,noMembershallapplyanyTRIMthatisinconsistentwiththeprovisionsofArticleIIIorArticleXIofGATT1994.2.AnillustrativelistofTRIMsthatareinconsistentwiththeobligationofnationaltreatmentprovidedforinparagraph4ofArticleIIIofGATT1994andtheobligationofgeneraleliminationofquantitativerestrictionsprovidedforinparagraph1ofArticleXIofGATT1994iscontainedintheAnnextothisAgreement.Article3ExceptionsAllexceptionsunderGATT1994shallapply,asappropriate,totheprovisionsofthisAgreement.Page140Article4DevelopingCountryMembersAdevelopingcountryMembershallbefreetodeviatetemporarilyfromtheprovisionsofArticle2totheextentandinsuchamannerasArticleXVIIIofGATT1994,theUnderstandingontheBalance-of-PaymentsProvisionsofGATT1994,andtheDeclarationonTradeMeasuresTakenforBalance-of-PaymentsPurposesadoptedon28November1979(BISD26S/205-209)permittheMembertodeviatefromtheprovisionsofArticlesIIIandXIofGATT1994.Article5NotificationandTransitionalArrangements1.Members,within90daysofthedateofentryintoforceoftheWTOAgreement,shallnotifytheCouncilforTradeinGoodsofallTRIMstheyareapplyingthatarenotinconformitywiththeprovisionsofthisAgreement.SuchTRIMsofgeneralorspecificapplicationshallbenotified,alongwiththeirprincipalfeatures.12.EachMembershalleliminateallTRIMswhicharenotifiedunderparagraph1withintwoyearsofthedateofentryintoforceoftheWTOAgreementinthecaseofadevelopedcountryMember,withinfiveyearsinthecaseofadevelopingcountryMember,andwithinsevenyearsinthecaseofaleast-developedcountryMember.3.Onrequest,theCouncilforTradeinGoodsmayextendthetransitionperiodfortheeliminationofTRIMsnotifiedunderparagraph1foradevelopingcountryMember,includingaleast-developedcountryMember,whichdemonstratesparticulardifficultiesinimplementingtheprovisionsofthisAgreement.Inconsideringsucharequest,theCouncilforTradeinGoodsshalltakeintoaccounttheindividualdevelopment,financialandtradeneedsoftheMemberinquestion.4.Duringthetransitionperiod,aMembershallnotmodifythetermsofanyTRIMwhichitnotifiesunderparagraph1fromthoseprevailingatthedateofentryintoforceoftheWTOAgreementsoastoincreasethedegreeofinconsistencywiththeprovisionsofArticle2.TRIMsintroducedlessthan180daysbeforethedateofentryintoforceoftheWTOAgreementshallnotbenefitfromthetransitionalarrangementsprovidedinparagraph2.5.NotwithstandingtheprovisionsofArticle2,aMember,inordernottodisadvantageestablishedenterpriseswhicharesubjecttoaTRIMnotifiedunderparagraph1,mayapplyduringthetransitionperiodthesameTRIMtoanewinvestment(i)wheretheproductsofsuchinvestmentarelikeproductstothoseoftheestablishedenterprises,and(ii)wherenecessarytoavoiddistortingtheconditionsofcompetitionbetweenthenewinvestmentandtheestablishedenterprises.AnyTRIMsoappliedtoanewinvestmentshallbenotifiedtotheCouncilforTradeinGoods.ThetermsofsuchaTRIMshallbeequivalentintheircompetitiveeffecttothoseapplicabletotheestablishedenterprises,anditshallbeterminatedatthesametime.1InthecaseofTRIMsappliedunderdiscretionaryauthority,eachspecificapplicationshallbenotified.Informationthatwouldprejudicethelegitimatecommercialinterestsofparticularenterprisesneednotbedisclosed.Page141Article6Transparency1.Membersreaffirm,withrespecttoTRIMs,theircommitmenttoobligationsontransparencyandnotificationinArticleXofGATT1994,intheundertakingonNotificationcontainedintheUnderstandingRegardingNotification,Consultation,DisputeSettlementandSurveillanceadoptedon28November1979andintheMinisterialDecisiononNotificationProceduresadoptedon15April1994.2.EachMembershallnotifytheSecretariatofthepublicationsinwhichTRIMsmaybefound,includingthoseappliedbyregionalandlocalgovernmentsandauthoritieswithintheirterritories.3.EachMembershallaccordsympatheticconsiderationtorequestsforinformation,andaffordadequateopportunityforconsultation,onanymatterarisingfromthisAgreementraisedbyanotherMember.InconformitywithArticleXofGATT1994noMemberisrequiredtodiscloseinformationthedisclosureofwhichwouldimpedelawenforcementorotherwisebecontrarytothepublicinterestorwouldprejudicethelegitimatecommercialint
