中华人民共和国澳门特别行政区基本法THEBASICLAWOFTHEMACAOSPECIALADMINISTRATIVEREGIONOFTHEPEOPLE'SREPUBLICOFCHINA（AdoptedattheFirstSessionoftheEighthNationalPeople'sCongressandpromulgatedbyOrderNo.3ofthePresidentofthePeople'sRepublicofChinaonMarch31，1993）颁布日期：19930331实施日期：19991220颁布单位：全国人大CONTENTSPreambleChapterIGeneralPrinciplesChapterIIRelationshipBetweentheCentralAuthoritiesandtheMacaoSpecialAdministrativeRegionChapterIIIFundamentalRightsandDutiesoftheResidentsChapterIVPoliticalStructureSection1TheChiefExecutiveSection2TheExecutiveAuthoritiesSection3TheLegislatureSection4TheJudiciarySection5MunicipalOrgansSection6PublicServantsSection7SwearingAllegianceChapterVEconomyChapterVICulturalandSocialAffairsChapterVIIExternalAffairsChapterVIIIInterpretationandAmendmentsoftheBasicLawChapterIXSupplementaryProvisionsAnnexIMethodfortheSelectionoftheChiefExecutiveoftheMacaoSpecialAdministrativeRegionAnnexIIMethodfortheFormationoftheLegislativeCounciloftheMacaoSpecialAdministrativeRegionAnnexIIINationalLawstoBeAppliedintheMacaoSpecialAdministrativeRegionPreambleMacao，includingtheMacaoPeninsula，TaipaIslandandColoaneIsland，hasbeenpartoftheterritoryofChinasinceancienttimes；itwasgraduallyoccupiedbyPortugalafterthemid-16thcentury.On13April1987，theChineseandPortugueseGovernmentssignedtheJointDeclarationontheQuestionofMacao，affirmingthattheGovernmentofthePeople'sRepublicofChinawillresumetheexerciseofsovereigntyoverMacaowitheffectfrom20December1999，thusfulfillingthelong-cherishedcommonaspirationoftheChinesepeoplefortherecoveryofMacao.Upholdingnationalunityandterritorialintegrity，contributingtosocialstabilityandeconomicdevelopment，andtakingaccountofitshistoryandrealities，thePeople'sRepublicofChinahasdecidedthatuponChina'sresumptionoftheexerciseofsovereigntyoverMacao，aMacaoSpecialAdministrativeRegionwillbeestablishedinaccordancewiththeprovisionsofArticle31oftheConstitutionofthePeople'sRepublicofChina，andthatundertheprincipleof“onecountry，twosystems”，thesocialistsystemandpolicieswillnotbepractisedinMacao.ThebasicpoliciesofthePeople'sRepublicofChinaregardingMacaohavebeenelaboratedbytheChineseGovernmentintheSino-PortugueseJointDeclaration.InaccordancewiththeConstitutionofthePeople'sRepublicofChina，theNationalPeople'sCongressherebyenactstheBasicLawoftheMacaoSpecialAdministrativeRegionofthePeople'sRepublicofChina，prescribingthesystemstobepractisedintheMacaoSpecialAdministrativeRegion，inordertoensuretheimplementationofthebasicpoliciesofthePeople'sRepublicofChinaregardingMacao.ChapterIGeneralPrinciplesArticle1TheMacaoSpecialAdministrativeRegionisaninalienablepartofthePeople'sRepublicofChina.Article2TheNationalPeople'sCongressauthorizestheMacaoSpecialAdministrativeRegiontoexerciseahighdegreeofautonomyandenjoyexecutive，legislativeandindependentjudicialpower，includingthatoffinaladjudication，inaccordancewiththeprovisionsofthisLaw.Article3TheexecutiveauthoritiesandlegislatureoftheMacaoSpecialAdministrativeRegionshallbecomposedofpermanentresidentsofMacaoinaccordancewiththerelevantprovisionsofthisLaw.Article4TheMacaoSpecialAdministrativeRegionshallsafeguardtherightsandfreedomsoftheresidentsoftheMacaoSpecialAdministrativeRegionandofotherpersonsintheRegioninaccordancewithlaw.Article5ThesocialistsystemandpoliciesshallnotbepractisedintheMacaoSpecialAdministrativeRegion，andthepreviouscapitalistsystemandwayoflifeshallremainunchangedfor50years.Article6TheMacaoSpecialAdministrativeRegionshallprotecttherightofprivateownershipofpropertyinaccordancewithlaw.Article7ThelandandnaturalresourceswithintheMacaoSpecialAdministrativeRegionshallbeStateproperty，exceptfortheprivatelandrecognisedassuchaccordingtothelawsinforcebeforetheestablishmentoftheMacaoSpecialAdministrativeRegion.TheGovernmentoftheMacaoSpecialAdministrativeRegionshallberesponsiblefortheirmanagement，useanddevelopmentandfortheirleaseorgranttoindividualsorlegalpersonsforuseordevelopment.TherevenuesderivedtherefromshallbeexclusivelyatthedisposalofthegovernmentoftheRegion.Article8Thelaws，decrees，administrativeregulationsandothernormativeactspreviouslyinforceinMacaoshallbemaintained，exceptforanythatcontravenesthisLaw，orsubjecttoanyamendmentbythelegislatureorotherrelevantorgansoftheMacaoSpecialAdministrativeRegioninaccordancewithlegalprocedures.Article9InadditiontotheChineselanguage，Portuguesemayalsobeusedasanofficiallanguagebytheexecutiveauthorities，legislatureandjudiciaryoftheMacaoSpecialAdministrativeRegion.Article10ApartfromdisplayingthenationalflagandnationalemblemofthePeople'sRepublicofChina，theMacaoSpecialAdministrativeRegionmayalsousearegionalflagandregionalemblem.TheregionalflagoftheMacaoSpecialAdministrativeRegionisagreenflagwithfivestars，lotusflower，bridgeandseawater.TheregionalemblemoftheMacaoSpecialAdministrativeRegioniscomposedoffivestars，lotusflower，bridgeandseawaterencircledbythewords“MacaoSpecialAdministrativeRegionofthePeople'sRepublicofChina”inChineseand“MACAO”inPortuguese.Article11InaccordancewithArticle31oftheConstitutionofthePeople'sRepublicofChina，thesystemsandpoliciespractisedintheMacaoSpecialAdm
