LaborContractLawofthePeople'sRepublicofChina劳动合同法Promulgationdate:June29,2007Effectivedate:January1,2007Department:NationalPeople'sCongressOrderofthePresidentofthePeople’sRepublicofChina(No.65)TheLaborContractLawofthePeople’sRepublicofChina,adoptedatthe28thSessionoftheStandingCommitteeofthe10thNationalPeople'sCongressofthePeople’sRepublicofChinaonJune29,2007,isherebypromulgatedandshallcomeintoeffectonJanuary1,2008.HuJintaoPresidentofthePeople’sRepublicofChinaJune29,2007ContentsChapterIGeneralProvisionsChapterIIConclusionofLaborContractsChapterIIIPerformanceandAmendmentofLaborContractsChapterIVRevocationandTerminationofLaborContractsChapterVSpecialProvisions-PartICollectiveContracts-PartIIWorkPlacement-PartIIIPart-timeLaborChapterVISupervisionandInspectionChapterVIILegalLiabilityChapterVIIISupplementaryProvisionsLaborContractLawofthePeople’sRepublicofChinaChapter1GeneralProvisionsArticle1ThisLawisformulatedtoimprovethelaborcontractsystem,tospecifytherightsandobligationsofthepartiestolaborcontracts,toprotectthelegitimaterightsandinterestsofworkers,andtobuildanddevelopharmoniousandstableemploymentrelationships.Article2ThisLawappliestotheestablishmentoflaborrelationshipsbetween,theconclusionof,performanceof,amendmentof,revocationofandterminationof,laborcontractsbyworkersandorganizationssuchasenterprises,individualeconomicorganizationsandprivatenon-enterpriseunitsinthePeople’sRepublicofChina(“Employers”).Theconclusion,performance,amendment,revocationandterminationoflaborcontractsbetweenstateauthorities,institutionsorsocialorganizationsandworkerswithwhomtheyestablishemploymentrelationships,shallbesubjecttothislaw.Article3Theconclusionofalaborcontractshallbebasedontheprinciplesoflawfulness,fairness,equality,voluntariness,negotiatedconsensusandgoodfaith.Alawfullyconcludedlaborcontractshallhavebindingforce,boththeEmployerandtheemployeeshallperformtheirrespectiveobligationsstipulatedtherein.Article4Employersshallformulateandimprovelaborrulesandregulationsinaccordancewiththelaw,soastoensurethatemployeesenjoytheirlaborrightsandperformtheirlaborobligations.Theformulations,amendmentsanddecisionsmadebyEmployerswithrespecttorulesonlaborcompensation,workinghours,leaveandrest,occupationalsafetyandhygiene,insuranceandwelfare,training,workdisciplineorworkquotamanagement,etc.,whichhaveadirectimpactonemployees’immediaterightsandinterests,orothermaterialmatters,shallbepresentedtoanddiscussedwiththeemployeerepresentativecongressoralltheemployees,andtheproposalandadvicethereofshallbedeterminedafterconsultationwiththelaborunionoremployeerepresentativeonthebasisofequality.If,duringtheimplementationofaruleorregulationordecisiononamaterialmatter,thelaborunionoranyoftheemployeesdeemsitinappropriate,theyshallbeentitledtoraisetheissuewiththeEmployerandhaveitamendedafterconsultation.TheEmployershallmakerules,regulationsanddecisionsonmaterialmattersthathaveadirectimpactonemployees’immediateinterestsandrights,publicorcommunicatethesametotheemployees.Article5ThelaboradministrationauthoritiesofthePeople’sGovernmentsatthecountylevelandaboveshall,togetherwithlaborunionsandenterpriserepresentatives,establishacomprehensivetri-partitemechanismfortheco-ordinationofemploymentrelationships,inordertojointlystudyandresolvematerialissuesrelatingtoemploymentrelationships.Article6ThelaborunionshallassistandguideworkersintheconclusionandperformanceoflaborcontractswiththeirEmployer,andestablishacollectiveconsultationmechanismwiththeEmployerinordertoprotectthelawfulrightsandinterestsofworkers.ChapterIIConclusionofLaborContractsArticle7TheemploymentrelationshipbetweenanEmployerandanemployeeshallcommenceonthedatetheemployeecommenceswork.TheEmployershallkeeparegisterofemployees,forfuturereference.Article8TheEmployershalltruthfullyadvisetheemployeeofthescopeofwork,theworkingconditions,theplaceofwork,occupationalhazards,productionsafetyconditions,laborcompensationandothermattersrequestedbytheemployee;theEmployershallbeentitledtotheworkerbasicinformationoftheemployeethatdirectlyrelatestothelaborcontract,andtheemployeeshalltruthfullyprovidethesame.Article9Whenhiringanemployee,theEmployershallnotretaintheemployee’sresidentIDcardorotherdocumentation,nordemandtheemployeetoprovidesecurityorcollectpropertyfromhim/herundersomeotherguise.Article10Awrittenlaborcontractshallbeconcludedwhenestablishinganemploymentrelationship.Whereanemploymentrelationshiphasbeenestablishedwithouttheconclusionofawrittenlaborcontract,thewrittenlaborcontractshallbeconcludedwithinone(1)monthfromthedatetheemployeecommenceswork.WhereanEmployerandanemployeeconcludealaborcontractbeforetheemployeecommenceswork,theemploymentrelationshipshallbeestablishedonthedatetheemployeecommenceswork.Article11WhereanEmployerfailstoconcludeawrittenlaborcontractwithanemployeebeforetheemployeecommenceswork,anditisunclearwhatlaborcompensationwasagreeduponwiththeemployee,thelaborcompensationforthenewlyrecruitedemployeeshallbepaidinaccordancewiththestandardsstipulatedinthecollectivecontract;wherethereisnocollectivecontrac
