MeetMINITABRelease14forWindows®September2003iiISBN0-925636-48-7PrintedintheUSA©2003byMinitabInc.Allrightsreserved.1stPrinting,08/03MINITAB®andtheMINITABlogo®areregisteredtrademarksofMinitabInc.Allothermarksreferencedremainthepropertyoftheirrespectiveowners.LICENSEAGREEMENTFORMINITAB™FORWINDOWS®IMPORTANT-READCAREFULLYPRIORTOLOADINGTHEENCLOSEDSOFTWAREONYOURCOMPUTER:Thisisalegalagreementbetween“You”(eitheranindividualorsinglelegalentity)andMinitabInc.governingtheuseofthesoftwareproductidentifiedabove(“Software”).ByloadingtheenclosedSoftwareonYourcomputer,youagreetothetermsofthisAgreement.Ifyoudonotagreetotheseterms,priortoloadingtheSoftwareonYourcomputer,youshouldpromptlyreturntheSoftwarepackagetotheplaceofpurchaseforafullrefund,orcontactMinitabInc.ThetypeoflicenseofferedyoubythisAgreement(for“annual”or“perpetual”use)islistedonthebackofthemediasleeve.A.TermsandConditionsApplicabletoPerpetualUseLicensesYouaregrantedalicensetousethisSoftwareinperpetuity,subjecttotheterms,fees,conditions,restrictions,andlimitationscontainedhereinandontheapplicableMinitabPriceList.ThisSoftwaremaybeusedonanycompatiblecomputer,evenifattachedtoanetwork,providedthattheSoftwareisloadedononlyonecomputerandusedbyonlyoneuseratatime.MinitabInc.willprovidereasonableamountsoftechnicalsupporttoRegisteredUsersforsolongasthisSoftwareisgenerallydistributedbyMinitabInc.tocustomers,andforone(1)yearthereafter.B.TermsandConditionsApplicabletoAnnualUseLicensesYouaregrantedalicensetousethisSoftwareforaperiodofoneyear,subjecttotheterms,fees,conditions,restrictionsandlimitationscontainedhereinandontheapplicableMinitabPriceList.Theannuallicensefeefromourthen-currentPriceListgovernsthenumberofuserspermittedtousethisSoftware.ThenumberoflicensedusersoftheSoftwaremaybeincreasedduringtheterm(s)ofthislicensebypayingadditionaluserfeesforthetimeremaininginyourthen-currentlicenseterm.Thislicensemayberenewedforadditionalone-yeartermsbypayingthethen-currentannuallicensefee,orbyissuingtoUsawrittenpurchaseorderorotherwrittenorelectronicconfirmationofYourintenttorenew.AlltermsandconditionsofthisAgreementwillapplyduringtherenewalterm(s).MinitabInc.willprovideroutinemaintenancetoRegisteredUsersduringtheterm(s)ofthelicense,includingreasonableamountsoftechnicalsupportandallprogramupdatesandnewreleasesoftheSoftwareastheybecomeavailable.C.TermsandConditionsApplicabletoBothPerpetualandAnnualUseLicensesThisagreementauthorizesYoutousetheSoftwareonlyonacomputerownedorleasedbyYou.Useofthesoftwareonacomputerownedbyathirdpartyisprohibited.ShouldYouelecttoterminateYouruseoftheSoftware,Youwillnotbeentitledtoarefundofanyportionofthelicensefee.ThisAgreementwillbegovernedunderthelawsoftheCommonwealthofPennsylvania,USA.YoumaymakecopiesoftheSoftwareforeachlicenseduserandforarchivalandback-uppurposes.MinitabInc.mayterminatethislicenseformaterialbreachbyyou.Upontermination,youagreetostopusing,andtodestroyallcopiesof,theSoftwarelicensedhereunder.Youmaynotdisassemble,de-compile,orreverseengineerthisSoftwareinanyway.ThisSoftwarelicensemaynotbeassignedorotherwisetransferredtoanotherwithoutourwrittenpermission.ThisSoftwaremaynotbeexportedwithouttheappropriateexportlicense.Alllicensefeesareexclusiveofanytariffs,duties,ortaxesimposedorleviedbyagovernmentorgovernmentalagency.TheSoftwareisthepropertyofMinitabInc.oritslicensorsandisprotectedbyUnitedStatescopyrightlawsandinternationaltreaties.ThisSoftwareanditsdocumentationareprovidedtotheU.S.FederalGovernmentinatransactionsubjecttotheFederalAcquisitionRegulationswithRestrictedRights.Use,duplication,ordisclosureofthesoftwarebythegovernmentissubjecttorestrictionsassetforthinFAR52.227-19CommercialComputerSoftware-RestrictedRights(48CFR52.227-19).Contractor/LicensorisMinitabInc.,QualityPlaza,1829PineHallRoad,StateCollege,Pennsylvania16801USA.ThetermsofthisLicenseAgreementdonotapplyifthisSoftwarehasbeenfurnishedtoyoupursuanttoaseparate,writtenlicenseagreementexecutedbybothparties.AnyconflictingtermscontainedinapurchaseorderfortheSoftwaresubmittedbyYouwhichhasnotbeenexecutedbyMinitabInc.areexpresslyrejected.LIMITEDWARRANTYMinitabInc.warrantsthatwehavetherighttograntthisLicensetousethisSoftwareandthatthefunctionscontainedinthisSoftwarewilloperatewithoutsubstantialprogramerrors.Intheeventofabreachoftheabovewarranties,youwillbeentitledtoarefundofallsumspaidbyyoufortherighttousethisSoftwareduringthatlicenseterm,asyoursoleandexclusiveremedyforsuchbreach.ThisSoftwareisprovidedunderthisAgreementASIS,withoutwarrantyofanykindexceptassetforthabove.ALLIMPLIEDWARRANTIESOFMERCHANTABILITYORFITNESSFORAPARTICULARPURPOSEAREEXPRESSLYDISCLAIMED.INNOEVENTSHALLMINITAB,INC.,ITSSUBSIDIARIES,DISTRIBUTORS,AGENTS,COMMISSIONAIRES,SERVICEPROVIDERS,ORSALESREPRESENTATIVESBELIABLETOYOUORANYOTHERPARTYFORANYLOSSORDAMAGE,CONSEQUENTIAL,INDIRECT,SPECIAL,INCIDENTALOROTHERWISEARISINGFROMTHEUSEOFTHISSOFTWARE.Somejurisdictionsdonotallowthelimitationorexclusionofliabilityforincidentalorconsequentialdamagessotheabovelimitationmaynotapplytoyou.May8,2003iiiTableofContents1Gettin
