TRIPsANNEX1CAGREEMENTONTRADE-RELATEDASPECTSOFINTELLECTUALPROPERTYRIGHTSPARTIGENERALPROVISIONSANDBASICPRINCIPLESPARTIISTANDARDSCONCERNINGTHEAVAILABILITY,SCOPEANDUSEOFINTELLECTUALPROPERTYRIGHTS1.CopyrightandRelatedRights2.Trademarks3.GeographicalIndications4.IndustrialDesigns5.Patents6.Layout-Designs(Topographies)ofIntegratedCircuits7.ProtectionofUndisclosedInformation8.ControlofAnti-CompetitivePracticesinContractualLicencesPARTIIIENFORCEMENTOFINTELLECTUALPROPERTYRIGHTS1.GeneralObligations2.CivilandAdministrativeProceduresandRemedies3.ProvisionalMeasures4.SpecialRequirementsRelatedtoBorderMeasures5.CriminalProceduresPARTIVACQUISITIONANDMAINTENANCEOFINTELLECTUALPROPERTYRIGHTSANDRELATEDINTER-PARTESPROCEDURESPARTVDISPUTEPREVENTIONANDSETTLEMENTPARTVITRANSITIONALARRANGEMENTSPARTVIIINSTITUTIONALARRANGEMENTS;FINALPROVISIONSAGREEMENTONTRADE-RELATEDASPECTSOFINTELLECTUALPROPERTYRIGHTSMembers,Desiringtoreducedistortionsandimpedimentstointernationaltrade,andtakingintoaccounttheneedtopromoteeffectiveandadequateprotectionofintellectualpropertyrights,andtoensurethatmeasuresandprocedurestoenforceintellectualpropertyrightsdonotthemselvesbecomebarrierstolegitimatetrade;Recognizing,tothisend,theneedfornewrulesanddisciplinesconcerning:(a)theapplicabilityofthebasicprinciplesofGATT1994andofrelevantinternationalintellectualpropertyagreementsorconventions;(b)theprovisionofadequatestandardsandprinciplesconcerningtheavailability,scopeanduseoftrade-relatedintellectualpropertyrights;(c)theprovisionofeffectiveandappropriatemeansfortheenforcementoftrade-relatedintellectualpropertyrights,takingintoaccountdifferencesinnationallegalsystems;(d)theprovisionofeffectiveandexpeditiousproceduresforthemultilateralpreventionandsettlementofdisputesbetweengovernments;and(e)transitionalarrangementsaimingatthefullestparticipationintheresultsofthenegotiations;Recognizingtheneedforamultilateralframeworkofprinciples,rulesanddisciplinesdealingwithinternationaltradeincounterfeitgoods;Recognizingthatintellectualpropertyrightsareprivaterights;TRIPsRecognizingtheunderlyingpublicpolicyobjectivesofnationalsystemsfortheprotectionofintellectualproperty,includingdevelopmentalandtechnologicalobjectives;Recognizingalsothespecialneedsoftheleast-developedcountryMembersinrespectofmaximumflexibilityinthedomesticimplementationoflawsandregulationsinordertoenablethemtocreateasoundandviabletechnologicalbase;Emphasizingtheimportanceofreducingtensionsbyreachingstrengthenedcommitmentstoresolvedisputesontrade-relatedintellectualpropertyissuesthroughmultilateralprocedures;DesiringtoestablishamutuallysupportiverelationshipbetweentheWTOandtheWorldIntellectualPropertyOrganization(referredtointhisAgreementasWIPO)aswellasotherrelevantinternationalorganizations;Herebyagreeasfollows:PARTIGENERALPROVISIONSANDBASICPRINCIPLESArticle1NatureandScopeofObligations1.MembersshallgiveeffecttotheprovisionsofthisAgreement.Membersmay,butshallnotbeobligedto,implementintheirlawmoreextensiveprotectionthanisrequiredbythisAgreement,providedthatsuchprotectiondoesnotcontravenetheprovisionsofthisAgreement.MembersshallbefreetodeterminetheappropriatemethodofimplementingtheprovisionsofthisAgreementwithintheirownlegalsystemandpractice.2.ForthepurposesofthisAgreement,thetermintellectualpropertyreferstoallcategoriesofintellectualpropertythatarethesubjectofSections1through7ofPartII.3.MembersshallaccordthetreatmentprovidedforinthisAgreementtothenationalsofotherMembers.1Inrespectoftherelevantintellectualpropertyright,thenationalsofotherMembersshallbeunderstoodasthosenaturalorlegalpersonsthatwouldmeetthecriteriaforeligibilityforprotectionprovidedforintheParisConvention(1967),theBerneConvention(1971),theRomeConventionandtheTreatyonIntellectualPropertyinRespectofIntegratedCircuits,wereallMembersoftheWTOmembersofthoseconventions.2AnyMemberavailingitselfofthepossibilitiesprovidedinparagraph3ofArticle5orparagraph2ofArticle6oftheRomeConventionshallmakeanotificationasforeseeninthoseprovisionstotheCouncilforTrade-RelatedAspectsofIntellectualPropertyRights(theCouncilforTRIPS).Article2IntellectualPropertyConventions1.InrespectofPartsII,IIIandIVofthisAgreement,MembersshallcomplywithArticles1through12,andArticle19,oftheParisConvention(1967).2.NothinginPartsItoIVofthisAgreementshallderogatefromexistingobligationsthatMembersmayhavetoeachotherundertheParisConvention,theBerneConvention,theRomeConventionandtheTreatyonIntellectualPropertyinRespectofIntegratedCircuits.Article3NationalTreatment1WhennationalsarereferredtointhisAgreement,theyshallbedeemed,inthecaseofaseparatecustomsterritoryMemberoftheWTO,tomeanpersons,naturalorlegal,whoaredomiciledorwhohavearealandeffectiveindustrialorcommercialestablishmentinthatcustomsterritory.2InthisAgreement,ParisConventionreferstotheParisConventionfortheProtectionofIndustrialProperty;ParisConvention(1967)referstotheStockholmActofthisConventionof14July1967.BerneConventionreferstotheBerneConventionfortheProtectionofLiteraryandArtisticWorks;BerneConvention(1971)referstotheParisActofthisConventionof24Ju
