Directive91/271/EECCOUNCILDIRECTIVEof21May1991concerningurbanwastewatertreatment(91/271/EEC)(JOL31,5.2.1976)THECOUNCILOFTHEEUROPEANCOMMUNITIES,HavingregardtotheTreatyestablishingtheEuropeanEconomicCommunity,andinparticularArticle130thereof,HavingregardtotheproposalfromtheCommission(1),HavingregardtotheopinionoftheEuropeanParliament(2),HavingregardtotheopinionoftheEconomicandSocialCommittee(3)WhereastheCouncilResolutionof28June1988ontheprotectionoftheNorthSeaandofotherwatersintheCommunity(4)invitedtheCommissiontosubmitproposalsformeasuresrequiredatCommunitylevelforthetreatmentofurbanwastewater;WhereaspollutionduetoinsufficienttreatmentofwastewaterinoneMemberStateofteninfluencesotherMemberStates'waters;whereasinaccordancewithArticle130r,actionatCommunitylevelisnecessary;Whereastopreventtheenvironmentfrombeingadverselyaffectedbythedisposalofinsufficiently-treatedurbanwastewater,thereisageneralneedforsecondarytreatmentofurbanwastewater;Whereasitisnecessaryinsensitiveareastorequiremorestringenttreatment;whereasinsomelesssensitiveareasaprimarytreatmentcouldbeconsideredappropriate;Whereasindustrialwastewaterenteringcollectingsystemsaswellasthedischargeofwastewateranddisposalofsludgefromurbanwastewatertreatmentplantsshouldbesubjecttogeneralrulesorregulationsand/orspecificauthorizations;Whereasdischargesfromcertainindustrialsectorsofbiodegradableindustrialwastewaternotenteringurbanwastewatertreatmentplantsbeforedischargetoreceivingwatersshouldbesubjecttoappropriaterequirements;Whereastherecyclingofsludgearisingfromwastewatertreatmentshouldbeencouraged;whereasthedisposalofsludgetosurfacewatersshouldbephasedout;Whereasitisnecessarytomonitortreatmentplants,receivingwatersandthedisposalofsludgetoensurethattheenvironmentisprotectedfromtheadverseeffectsofthedischargeofwastewaters;Whereasitisimportanttoensurethatinformationonthedisposalofwastewaterandsludgeismadeavailabletothepublicintheformofperiodicreports;WhereasMemberStatesshouldestablishandpresenttotheCommissionnationalprogrammesfortheimplementationofthisDirective;WhereasaCommitteeshouldbeestablishedtoassisttheCommissiononmattersrelatingtotheimplementationofthisDirectiveandtoitsadaptationtotechnicalprogress,(1)OJNoC1,4.1.1990,p.20andOJNoC287,15.11.1990,p.11(2)OJNoC260,15.10.1990,p.185(3)OJNoC168,10.7.1990,p.36.(4)OJNoC209,9.8.1988,p.3.(5)OJNoL158,23.6.1990,p.56.HASADOPTEDTHISDIRECTIVE:Article1ThisDirectiveconcernsthecollection,treatmentanddischargeofurbanwastewaterandthetreatmentanddischargeofwastewaterfromcertainindustrialsectors.TheobjectiveoftheDirectiveistoprotecttheenvironmentfromtheadverseeffectsoftheabovementionedwastewaterdischarges.Article2ForthepurposeofthisDirective:1.'urbanwastewater'meansdomesticwastewaterorthemixtureofdomesticwastewaterwithindustrialwastewaterand/orrun-offrainwater;2.'domesticwastewater'meanswastewaterfromresidentialsettlementsandserviceswhichoriginatespredominantlyfromthehumannmetabolismandfromhouseholdactivities;3.'industrialwastewater'meansanywastewaterwhichisdischargedfrompremisesusedforcarryingonanytradeorindustry,otherthandomesticwastewaterandrun-offrainwater;4.'agglomeration'meansanareawherethepopulationand/oreconomicactivitiesaresufficientlyconcentratedforurbanwastewatertobecollectedandconductedtoanurbanwastewatertreatmentplantortoafinaldischargepoint;5.'collectingsystem'meansasystemofconduitswhichcollectsandconductsurbanwastewater;6.'1p.e.(populationequivalent)'meanstheorganicbiodegradableloadhavingafive-daybiochemicaloxygendemand(BOD5)of60gofoxygenperday;7.'primarytreatment'meanstreatmentofurbanwastewaterbyaphysicaland/orchemicalprocessinvolvingsettlementofsuspendedsolids,orotherprocessesinwhichtheBOD5oftheincomingwastewaterisreducedbyatleast20%beforedischargeandthetotalsuspendedsolidsoftheincomingwastewaterarereducedbyatleast50%;8.'secondarytreatment'meanstreatmentofurbanwastewaterbyaprocessgenerallyinvolvingbiologicaltreatmentwithasecondarysettlementorotherprocessinwhichtherequirementsestablishedinTable1ofAnnexIarerespected;9.'appropriatetreatment'meanstreatmentofurbanwastewaterbyanyprocessand/ordisposalsystemwhichafterdischargeallowsthereceivingwaterstomeettherelevantqualityobjectivesandtherelevantprovisionsofthisandotherCommunityDirectives;10.'Sludge'meansresidualsludge,whethertreatedoruntreated,fromurbanwastewatertreatmentplants;11.'eutrophication'meanstheenrichmentofwaterbynutrients,especiallycompoundsofnitrogenand/orphosphorus,causinganacceleratedgrowthofalgaeandhigherformsofplantlifetoproduceanundesirabledisturbancetothebalanceoforganismspresentinthewaterandtothequalityofthewaterconcerned;12.'estuary'meansthetransitionalareaatthemouthofariverbetweenfresh-waterandcoastalwaters.MemberStatesshallestablishtheouter(seaward)limitsofestuariesforthepurposesofthisDirectiveaspartoftheprogrammeforimplementationinaccordancewiththeprovisionsofArticle17(1)and(2);13.'coastalwaters'meansthewatersoutsidethelow-waterlineortheouterlimitofanestuary.Article31.MemberStatesshallensurethatallagglomerationsareprovidedwithcollectingsystemsforurb
