STATUTEOFTHECOURTTheStatuteoftheInternationalCourtofJusticeisannexedtotheCharteroftheUnitedNations,ofwhichitformsanintegralpart.ThemainobjectoftheStatuteistoorganizethecompositionandthefunctioningoftheCourt.TheStatutecanbeamendedonlyinthesamewayastheCharter,i.e.,byatwo-thirdsmajorityvoteintheGeneralAssemblyandratificationbytwo-thirdsoftheStates(Art69).ShouldtheICJconsideritdesirableforitsStatutetobeamended,itmustsubmitaproposaltothiseffecttotheGeneralAssemblybymeansofawrittencommunicationaddressedtotheSecretary-GeneraloftheUnitedNations(Art70).However,therehashithertobeennoamendmentoftheStatuteoftheCourt.STATUTEOFTHEINTERNATIONALCOURTOFJUSTICETABLEOFCONTENTS:ChapterI:OrganizationoftheCourt(Articles2-33)ChapterII:CompetenceoftheCourt(Articles34-38)ChapterIII:Procedure(Articles39-64)ChapterIV:AdvisoryOpinions(Articles65-68)ChapterV:Amendment(Articles69&70)Article1TheInternationalCourtofJusticeestablishedbytheCharteroftheUnitedNationsastheprincipaljudicialorganoftheUnitedNationsshallbeconstitutedandshallfunctioninaccordancewiththeprovisionsofthepresentStatute.CHAPTERI-ORGANIZATIONOFTHECOURTArticle2TheCourtshallbecomposedofabodyofindependentjudges,electedregardlessoftheirnationalityfromamongpersonsofhighmoralcharacter,whopossessthequalificationsrequiredintheirrespectivecountriesforappointmenttothehighestjudicialoffices,orarejurisconsultsofrecognizedcompetenceininternationallaw.Article31.TheCourtshallconsistoffifteenmembers,notwoofwhommaybenationalsofthesamestate.2.ApersonwhoforthepurposesofmembershipintheCourtcouldberegardedasanationalofmorethanonestateshallbedeemedtobeanationaloftheoneinwhichheordinarilyexercisescivilandpoliticalrights.Article41.ThemembersoftheCourtshallbeelectedbytheGeneralAssemblyandbytheSecurityCouncilfromalistofpersonsnominatedbythenationalgroupsinthePermanentCourtofArbitration,inaccordancewiththefollowingprovisions.2.InthecaseofMembersoftheUnitedNationsnotrepresentedinthePermanentCourtofArbitration,candidatesshallbenominatedbynationalgroupsappointedforthispurposebytheirgovernmentsunderthesameconditionsasthoseprescribedformembersofthePermanentCourtofArbitrationbyArticle44oftheConventionofTheHagueof1907forthepacificsettlementofinternationaldisputes.3.TheconditionsunderwhichastatewhichisapartytothepresentStatutebutisnotaMemberoftheUnitedNationsmayparticipateinelectingthemembersoftheCourtshall,intheabsenceofaspecialagreement,belaiddownbytheGeneralAssemblyuponrecommendationoftheSecurityCouncil.Article51.Atleastthreemonthsbeforethedateoftheelection,theSecretary-GeneraloftheUnitedNationsshalladdressawrittenrequesttothemembersofthePermanentCourtofArbitrationbelongingtothestateswhicharepartiestothepresentStatute,andtothemembersofthenationalgroupsappointedunderArticle4,paragraph2,invitingthemtoundertake,withinagiventime,bynationalgroups,thenominationofpersonsinapositiontoacceptthedutiesofamemberoftheCourt.2.Nogroupmaynominatemorethanfourpersons,notmorethantwoofwhomshallbeoftheirownnationality.Innocasemaythenumberofcandidatesnominatedbyagroupbemorethandoublethenumberofseatstobefilled.Article6Beforemakingthesenominations,eachnationalgroupisrecommendedtoconsultitshighestcourtofjustice,itslegalfacultiesandschoolsoflaw,anditsnationalacademiesandnationalsectionsofinternationalacademiesdevotedtothestudyoflaw.Article71.TheSecretary-Generalshallpreparealistinalphabeticalorderofallthepersonsthusnominated.SaveasprovidedinArticle12,paragraph2,theseshallbetheonlypersonseligible.2.TheSecretary-GeneralshallsubmitthislisttotheGeneralAssemblyandtotheSecurityCouncil.Article8TheGeneralAssemblyandtheSecurityCouncilshallproceedindependentlyofoneanothertoelectthemembersoftheCourt.Article9Ateveryelection,theelectorsshallbearinmindnotonlythatthepersonstobeelectedshouldindividuallypossessthequalificationsrequired,butalsothatinthebodyasawholetherepresentationofthemainformsofcivilizationandoftheprincipallegalsystemsoftheworldshouldbeassured.Article101.ThosecandidateswhoobtainanabsolutemajorityofvotesintheGeneralAssemblyandintheSecurityCouncilshallbeconsideredaselected.2.AnyvoteoftheSecurityCouncil,whetherfortheelectionofjudgesorfortheappointmentofmembersoftheconferenceenvisagedinArticle12,shallbetakenwithoutanydistinctionbetweenpermanentandnon-permanentmembersoftheSecurityCouncil.3.IntheeventofmorethanonenationalofthesamestateobtaininganabsolutemajorityofthevotesbothoftheGeneralAssemblyandoftheSecurityCouncil,theeldestoftheseonlyshallbeconsideredaselected.Article11If,afterthefirstmeetingheldforthepurposeoftheelection,oneormoreseatsremaintobefilled,asecondand,ifnecessary,athirdmeetingshalltakeplace.Article121.If,afterthethirdmeeting,oneormoreseatsstillremainunfilled,ajointconferenceconsistingofsixmembers,threeappointedbytheGeneralAssemblyandthreebytheSecurityCouncil,maybeformedatanytimeattherequestofeithertheGeneralAssemblyortheSecurityCouncil,forthepurposeofchoosingbythevoteofanabsolutemajorityonenameforeachseatstillvacant,tosubmittotheGeneralAssemblyandtheSecurityCouncilfortheirrespectiveacceptance.2.Ifthejointconferenceisu
