DIRECTIVE2014/53/EUOFTHEEUROPEANPARLIAMENTANDOFTHECOUNCILof16April2014ontheharmonisationofthelawsoftheMemberStatesrelatingtothemakingavailableonthemarketofradioequipmentandrepealingDirective1999/5/EC(TextwithEEArelevance)THEEUROPEANPARLIAMENTANDTHECOUNCILOFTHEEUROPEANUNION,HavingregardtotheTreatyontheFunctioningoftheEuropeanUnion,andinparticularArticle114thereof,HavingregardtotheproposalfromtheEuropeanCommission,Aftertransmissionofthedraftlegislativeacttothenationalparliaments,HavingregardtotheopinionoftheEconomicandSocialCommittee(1),Actinginaccordancewiththeordinarylegislativeprocedure(2),Whereas:(1)Directive1999/5/ECoftheEuropeanParliamentandoftheCouncil(3)hasbeensubstantiallyamendedseveraltimes.Sincefurtheramendmentsaretobemade,itshouldbereplacedintheinterestsofclarity.(2)Regulation(EC)No765/2008oftheEuropeanParliamentandoftheCouncil(4)laysdownrulesontheaccredita­tionofconformityassessmentbodies,providesaframeworkforthemarketsurveillanceofproductsandforcontrolsonproductsfromthirdcountries,andlaysdownthegeneralprinciplesoftheCEmarking.(3)DecisionNo768/2008/ECoftheEuropeanParliamentandoftheCouncil(5)laysdowncommonprinciplesandreferenceprovisionsintendedtoapplyacrosssectorallegislationinordertoprovideacoherentbasisforrevisionorrecastsofthatlegislation.Directive1999/5/ECshouldthereforebeadaptedtothatDecision.(4)TheessentialrequirementslaiddowninDirective1999/5/ECwhicharerelevanttofixed-lineterminalequipment,i.e.toensuretheprotectionofhealthandsafetyofpersonsandofdomesticanimalsandtheprotectionofprop­ertyandanadequatelevelofelectromagneticcompatibility,areappropriatelycoveredbyDirective2014/35/EUoftheEuropeanParliamentandoftheCouncil(6)andDirective2014/30/EUoftheEuropeanParliamentandoftheCouncil(7).ThisDirectiveshouldthereforenotapplytofixed-lineterminalequipment.22.5.2014L153/62OfficialJournaloftheEuropeanUnionEN(1)OJC133,9.5.2013,p.58.(2)PositionoftheEuropeanParliamentof13March2014(notyetpublishedintheOfficialJournal)anddecisionoftheCouncilof14April2014.(3)Directive1999/5/ECoftheEuropeanParliamentandoftheCouncilof9March1999onradioequipmentandtelecommunicationsterm­inalequipmentandthemutualrecognitionoftheirconformity(OJL91,7.4.1999,p.10).(4)Regulation(EC)No765/2008oftheEuropeanParliamentandoftheCouncilof9July2008settingouttherequirementsforaccredita­tionandmarketsurveillancerelatingtothemarketingofproductsandrepealingRegulation(EEC)No339/93(OJL218,13.8.2008,p.30).(5)DecisionNo768/2008/ECoftheEuropeanParliamentandoftheCouncilof9July2008onacommonframeworkforthemarketingofproducts,andrepealingCouncilDecision93/465/EEC(OJL218,13.8.2008,p.82).(6)Directive2014/35/EUoftheEuropeanParliamentandoftheCouncilof26February2014ontheharmonisationofthelawsofMemberStatesrelatingtothemakingavailableonthemarketofelectricalequipmentdesignedforusewithincertainvoltagelimits(OJL96,29.3.2014,p.357).(7)Directive2014/30/EUoftheEuropeanParliamentandoftheCouncilof26February2014ontheharmonisationofthelawsoftheMemberStatesrelatingtoelectromagneticcompatibility(OJL96,29.3.2014,p.79).(5)CompetitionissuesinthemarketforterminalequipmentareappropriatelycoveredbyCommissionDirective2008/63/EC(1),inparticularthroughtheobligationfornationalregulatoryauthoritiestoensurethepublicationofdetailsoftechnicalinterfacespecificationsfornetworkaccess.ItisthereforenotnecessarytoincludeinthisDirectiverequirementsfacilitatingcompetitioninthemarketforterminalequipmentcoveredbyDirective2008/63/EC.(6)Equipmentwhichintentionallyemitsorreceivesradiowavesforthepurposeofradiocommunicationorradiode­terminationmakessystematicuseofradiospectrum.Inordertoensureanefficientuseofradiospectrumsoastoavoidharmfulinterference,allsuchequipmentshouldfallwithinthescopeofthisDirective.(7)TheobjectiveswithrespecttosafetyrequirementslaiddowninDirective2014/35/EUaresufficienttocoverradioequipment,andshouldthereforebethereferenceandmadeapplicablebyvirtueofthisDirective.Inordertoavoidunnecessaryduplicationsofprovisionsotherthanthoseconcerningsuchrequirements,Directive2014/35/EUshouldnotapplytoradioequipment.(8)TheessentialrequirementsintheareaofelectromagneticcompatibilitylaiddownbyDirective2014/30/EUaresufficienttocoverradioequipment,andshouldthereforebethereferenceandmadeapplicablebyvirtueofthisDirective.Inordertoavoidunnecessaryduplicationsofprovisionsotherthanthoseconcerningessentialrequire­ments,Directive2014/30/EUshouldnotapplytoradioequipment.(9)ThisDirectiveshouldapplytoallformsofsupply,includingdistanceselling.(10)Inordertoensurethatradioequipmentusestheradiospectrumeffectivelyandsupportstheefficientuseofradiospectrum,radioequipmentshouldbeconstructedsothat:inthecaseofatransmitter,whenthetransmitterisproperlyinstalled,maintainedandusedforitsintendedpurposeitgeneratesradiowavesemissionsthatdonotcreateharmfulinterference,whileunwantedradiowavesemissionsgeneratedbythetransmitter(e.g.inadjacentchannels)withapotentialnegativeimpactonthegoalsofradiospectrumpolicyshouldbelimitedtosuchalevelthat,accordingtothestateoftheart,harmfulinterferenceisavoided;and,inthecaseofareceiver,ithasal
