1ContractofEmployment伊莱特翻译提供*二八七六七三八七三零*PartyA:XXXXXXXXXXXXXXXXXXXXXXXXXXXX.PartyB:XXX2XXXXXXXXX.(hereinafterreferredtoasPartyA),regardingtheemploymentofXXX(hereinafterreferredtoasPartyB)asitsemployeeunderlaborcontractsystem,throughnegotiationswithPartyBonthebasisofLaborLaw,BeijingMunicipalRegulationsontheManagementofLaborandHumanResourcesinForeign-investedEnterprisesaswellasrelevantnationallawsandregulations,concludedthisContractofEmployment(hereinafterreferredtoastheContract)withPartyBasfollows.1.REFERENCEThisContractisformulatedaccordingtotheLaborLaw,relevantnationallawsandregulationsaswellastheEmployeeManual,variousrulesandregulationsofPartyA(hereinafterreferredtoasRegulationsofPartyA).2.DURATIONOFTHECONTRACTThedurationofthisContractisfromApril1,2001toMarch31,2002foraperiodofoneyear.3.WORKPOST&RESPONSIBILITIES3.1Accordingtothestatusofbothparties,PartyAassignsPartyBtoworkinXXXXXXXXXXXXasasystemengineer.3.2PartyAhastherighttoadjusttheworkpostofPartyBaccordingtotheability,workperformance,healthandetc.ofPartyB.Withoutanyjustification,PartyBshallobeythearrangementandadjustmentofPartyAonhisworkpost.3.3PartyBshallcompletetheworkaccordingtotheworkresponsibilitiesstipulatedbyPartyAandobservetheRegulationsofPartyA.4.WORKINGHOURSANDLEAVE4.1PartyA,accordingtonationalregulations,adoptsaworkingsystemof40hoursaweek,specifically,from9:00to17:30ofeachMondaythroughFriday(includingonehoureachdayforlunch).4.2PartyB,withinthevalidityofthisContract,enjoysholidaysandvacationsstipulatedbythenationincludingofficialholidays,marriageleave,leaveforthe3deadandetc.4.3PartyB,accordingtotheregulationsofPartyA,enjoysannualvacationwithsalary.5.LABORPROTECTION&SAFETY5.1PartyAprovidesasafeandhealthyworkingenvironmentincompliancewiththestipulationsofChineseGovernmentforPartyB,soastoensurethatPartyBcanworkinanenvironmentthatwillnotharmthepersonalsafetyandthebodyofPartyB.5.2PartyBhastheobligationtoobservevariousregulationsonsafetyandsanitationstipulatedbyrelevantgovernmentalagencies,PartyAandpropertyownersofthebusinesslocationrentedbyPartyA.6.PAYFORTHEEMPLOYEE6.1ThemonthlysalaryofPartyBisRMBXXXXYuan(beforetax),theannualsalaryofPartyBisthecombinationofthemonthlysalariesof13months.6.2PartyAwill,accordingtotheworkperformanceofPartyB,adjustthesalaryofPartyBataroundyear.ThelevelofadjustmentwillbedeterminedbyPartyA.6.3PartyB’spersonalincometaxwillbedeductedandpaidbyPartyAonbehalfofPartyB.7.LABORINSURANCE&WELFARE7.1PartyA,accordingtoBeijingMunicipalrelevantregulations,shallpayforPartyBforold-ageinsurance,accumulationfundforhousing,unemploymentinsurance,sickinsurance,laborinjuryandmedicalinsuranceandotherkindsofinsurancestipulatedbythenation.7.2WhenPartyBisillorinjuredotherthanhappenedduringhiswork,thedailysalaryduringhissickleaveshallbe:halfofthedailysalarywithinasickleaveofoneweek;one-thirdofthedailysalaryforasickleavefromoneweektoonemonth;2timesofthelocallowestsalaryforasickleavefromonemonthtothreemonthsandabove.Whenaskingforasickleaveofmorethantwodays,PartyBshallpresentasickcertificateissuedbydoctor.8.LABORDISCIPLINE,REWARDS&PUNISHMENTS8.1PartyA,accordingtorelevantnationalrulesandregulations,formulates,amends4andexecutestheRegulationsofPartyA,PartyBshallstrictlyobservetheRegulationsofPartyA.8.2PartyAwill,accordingtotheRegulationsofPartyAandtheworkperformanceofPartyB,rewardorpunishPartyBaccordingly.9.UPDATE,REMOVAL,TERMINATION&RENEWALOFTHECONTRACT9.1Ifanylaws,administrativerulesandregulationsreferredtobythisContractchanges,thecontentsofthisContractshallbeupdatedaccordingly.9.2IftheobjectiveconditionsreferredtobythisContractexperiencesgreatchangesthatwillresultinnon-fulfillmentoftheContract,andthroughnegotiationsandagreementofbothparties,therelevantcontentsofthisContractcanbeupdated.9.3ThisContractcanbecancelledafternegotiationsandagreementofbothPartyAandPartyB.9.4ThisContractwillbecancelledif:9.4.1PartyBisprovednotqualifiedfortheemploymentconditionsofPartyAduringtrialemploymentperiod;9.4.2PartyBseverelyviolatestheRegulationsofPartyAanddisclosestheconfidentialinformationtoanauthorizedthirdparty;9.4.3PartyBseverelyneglectshisdutiesandaffectstheregularoperationsofPartyA,whichwillresultineconomiclossesofPartyA;9.4.4PartyBviolatesthelawandhiscriminalresponsibilitiesislegallyinvestigatedorheisputunderlaborcorrection;9.5Ifanyofthefollowinghappened,PartyAcancancelthisContract,butPartyAneedstoissueawrittennoticetoPartyBthirtydaysaheadofthecancellation,orpayasalaryof30daysascompensation:9.5.1Duetosicknessorout-of-dutyinjuryandafterthestipulatedperiodformedicaltreatment,PartyBcandoneithertheoriginalworknoranyotherworkassignedbyPartyA;9.5.2WhenPartyBisnotcompetentathiswork,andthroughtrainingoradjustmentofhisworkpostandheisstillnotequaltohisduties;9.5.3TheobjectiveconditionsreferredtobythisContracthavebeenchangedthatresultsinnon-fulfillmentofthisContract,throughnegotiationsbutbothpartiesareunabletoreachanagreementontheupdatingofthisContract.59.6Whenanyofthefollowinghappened,PartyBcan,atanytime,notifyPartyAtocanceltheContract:9.6.1Duringthetrialemploymentperio
