LawofthePeople'sRepublicofChinaonRoadTrafficSafety(OrderofthePresidentNo.8)OrderofthePresidentofthePeople'sRepublicofChinaNo.8TheLawofthePeople'sRepublicofChinaonRoadTrafficSafety,adoptedatthe5thMeetingoftheStandingCommitteeoftheTenthNationalPeople'sCongressofthePeople'sRepublicofChinaonOctober28,2003,isherebypromulgatedandshallgointoeffectasofMay1,2004.HuJintaoPresidentofthePeople'sRepublicofChinaOctober28,2003LawofthePeople'sRepublicofChinaonRoadTrafficSafety(Adoptedatthe5thMeetingoftheStandingCommitteeoftheTenthNationalPeople'sCongressonOctober28,2003)ContentsChapterIGeneralProvisionsChapterIIVehiclesandDriversSection1MotorVehiclesandNon-motorVehiclesSection2DriversofMotorVehiclesChapterIIIConditionsforRoadPassageChapterIVProvisionsonRoadPassageSection1GeneralProvisionsSection2ProvisionsonthePassageofMotorVehiclesSection3ProvisionsonthePassageofNon-motorVehiclesSection4ProvisionsonthePassageofPedestriansandRidersSection5SpecialProvisionsonExpresswaysChapterVDispositionofTrafficAccidentsChapterVISupervisionofLaw-enforcementChapterVIILegalResponsibilityChapterVIIISupplementaryProvisionsChapterIGeneralProvisionsArticle1ThisLawisenactedwithaviewtomaintainingroadtrafficorder,takingprecautionsagainstandreducingtrafficaccidents,protectingpersonalsafety,safeguardingthesafetyofpropertyandotherlawfulrightsandinterestsofcitizens,legalpersonsandotherorganizations,andincreasingpassageefficiency.Article2WithintheterritoryofthePeople'sRepublicofChina,thedriversofvehicles,pedestrians,passengersandtheunitsandindividualsinvolvedinroadtrafficactivitiesshallobservethisLaw.Article3Workforroadtrafficsafetyshallbecarriedoutinadherencetotheprinciplesofconductingadministrationaccordingtolawandmakingthingsconvenienttothemasses,toguaranteegoodorder,safetyandunimpededflowofroadtraffic.Article4People'sgovernmentsatvariouslevelsshallguaranteethattheadministrativeworkforroadtrafficsafetyfitswiththeeconomicandsocialdevelopment.Inordertomeettheneedsofroadtrafficdevelopment,alllocalpeople'sgovernmentsatorabovethecountylevelshall,inaccordancewiththelawsandregulationsonroadtrafficsafetyandtherelevantpoliciesoftheState,workoutadministrationplansforroadtrafficsafety,andtakechargeoftheirimplementation.Article5ThedepartmentforpublicsecurityundertheStateCouncilshallbeinchargeoftheadministrativeworkforroadtrafficsafetynationwide.Thetrafficcontroldepartmentofthepublicsecurityorgansunderthelocalpeople'sgovernmentsatorabovethecountylevelshallbeinchargeoftheadministrativeworkforroadtrafficsafetywithintheirrespectiveadministrativeareas.Thetrafficcontroldepartmentsandtheconstructionadministrationdepartmentsunderthepeople'sgovernmentsatorabovethecountylevelshallbeinchargeofrelevantroadtrafficworkincompliancewiththeirrespectiveduties.Article6People'sgovernmentsatvariouslevelsshallconductregulareducationinroadtrafficsafetysoastoenhancecitizens'awarenessoftheimportanceofroadtrafficsafety.Whenperformingtheirduties,trafficcontroldepartmentsofthepublicsecurityorgansandtheirtrafficpolicemenshallgivemorepublicitytothelawsandregulationsonroadtrafficsafety,andobservesuchlawsandregulationsinanexemplaryway.Governmentdepartments,armedunits,enterprises,institutions,publicassociationsandotherorganizationsshalloffereducationinroadtrafficsafetytotheirownmembers.Administrativedepartmentsofeducationandschoolsshallincorporateeducationinroadtrafficsafetyintoeducationinthelegalsystem.Thenewsmediaandpublishing,radioandTV,andotherrelevantinstitutionsshallhavethedutytoconducteducationinroadtrafficsafety.Article7Scientificresearchinadministrativeworkforroadtrafficsafetyshallbepromoted,andadvancedadministrationmethods,technologyandequipmentshallbeusedonawidescale.ChapterIIVehiclesandDriversSection1MotorVehiclesandNon-motorvehiclesArticle8TheStatepractisesaregistrationsystemformotorvehicles.Amotorvehicleshallbedrivenonroadsonlyafteritisregisteredwiththetrafficcontroldepartmentofapublicsecurityorgan.Whereamotorvehicleisnotyetregisteredbutneedstobedrivenonroadstemporarily,atemporarypassshallbeobtained.Article9Thefollowingcertificatesandvouchersshallbesubmittedforapplicationfortheregistrationofamotorvehicle:(1)certificateofidentificationoftheownerofthevehicle;(2)certificateofthemannerinwhichthevehicleisobtained;(3)certificateofoutgoingqualityforthewholevehicleorcertificateofimportlicenseforthevehicleimported;(4)paymentreceiptofvehiclepurchasetaxordutyfreecertificate;and(5)othercertificatesorvoucherstobesubmittedasrequiredbytheprovisionsoflawsandadministrativeregulationsforregistrationofmotorvehicles.Thetrafficcontroldepartmentofapublicsecurityorganshallfinishtheexaminationforregistrationofamotorvehiclewithinfiveworkingdaysfromthedateitreceivestheapplicationandshall,iftheconditionsprovidedforintheproceedingparagrapharemet,issuetheregistrationcertificate,numberplateandlicenseforthevehicle;andifthesaidconditionsarenotmet,thedepartmentshallexplainthereasonswhythevehicleisnottoberegistered.Unitsandindividuals,otherthanthetrafficcontroldepartmentsofthepublicsecurityorgans,shallnotissuenum
