PICCP&CDTVHULLCLAUSES1978(AsamendedinApril1984)(OriginaltextinGermanwhichshalltakeprecedence)1RelationshiptotheGermanGeneralRulesofMarineInsurance(ADS)TheDTVHullClausestakeprecedenceovertheADS.2PeriodofInsurance2.1Theinsurancecommencesandexpiresonthedatesmentioned.ThisappliesalsotoavesselwhichisenrouteatthetimewhentheinsuranceexpiresinaccordancewithArticle68ADS.2.2TheAssuredmay,however,submitadeclarationtoUnderwritersbeforeexpiryoftheinsurancetotheeffectthattheinsurancebeextendedintheeventthatthevesselisenroutewhentheinsuranceexpiresandsustainsindemnifiabledamageimpairingherseaworthiness.Theextensionexpiresassoonastherepairshavebeencarriedoutor-ifrepairsarenotcarriedoutimmediately-whenthedamagehasbeenascertained.3InsurableValueTheagreedhullvaluationshallbeconsideredastheinsurablevalueandcomprisesthevessel,themechanicalequipment,appurtenancesandinstallations.4AppurtenancesandInstallations4.1AppurtenancesareincludedintheinsuranceevenifthesearenotthepropertyoftheAssured.4.2Equipmentiscoveredagainstpartiallossordamageonlyifcausedbyfireorexplosion.5PartsremovedfromthevesselPartsoftheinsuredvesselandherappurtenances,whicharetemporarilyremovedfromthevessel,remaininsured.Anyotherexistinginsuranceshalltakeprecedenceoverthisinsurance.6InsurancesonDisbursementsandFreight6.1Additionalinsurancesforshipowner'saccountarepermittedasfollows:upto15%ofthehullvaluationondisbursementsandequipmentandupto20%ofthehullvaluationonfreight.Amountsinsuredonequipmentandfreightnotatriskshallbedeemedtobecoveredondisbursements.6.2Intheeventoftotalloss,Underwritersareentitledtodemandadeclarationofalladditionalinsurancestakenoutforshipowner'saccount.6.3Ifadditionalinsurancesarecoveredforhigheramountsthanthosepermittedabove,Underwritersaredischargedfromliabilityinrespectofthesehigheramountsintheeventoftotalloss.7TradingWarranties(accordingtoagreement)7.1EuropeanTradingTheinsuranceappliestovoyagesbetweenallEuropeanplacesandallplacesintheMediterraneanandBlackSea,limitedtothenorthbythe70thdegreeLat.N.,excludingGreenland,butincludingdirectvoyagestoandfromKirkenesandMurmanskandvoyagestoandfromtheWhiteSea,providedthatontheoutwardvoyagethevesseldoesnotpassHonnigsvaagpriortothe10thMayanddoesnotcommencethereturnvoyagefromthelastportofcallatWhiteSeaafterthe31stOctober,tothesouthbytheAtlanticCoastofAfricauptoandincludingCasablanca,tothewestbyandincludingIceland,butexcludingtheCanaryIslandsandtheAzores.7.2WorldwideTradingTheinsuranceappliestovoyagestoandfromallplaces.Excluded,however,arevoyages1.northof70°Lat.N.exceptvoyagesdirecttoandfromKirkenesandMurmanskandvoyagestoandfromtheWhiteSeaprovidedthatontheoutwardvoyagethevesseldoesnotpassHonnigsvaagpriortothe10thMayanddoesnotcommencethereturnvoyagefromthelastportofcallattheWhiteSeaafterthe31stOctober,2.toandfromGreenland,3.southof50°Lat.S.exceptvoyagestoandfromplacesintheArgentine,ChileandFalklandIslandsandvoyagestoandfromplacesofthepermittedtradingarea,4.NorthAmerica:attheAtlanticCoastnorthof52°10'Lat.N.andwestof50°Long.W.,southof52°10'Lat.N.intheareawithinthelinesBattleHarbour/PistoletBay;CapeRay/CapeNorth;PortHawkesbury/PortMulgraveandBaieComeau/Matanebetween21stDecemberand30thAprilb.d.i.,westofthefineBaieComeau/Matane(butnotwestofMontreal)between1stDecemberand30thAprilb.d.i.,ontheGreatLakesortheSt.LawrenceSeawaywestofMontreal,onthePacificCoastnorthof54°30'Lat.N.orwestof13°50'Long.W.,5.EastAsiatoandfromtheBehring-Sea,northof46°Lat.N.andSiberiaexceptVladivostokandNakhodka,6.IndianOceantoandfromtheKerguelen,CrozetIslandsandPrinceEdwardIslands,7.WarrantednottosailwithIndiancoalascargo-between1stMarchand30thJuneb.d.i.,-between1stJulyand30thSeptemberb.d.i.,exceptvoyagestoplacesinAsia,notwestofAdenandnoteastofSingapore.7.3Breachoftheagreedtradingwarrantiesshallbedeemedtobeanalterationofrisk.8PremiumPayment8.1Thepremiumistobepaidinadvanceforeach3months'period.8.2Additionalpremiumsshallbepaidtogetherwiththefollowingquarterlyinstalment.8.3Thediscountis7.5%.ThepremiummustbereceivedbyUnderwriterswithin10daysaftercommencementofthe3months'period.Ifthepaymentiseffectedthroughabroker,thepremiummustbereceivedbyhimwithintheabovementionedperiodandmustbepassedonimmediately,butitmustbereceivedbyUnderwriterswithinfurthersever,daysatthelatest.8.4Ifthepremiumisnotreceivedwithintheabovementionedperiods,nodiscountwillbegrantedfromthecommencementofthe3months'periodduringwhichthedelayhasoccurred;Underwritershavethentherighttocanceltheinsurancewithinaperiodof5days.IfUnderwriterscanceltheinsurance,thecoverwillterminatewithArticles67and68ADSbeingcancelledonexpiryofthe5thdayafterthenoticeofcancellationhasbeenreceivedbytheAssured,unlesstheinsurancehasterminatedearlier.8.5IfUnderwriterspaytheamountinsuredorthedifferencebetweentheamountinsuredandtheproceedsinaccordancewithArticle77ADS,theannualpremiumispayable.Theportionoftheannualpremiumwhichhasnotyetbeenpaidinadvanceistobepaidwithoutdeductionofadiscount,butwiththedeductionofanyreturnswhichtheAssuredisentitledtoreceive.8.6TheAssuredmayoffsetanycounterclaimswhichhavenotyetbecomedueagain
