COMMISSIONREGULATION(EC)No552/2009of22June2009amendingRegulation(EC)No1907/2006oftheEuropeanParliamentandoftheCouncilontheRegistration,Evaluation,AuthorisationandRestrictionofChemicals(REACH)asregardsAnnexXVII(TextwithEEArelevance)THECOMMISSIONOFTHEEUROPEANCOMMUNITIES,HavingregardtotheTreatyestablishingtheEuropeanCommunity,HavingregardtoRegulation(EC)No1907/2006oftheEuropeanParliamentandoftheCouncilof18December2006concerningtheRegistration,Evaluation,AuthorisationandRestrictionofChemicals(REACH),establishingaEuropeanChemicalsAgency,amendingDirective1999/45/ECandrepealingCouncilRegulation(EEC)No793/93andCommissionRegulation(EC)No1488/94aswellasCouncilDirective76/769/EECandCommissionDirectives91/155/EEC,93/67/EEC,93/105/ECand2000/21/EC(1),andinparticularArticle131thereof,Whereas:(1)CouncilDirective76/769/EECof27July1976ontheapproximationofthelaws,regulationsandadministrativeprovisionsoftheMemberStatesrelatingtorestrictionsonthemarketinganduseofcertaindangeroussubstancesandpreparations(2)establishedinitsAnnexIrestrictionsforcertaindangeroussubstancesandpreparations.Regulation(EC)No1907/2006repealsandreplacesDirective76/769/EECwitheffectfrom1June2009.AnnexXVIItothatRegulationreplacesAnnexItoDirective76/769/EEC.(2)Article67ofRegulation(EC)No1907/2006providesthatsubstances,mixturesorarticlesmaynotbemanu­factured,placedonthemarketorusedunlesstheycomplywiththeconditionsofanyrestrictionslaiddownintheirregardinAnnexXVII.(3)Directive2006/122/ECoftheEuropeanParliamentandoftheCouncilof12December2006amendingforthe30thtimeCouncilDirective76/769/EEC(perfluor­ooctanesulfonates(PFOS))(3)andCommissionDirective2006/139/ECof20December2006amendingCouncilDirective76/769/EECasregardsrestrictionsonthemarketinganduseofarseniccompoundsforthepurposeofadaptingitsAnnexItotechnicalprogress(4)amendingAnnexItoDirective76/769/ECwereadoptedshortlybeforeRegulation(EC)No1907/2006wasadopted,inDecember2006,buttherestrictionsconcernedhavenotyetbeenincludedinAnnexXVIItothatRegulation.ThereforeAnnexXVIIshouldbeamendedtoincludetherestrictionscorre­spondingtoDirectives2006/122/ECand2006/139/ECasotherwisetherestrictionsconcernedwillberepealedon1June2009.(4)PursuanttoArticle137(3)ofRegulation(EC)No1907/2006,anyamendmenttotherestrictionsadoptedunderDirective76/769/EECfrom1June2007istobeincorporatedinAnnexXVIItothatRegulationwitheffectfrom1June2009.(5)Directive2007/51/ECoftheEuropeanParliamentandoftheCouncilamendingCouncilDirective76/769/EECrelatingtorestrictionsonthemarketingofcertainmeasuringdevicescontainingmercury(5)wasadoptedon25September2007.Decision1348/2008/ECoftheEuropeanParliamentandCouncilamendingCouncilDirective76/769/EECasregardsrestrictionsonthemarketinganduseof2(2-methoxyethoxy)ethanol,2-(2-butoxyethoxy)ethanol,methylenediphenyldiisocyanate,cyclohexaneandammoniumnitrate(6)wasadoptedon16December2008.TherestrictionsconcernedhavenotyetbeenincludedinAnnexXVIItothatRegulation.AnnexXVIIshouldbeamendedtoincorporatetherestrictionsoncertainmeasuringdevicescontainingmercuryadoptedunderDirective2007/51/ECandtherestrictionson2(2-methoxyethoxy)ethanol,2-(2-butox­yethoxy)ethanol,methylene-diphenyldiisocyanate,cyclo­hexaneandammoniumnitrateadoptedunderDecision1348/2008/EC.(6)AccountshouldbetakenoftherelevantprovisionsofRegulation(EC)No1272/2008onclassification,labellingandpackagingofsubstancesandmixtures,amendingandrepealingDirective67/548/EECand1999/45/EC,andamendingRegulation(EC)No1907/2006(7).(7)SincetheprovisionsofTitleVIIIofRegulation(EC)No1907/2006andinparticularAnnexXVIIaretobedirectlyapplicablefrom1June2009,therestrictionsshouldbeclearlydraftedinordertoallowoperatorsandenforcementauthoritiestoapplythemcorrectly.Thereforethedraftingoftherestrictionsshouldbereviewed.TheterminologyforthedifferententriesshouldbeharmonisedandmademorecoherentwiththedefinitionscontainedinRegulation(EC)No1907/2006.EN26.6.2009OfficialJournaloftheEuropeanUnionL164/7(1)OJL396,30.12.2006,p.1.(2)OJL262,27.9.1976,p.201.(3)OJL372,27.12.2006,p.32.(4)OJL384,29.12.2006,p.94.(5)OJL257,3.10.2007,p.13.(6)OJL348,24.12.2008,p.108.(7)OJL353,31.12.2008,p.1.(8)CouncilDirective96/59/ECof16September1996onthedisposalofpolychlorinatedbiphenylsandpoly­chlorinatedterphenyls(PCB/PCT)(1)requiresthatequipmentcontainingPCBsandPCTsisdecontaminatedanddisposedofassoonaspossibleandsetstheconditionsforthedecontaminationofequipmentcontainingthosesubstances.ThereforetheentryinAnnexXVIItoRegulation(EC)1907/2006concerningPCTsshouldnotincludeprovisionconcerningequipmentcontainingPCTsasthatisfullyregulatedunderDirective96/59/EC.(9)Theexistingrestrictionsforthesubstances2-naphthy­lamine,benzidine,4-nitrobiphenyl,4-aminobiphenylareambiguousasitisunclearwhethertheprohibitionconcernsonlythesupplytothegeneralpublicoralsothesupplytoprofessionalusers.Theseshouldbeclarified.SinceCouncilDirective98/24/ECof7April1998ontheprotectionofthehealthandsafetyofworkersfromtherisksrelatedtochemicalagents(2)prohibitstheproduction,manufactureanduseatworkofthosesubstances,therestrictionsinAnnexXVIItoRegulation(EC)No1907/2006relatin
