AdvancePaymentGuaranteeTo:Date:Advisedthrough:From:BankofCommunicationsbranchDearSirs:Ourirrevocableletterofguaranteeno..WhereasyousignedthecontractNo.(hereinaftercalledthecontract)with(hereinafterreferredastheapplicant)andattherequestoftheapplicant,We,BankofCommunicationsbranch,herebyestablishinyourfavorthisindependentL/Gforthemaximumamountof(sayonly)(hereinafterreferredtoastheguaranteedamount)coveringtheadvancepaymentandthecorrespondinginterestunderthecontract.Weundertaketopayyoutheamountspecifiedinyourdemand,within7bankingbusinessdaysuponreceiptofyourwrittendemandandstatementstatingtheeffectandtheaspectoftheapplicant’sdefaultinfulfillmentofanyofhisobligationforwhichtheadvancepaymentismade,providedthattheaggregateamountclaimeddoesnotexceedtheguaranteedamount.Theguaranteedamountshallautomaticallyandproportionallyreduceaccordingtotheprogressofthecontract,whichisevidencedbyourreceiptofthedocument（s）fromtheapplicant.Unlessexpresslyconsentedbyusinwritten,anymodification,amendment,oralterationoftheContractshallrelieveourobligationunderthisL/G.Unlessexpresslyconsentedbyusinwritten,thisguaranteeisnottransferableorassignable.Theformation,validity,interpretation,performance,terminationordisputeresolutionwithrespecttothisL/GshallbegovernedandconstruedunderthelawsofthePeople’sRepublicofChina.AnydisputesorclaimarisingoutoforinrelationtothisL/GshallbegovernedbythecourtsofthePeople’sRepublicofChina.Thisguaranteeshallcomeintoforcefromourreceiptofthestatementbytheapplicantstatingthatitreceivestheadvancepayment,andremainsvaliduntil.Anyclaimshouldreachourcounteronorbeforethatday.Uponexpiry,thisL/Gshallautomaticallybecomenullandvoidandbecancelledwhetheritisreturnedtousornot.Exceptexpresslystatedherein,thisL/Gissubjectto.
