ProductQualityLawofthePeople'sRepublicofChinaAdoptedatthe30thMeetingoftheStandingCommitteeoftheSeventhNationalPeople'sCongressonFebruary22,1993AmendedinaccordancewiththeDecisionsonAmendingtheProductQualityLawofthePeople'sRepublicofChinawhichwasadoptedatthe24thSessionoftheStandingCommitteeoftheNinthNationalPeople'sCongressonOctober27,2001ContentsChapterIGeneralPrinciplesChapterIISupervisionandControlofProductQualityChapterIIIResponsibilitiesandObligationsofProducersandSellersChapterIVCompensationforDamageChapterVPenaltyProvisionsChapterVISupplementaryProvisionsChapterIGeneralPrinciplesArticle1Thelawhasbeenformulatedwithaviewtoreinforcingthesupervisionandregulationofproductquality,improvingthequalityofproducts,clarifyingtheliabilitiesforproductquality,protectingthelegitimaterightsandinterestsofconsumersandsafeguardingthesocialandeconomicorder.Article2ThelawappliestoallproductionandmarketingactivitieswithintheterritoryofthePeople'sRepublicofChina.Productsmentionedinthelawarereferredtoproductsprocessedandmanufacturedforthepurposeofmarketing.Thislawisnotapplicabletoconstructionprojects.However,theconstructionmaterials,structuralcomponentsandfittingsandequipmentthatfallwithinthecategoryasprovidedinthepreviousparagraphshallbegovernedbythislaw.Article3Producersandsellersshallhavetheirownproperregulationsforthemanagementofproductquality,rigorouslyimplementingpost-orientedqualityregulations,qualityliabilitiesandrelevantmeasuresfortheirassessment.Article4Producersandsellersareresponsiblefortheproductqualityaccordingtotheprovisionsofthelaw.Article5Itisforbiddentoforgeorinfringeuponqualitymarkssuchascertificationmarksandmarksforfinequalityproducts;itisforbiddentoforgetheplaceoforigin,forgeorinfringeuponthefactorynames,factoryaddresses;itisforbiddentoproduceormarketadulteratedproductsortousefakegoodsasgenuineorsub-standardproductsasstandard.Article6TheStateencouragestheuseofscientificqualitycontrolmethodsandadoptionofadvancedscienceandtechnologybyenterprisestomaketheirproductssurpassthestandardssetbythevarioustrades,theStatestandardsandeveninternationalstandardsintheirproductqualityandawardsunitsandindividualswhohavemadeoutstandingachievementsinqualitycontrolandinbringingtheproductqualityuptotheadvancedinternationallevels.Article7Thepeople'sgovernmentatalllevelsshallensuretheimplementationofthislawbyincorporatingtheimprovementofproductqualityintotheirplansfornationaleconomyandsocialdevelopment,reinforcingtheintegratedplanningandorganizationregardingproductquality,guiding,supervisingandurgingtheproducersandsellerstoreinforcethemanagementofproductqualityandimprovethequalityofproducts,organizingrelevantdepartmentstolawfullytakingmeasuresforstoppingthoseactsthatviolatethislawintheprocessofproductproductionandproductselling.Article8TheproductqualitysupervisionandadministrationdepartmentsoftheStateCouncilareresponsibleforthesupervisionandadministrationofthequalityofproductsofthewholecountry.AllrelevantdepartmentsoftheStateCouncilshallberesponsibleforthesupervisionofproduct1/9qualitywithintheirownfunctionsandduties.Localadministrationsforthesupervisionofproductqualityatandabovethecountylevelareresponsibleforthesupervisionofproductqualitywithintheirownadministrativejurisdictions.Therelevantdepartmentsofthelocalpeople'sgovernmentsatandabovethecountylevelareresponsiblefortheproductqualitywithintheirrespectivefunctionsandduties.Iftherearedifferentprovisionsconcerningthesupervisiondepartmentsofproductquality,suchprovisionsshallbeapplied.Article9Thestaffmembersofthepeople'sgovernmentsatalllevelsandotherstateorgansmaynotabusetheirpower,neglecttheirdutiesormisconducttoseekprivateinterests,coveruporgiveloosetotheactsviolatingthislawthatoccurswithinthelocalityorwithintheindustry,hinderormeddlewiththeinvestigationofactsviolatingthislawthatoccurredintheprocessoftheproducingorsellingproducts.Whereanyofthelocalpeople'sgovernmentsorotherstateorganscoversuporgiveloosetotheviolationsofthislawthatoccurredintheproductionorsellingofproducts,thepersonwhoisheldtobemainlyresponsibleshalltakelegalliabilities.Article10Anyentityorindividualisentitledtoreporttotheproductqualitysupervisionadministrationsorotherrelevantdepartmentsaboutanyoftheactsviolatingthislaw.Theproductqualitysupervisiondepartmentandrelevantdepartmentsshallholdallinformationaboutthereporterasconfidentialandgiveawardstothereporterinaccordancewiththeprovisionsoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.Article11Noentityorindividualmaypreventanyofthequalifiedproductsproducedoutsideoftheregionortradefromenteringtheregionortrade.ChapterIISupervisionandControlofProductQualityArticle12Qualityofproductsshallpassstandardexaminationsandnosub-standardproductsshallbeusedasstandardones.Article13IndustrialproductswhichmaybehazardoustothehealthofthepeopleandthesafetyoflivesandpropertyshallconformtotheStateandtradestandardsforensuringthehealthofthehumanbodyandsafetyoflivesandproperty.InabsenceofsuchStateortradestandards,theproductsshallconformtotheminimumrequirementsf
